FLORIDA STATUTES mo� a Cr, WHEREAS,the City of Zephyrhills, Florida, is adopting an amended Future Land Use map and small scale amendment to the Comprehensive Plan of said City, to include that certain parcel of =n land annexed into the corporate limits of the City of Zephyrhills upon the petition of its owner, with said parcel and owner itemized below: �° 1- ,^,c • • Townview Arts Medical Center Partnership, which parcel contains approximately 9.8 acres 0 moand is located west of Greenslope Drive and south of Oak Run Apartments. Land Use: Residential WHEREAS,the City also is amending all maps of said Comprehensive Plan to include, show, and depict said annexed property; providinthat all goals, objections, policiesand other planning ��m provisions applicable to properties in the Comprehensive Plan shall pertain and be.applicable to the wry annexed property; providing that invalidity of said portion shall not-affect the remaining portions of rJJm this Ordinance; and providing for an effective date, and WHEREAS,by City of Zephyrhills Ordinance No.: 679, the above-described real property ! o 1) was annexed by the City and incorporated within the municipal boundaries of the City of Zephyrhills; �.o - o n real property described in Exhibit "A" attached hereto and by this reference incorporated herein and 9,E made a part thereof, and -< P WHEREAS,the Zephyrhills City Council has requested the Zephyrhills Planning Commission, (.11 m as the local planning agency of the City, to recommend inclusion of this property in.the City's Comprehensive Plan; and WHEREAS, based on the recommendation of the Planning Commission to the Zephyrhills City Council, said Council has prepared a small scale amendment to the City's-Comprehensive Plan and is hereby transmitting it to the Department of Community Affairs and such other agencies as required by Section 163.3184, Florida Statutes; and - WHEREAS,the City Council of the City of Zephyrhills desires to thereby formally adopt the small scale amendment to the City's Comprehensive Plan. BE IT ORDAINED by the City Council of the City of Zephyrhills,Florida, as follows: SECTION 1: The following small scale amendments to the Comprehensive Plan of the City of Zephyrhills are hereby proposed: (a) All maps depicting land use, traffic circulation, public facilities, recreational sites, and housing have been amended to include, show and depict the annexed property described above. Copies of the maps as hereby amended are attached as Exhibit "B" to this Ordinance and are hereby rl wj1 s' incorporated by reference. SECTION 2: All goals, objectives, policies and other planning provisions applicable to properties within the City of Zephyrhills as shown and set forth in the Comprehensive Plan of the City of Zephyrhills are hereby expressly made applicable and pertinent to the property described on Exhibit SECTION 3: The above small scale amendment shall be forwarded to the State of Florida, Department of Community Affairs for their appropriate review and comment. SECTION 4: The provisions of this Ordinance are severable, and if any section, sentence, clause, or phrase is for any reason held to be unconstitutional, invalid, or ineffective, this holding shall not affect the validity of the remaining portions of the Ordinance, it being expressly declared to be the City Council's intent that it would have passed the valid portions of this Ordinance without the inclusion of any.invalid portion or portions.
