HomeMy WebLinkAbout685-98 Adopt Amendments to Comp Plan 111111111111111111111111111101 IIIII 111111111 1111 98030925 ,,- Rept: 223929 Rec: 15.00 DS: 0.00 IT: 0.00 ORDINANCE NO. 685 03/18/98 _ Dpty Clerk AN ORDINANCE OF THE CITY OF ZEPHYRIIIJLS, FLORIDA, A MUNICIPAL CORPORATION, ADOPTING SMALL SCALE AMENDMENTS TO THE COMPREHENSIVE PLAN TO INCLUDE ADDITIONAL TERRITORY AND AMEND THE FUTURE LAND USE MAP IN ACCORDANCE WITH CHAPTER 163.3187 FLORIDA STATUTES JED PITTMAN, PASCO COUNTY CLERK 03/18/98 04:19pe 1 of 3 OR BK .238.9c.3 PG 1 ZI WHEREAS,the City of Zephyrhills, Florida, is adopting an amended Future Land Use map and small scale amendments to the Comprehensive Plan of said City, to include certain parcels of land annexed into the corporate limits of the City of Zephyrhills upon the petition of its owners, with said parcels and owners itemized below: 1. Nye property,which parcel contains approximately.3 acres and is located at the northwest corner of Fort King Road, and U.S. 301. Proposed City Future Land Use: Commercial 2. Grace property,which parcel contains approximately 1.7 acres and is located on the south side of Pretty Pond Road, and east of Wire Road. Proposed City Future Land Use: Residential 3. Baugniet/Unity Lanes property, which parcel contains approximately 2.3 acres and is located on the east side of U.S. 301, and north ofEiland Boulevard. Proposed City Future Land Use: Commercial 4. Moats Property,which parcel contains approximately 5.87 acres and is located on the east side of 16th Street, south of Pretty Pond Road and north of 54 East. Proposed City Future Land Use: Residential 5. Great Springs Water of America, Inc., Property, which parcel contains approximately 6.1 acres and is located on the east side of 20th Street and south of Alston Avenue. Proposed City Future Land Use: Industrial WHEREAS,the City also is amending all maps of said Comprehensive Plan to include, show, and depict said annexed properties; providing that all goals, objections,.policies, and other planning provisions applicable to properties in the Comprehensive Plan shall pertain and be applicable to the annexed properties; providing that invalidity of said portion shall not affect the remaining portions of this Ordinance; and providing for an effective date, and WHEREAS, by City of Zephyrhills Ordinances 660, 661, 663;,6p9, 681, respectively, the above-described real properties were annexed by the City and incorporated within the municipal boundaries of the City of Zephyrhills; real property described in Exhibit "A" attached hereto and by this reference incorporated herein and made a part thereof; and WHEREAS,the Zephyrhills City Council has requested the Zephyrhills Planning Commission, as the local planning agency of the City, to recommend inclusion of this property in the City's Comprehensive Plan; and WHEREAS, based on the recommendation of the Planning CoM fission to,the Zephyrhills City Council, said Council has prepared a small scale amendment to the City's Comprehensive Plan and is hereby transmitting it to the Department of Community Affairs and such other agencies as Record and Return to: x >;_ City Clerk's Office .1 5335 8th Street Zephyrhills, FL 33540 QR BK Si3S03, PG i IZITE3, 2 of 3 required by Section 163.3184, Florida Statutes; and WHEREAS,the City Council of the City of Zephyrhills desires to thereby formally adopt the small scale amendment to the City's Comprehensive Plan. } . BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows: SECTION1: The following small scale amendments to the Comprehensive Plan of the City of Zephyrhills are hereby proposed: (a) All maps depicting land use, traffic circulation, public facilities, recreational sites, and housing have been amended to include, show and depict the annexed properties described above. Copies of the maps as hereby amended are attached as Exhibit "B" to this Ordinance and are hereby incorporated by reference. (b) All necessary data and analyses with references to the annexed properties are included with Exhibit "A". All prior review of these properties are included and labeled Exhibit "B": SECTION 2: All goals, objectives, policies and other planning provisions applicable to. properties within the City of Zephyrhills as shown and set forth in the Comprehensive Plan of the City of Zephyrhills are hereby expressly made applicable and pertinent to the property described on Exhibit SECTION3: The above small scale amendment shall be forwarded to the State of Florida, Department of Community Affairs for their appropriate review and comment. SECTION 4: The provisions of this Ordinance are severable, and if any section, sentence, clause, or phrase is for any reason held to be unconstitutional, invalid, or ineffective, this holding shall not affect the validity of the remaining portions of the Ordinance,it being expressly declared to be the City Council's intent that it would have passed the valid portions of this Ordinance without the inclusion of any invalid portion or portions. SECTIONS: This Ordinance shall become effective immediately upon its passage.
