WHEREAS, pursuant to the requirement of Chapter 163, Part II, Florida Statutes, and Rule 9J-5, Florida Administrative Code, the City Council of the City Zephyrhills adopted a Comprehensive Plan for the City of Zephyrhills on June 20, 1989 by Ordinance No.: 506; and WHEREAS, Section 163.3191,Florida Statutes, and Section 9J-5.0053, Florida Administrative Code, required the City of Zephyrhills to conduct an evaluation and appraisal of the adopted Comprehensive Plan; and WHEREAS, said evaluation and appraisal was intended to assess and evaluate the success or failure of the Comprehensive Plan, including the validity of the projections, the realization of the goals and objectives, and the implementation of the Plan's policies; and WHEREAS,following a public hearing on June 24, 1996,the City Council of the City of Zephyrhills adopted the Evaluation and Appraisal Report (EAR); and WHEREAS, Section 9J-5.0053(1),Florida Administrative Code, states that the Evaluation and Appraisal Report shall be used to form the basis for Amendments which update the Comprehensive Plan; and Record and Return to: �. City Clerk's Office : , 5335 8th Street ti70 Zephyrhills, FL 33540 OR BK 3935 PG 1492 2 o 3 WHEREAS,from October 1997 to March 1998 the City of Zephyrhills'Planning Commission, sitting as the Local Planning Agency and Staff, reviewed the adopted EAR and prepared the necessary EAR-Based Comprehensive Plan amendments; including the amendments necessitated by the revision of the minimum Comprehensive Plan criteria contained in Rule 9J-5, Florida Administrative Code. NOW THEREFORE, be it ordained by the City Council of the City of Zephyrhills, Florida, as follows: SECTION 1. Purpose and Intent: Pursuant to the provisions of Section 9J- 5.005(1)(c), Florida Adm;nistrative Code, the City Council of the City of Zephyrhills does hereby amend Ordinance No.: 506 in its entirety. SECTION 2.Adoption of Comprehensive Plan: Pursuant to the provisions of Section 9J-5.005, Florida Administrative Code, the City Council of the City of Zephyrhills does hereby adopt the Comprehensive Plan, which includes the following: i. Future Land Use Element, Goals, Objectives Policies and Maps LU-1, LU-2, LU-3; ii. Transportation Element, Goals, Objectives, Policies and Maps TRA-1, TRA-2, TRA-3, TRA-4, TRA-5; iii. Public Facilities Element, Goals, Objectives, Policies.and Maps PF-1, PF-2, PF-3; iv. Housing Element, Goals, Objectives,Policies•and Map HOU-1; v. Recreation and Open Space Element, Goals;Objectives,Policies and Map REC-1; vi. Conservation Element, Goals, Objectives,-Policies; vii. Capital Improvements Element and Concurrent Management System, Goals, Objectives and Policies; viii. Intergovernmental Coordination Element, Goals, Objectives, and Policies; ix. Public Participation Procedures; and x. Monitoring and Evaluation Procedures. SECTION 3.-Severability: If any section, phrase, sentence or portion of this Ordinance is for any reason held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions thereof. SECTION 4.-Effective Date: The effective date of this plan amendment shall be the date of publication by the Florida Department of Community Affairs of a Notice of Intent to find the Plan Amendment in compliance with Section 163.3184(9), Florida Statutes as amended or the date the Administration Commission issues a final order determining the adopted amendment to be in compliance pursuant to Section 163.3184 (10), Florida Statutes as amended. If a final order of noncompliance is issued by the Administration Commission, this amendment may nevertheless be made effective by adoption of a resolution affirming its effective status pursuant to Section 163.3189(2)(b), OR BK .739Zn PG 3 of 3 Florida Statutes, as amended.
