HomeMy WebLinkAbout666-97 Cemetery ' 111111111111111111111111111111111111111111111111Rcpt: 17057 Rec: c8.50 DS° 0.00 I T: 0.00 97086812 08/04/97 ---• —__ Doty Clerk JED PITT IAN, PASCO COUNTY CLERZ ORDINANCE NO.: 6 6 6 , 08/04/97 03:44p 1 of G OR BK Z3-47E3.4 PG Z5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA, ESTABLISHING RULES AND REGULATIONS FOR THE OPERATION OF THE CITY'S CEMETERY; THE CONDUCT OF PERSONS THEREIN; THE CONSTRUCTION OF VAULTS, MEMORIALS AND MAUSOLEUMS; AND PROVIDING A PENALTY FOR THE VIOLATION OF ITS TERMS. WHEREAS, the City Council of the City of Zephyrhills has determined that it is in the best interest of the citizens of the City of Zephyrhills to provide for rules and regulations for the operation of the city's cemetery;the conduct of persons therein; and the construction of vaults, memorials and mausoleums thereto. NOW THEREFORE, be it ordained by the City Council of the City of Zephyrhills, Florida, sitting in regular session, as follows: SECTION 1-Definitions: The term "City" shall apply to and mean the City of Zephyrhills, a Florida municipal corporation. The term "lot" shall apply to numbered divisions as shown on the recorded plats of the municipal cemetery of the City. The term"owner" shall mean any person, firm, or corporation who has purchased a lot, part lot, or grave space in the cemetery, or the heirs, personal representatives or successors of such owners. The term"interment right" shall mean the right of all owners to use the cemetery grounds for the interment of deceased persons. This interment right belongs to the owner of the cemetery lot, part lot, or grave space, and is subject to the rules and regulations contained therein. The term "memorial" shall mean any marker or structure upon or in any lot and placed thereupon or therein, or partially therein, for the purpose of identification or in memory of the interred. SECTION 2.-Conduct in the Cemetery: a. No person shall break or injure any tree or shrub, or deface any landmark, marker, or memorial, or in any way deface the grounds of the cemetery. b. The hours of admission to the cemetery shall be from sunup to sundown. It shall be unlawful for any person to be within the cemetery grounds except during said hours of admission. c. Persons within the cemetery grounds shall use only established walk ways and roads. d. No person may consume alcoholic beverages with the cemetery, or carry same into the premises. e. No person may discharge a firearm within the grounds of the cemetery except during an official military type funeral or an official Memorial Day service. f. No person shall throw rubbish or debris on walks, drives, or any part of the cemetery. h. Unauthorized persons shall not loaf, lounge, or otherwise use any of the grounds, graves or monuments in the cemetery, or in any of the buildings therein. i. No loud or profane talking shall be permitted on the cemetery grounds. j. No person except the owner or caretaker shall pluck or remove any plant or flower from any part of the cemetery, or injure anything upon any part of the grounds. k. Children are not to play within the cemetery grounds. 111 1. No boxes, statues, shells, toy, discarded glassware, sprinkling cans or similar articles will be permitted on any grave, lot or tree. - m. Dogs and other domestic animals are strictly prohibited from entering the cemetery. This provision shall not apply to guide or service dogs, pursuant to Florida Statute 413.08. n. Rubbish shall be deposited in the proper receptacles. SECTION 3.-Motor Vehicles: a. Motor vehicles shall not be driven through the cemetery grounds at a speed greater than 5 miles per hour. b. Motor vehicles shall be driven and parked on designated roadways only. c. Motor vehicles shall not be parked in front of an open grave unless the occupants thereof are in attendance at a funeral. d. The traffic laws of the city of Zephyrhills shall be applicable to the operation of motor vehicles in the cemetery. e. Heavy trucks or cominerciai-vehicles, unless on-official cemetery business;are- - prohibited from entering the grounds. SECTION 4.-Administration and Maintenance: a. The control and management of the cemetery shall be under direct supervision of the city manager or appointed staff, who will administer this ordinance. b. All grading, landscaping work, care of trees and shrubs, and location of grave spaces shall be done only under the supervision of the city manager or appointed staff. - ] c. The city manager or appointed staff shall direct all improvements within the grounds an upon all lots and graves, before as well as after interments have been made therein. d. In the event any improvements or alterations of individual property in the cemetery shall be made without prior approval of the city manager or appointed staff, the City of Zephyrhills shall ave the right to remove such improvements or alterations. e. Vases shall be permitted only if properly installed_ -and maintained. Failure to properly install or maintain fixtures will be cause for their removal. The city manager or appointed staff shall be the sole judge as to the proper installation and maintenance of such vases. f. Fences, coping enclosures, structures of wood or concrete and hedges are prohibited. Those structures or enclosures established on any lot prior to the operation of these rules and regulations,which have, in judgment of the City of Zephyrhills,become unsightly by reason of neglect or age, shall, after thirty days written notice to the owner, be removed by the City at its expense. 2 ` OR BK PG a7� 3of6 g. No elevated mounds shall be built over graves, and no lots shall be filled above the grade established by the city manager or appointed staff h. Potted plants,wreaths and baskets,live or artificial flowers and all other decorations, shall be removed from lots and graves as soon as such flowers or decorations become wilted or unsightly. i. Any flowers or decorations must be placed in the general vicinity of the memorial marker. All decorations shall not interfere with the mowing, trimming and normal maintenance of the cemetery grounds. j.- rally memorial or structure,or-any-inscription-placed on-same,-shal_1_be-determined -- _ -_ by the city manager or staff to be offensive, the City of Zephyrhills shall have the right to enter upon any lot and remove, change or correct the offensive or improper object to objects. k. No tree, shrub or flower shall be planted upon any lot, or in any other part of the cemetery,with the exception of plantings performed by the City of Zephyrhills, approved by the city manager or appointed staff. SECTION 5-Funeral Regulations and Burials: a. No person, firm or corporation shall cause the interment of any deceased person, install vaults, or conduct ceremonies within the municipal cemetery of the City of Zephyrhills unless a permit for the same has been obtained from the city clerk, and that such interment, interment fees, installation of vaults, and ceremonies shall be in strict compliance with the provisions of this ordinance. b. Any person, firm or corporation arranging the interment of a deceased person shall not less than(24)hours prior to such interment make application therefor to the city clerk for a burial permit. The burial permit shall show the following information: i. Name of deceased person; ii. Place of death; • iii. Date of death; iv. Location of grave, including block, lot and grave number; v. Owner of said lot; vi. Next of kin, guardian or executor of will; vii. Applicant's signature; and viii. Approval of the City Clerk of the City of Zephyrhills. c. A one time interment fee must be paid in full prior to the commencement of any burial. Interment fees shall be set by city council. d. The burial of two bodies in one grave is prohibited, except in the case of a mother and infant buried at the same time, or in the case of twin children buried on the same day. e. No more than two cremains shall be buried in any full size grave. f. Cremains lots shall contain only one burial per lot. g. Every earth interment shall be made enclosed in a concrete vault. A concrete vault, provided by the funeral directors shall be of a type approved by the city manager or staff, and installed 3 OR BK .37B4- PG 4of6 as aforementioned. h. No funeral design or floral piece shall be permitted to remain the cemetery for more than 10 days. i. No animals or pets shall be buried in the cemetery. SECTION 6.-Installations, Markers, Monuments: a. No person,firm or corporation shall install monuments, grave markers, slabs or coping within the municipal cemetery without first obtaining a permit from the city clerk and pay permit fee. no such permit shall be issued until the city clerk finds: i. That the application for such permit has a proper and valid occupational license issued by the City of Zephyrhills. ii. That the applicant for such permit has not violated any of the regulations provided in this ordinance. iii. That the installation of the monument, grave marker, slab, service marker and or coping shall be in accordance with the regulations provided in this ordinance. b. All graves shall be marked. c. Sizes and dimensions of markers are as follows: i. Family memorial: Width: Not less than 14 inches and not more than 24 inches. Length: Not less than 42 inches and not more than 72 inches. ii. Individual markers: Width: Not less than 12-inches and not mote than 18 inches. Length: Not less than 24 inches and not more than 36 inches. iii. Cremains area markers: Family memorial Width: Not more than 11 inches. Length: Not more than 23 inches. Individual markers: Width: Not more than 11 inches. Length: Not more than 11 inches. d. With the exception of existing markers in sections one through eight, all markers must be of the flush with ground variety. These markers shall be installed at ground level and may contain inverted type vases which can be inverted when not in use. e. Persons installing monuments or markers-Will be responsible for the cleanup of-the installation site. Pieces of sod and other debris shall be cleaned up at the time of installation. f. The City of Zephyrhills will not be responsible for any theft, vandalism or damaged monuments, vases, markers, or decorations. g. All memorials shall be set on uniform lines, as prescribed by the cemetery, to conform to the general plan of the cemetery. h. With the exception of funeral directors'markers, memorials of cement, artificial stone, composition, wood, tin or iron are prohibited. SECTION 7-Lot Sales: a. Sale of all lots,part lots, or grave spaces shall be a function of the city clerk. The city clerk may refuse to sell any lot, part lot or grave space to any,person or corporation if such sale would violate the Florida State law prohibiting speculation in cemetery property. b. The deed of ownership for any cemetery plot willnot be delivered to any purchaser until the purchase price of the plot has been paid to the city clerk in full. After 30 days a one time ten percent(10%)fee will be charged on the unpaid balance. e. No cemetery lot or burial space shall be sold, transferred or conveyed by any owner without consent to transfer being first had from the city clerk, and no such transfer or conveyance shall be made unless all assessments and charges against the lot or burial space are paid in full. All transfers must be recorded on the permanent records of the city cemetery. f. Cemetery lot refunds will be provided in the cause of an un-recorded deed only. 40% of the monies that were paid towards the purchase price shall be refunded by the City of Zephyrhills. Any refunds must be recorded by the city clerk. g. The sale price of all lots or grave spaces shall be set by the City Council of the City of Zephyrhills. SECTION 8-Records of Ownership: The city clerk shall keep full and complete records of the ownership of all lots in the cemetery, of the burial capacity of each lot, sold and unsold, of the location of each grave, of the names of the persons buried in each grave that has been or shall hereafter be used, and of the date of each burial. SECTION 9-Penalty for Violation: Any violation of the provisions hereto, upon conviction thereof, shall be punished by a fine not to exceed $500.00. SECTION 10-Effective date: The provisions of this Ordinance shall become effective upon second reading and signing by the Mayor.
