ORDINANCE NO.: 696
AN EMERGENCY ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF ZEPHYRHILLS,
FLORIDA, PROHIBITING THE SALE AND USE OF
FIREWORKS WITHIN THE CITY OF
ZEPHYRHILLS FOR A PERIOD OF FIFTEEN (15)
DAYS FROM THE EFFECTIVE DATE HEREOF, OR
UNTIL SUCH TIME AS THE TERMINATION OF
THE EXISTING STATE OF EMERGENCY;
PROVIDING FOP PENALTIES .HERETO; AND -
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS,the State of Florida is experiencing a series of extensive forest and brush fires,
including Pasco County, Florida, due to abnormally dry whether conditions; and ,
WHEREAS, the State Division of Emergency Management has determined that as of June
24, 1998 such fires have burned more than 100,000 acres; and
WHEREAS, the Governor of the State of Florida has issued Executive'Order 98-41, dated
June 7, 1998, declaring a state of emergency throughout Florida as.a result of the continuing fires;
and
WHEREAS,the Governor's Executive Order expressly recognizes the extreme potential for
additional fires that may threaten life and property;
WHEREAS,the State Division of Emergency Management has determined that the state of
Florida will continue to experience whether conditions conducive to fire activity; and
WHEREAS,the State Division of Forestry has issued a ban on burning permits throughout
the State, including Pasco County;and
WHEREAS, the sale and personal use of fireworks and sparklers, as well as the discarding
of lit cigarette butts outdoors unnecessarily increase the risk of additional fire in the City of
Zephyrhills with the attendant risk to life and property.
NOW THEREFORE, be it ordained' by the City Council of the City of Zep'hyrhills,
Florida, sitting in emergency session, that:
1. A State of Emergency does hereby exists, as a result of the conditions set forth
and the preamble hereto.
2. That during the local State of Emergency, the personal sale and use of
fireworks and sparklers, as well the discarding of lit cigarette butts outdoors shall
hereby be prohibited.
3. The violation of this Ordinance by any person shall constitute a misdemeanor
in the second degree punishable pursuant to Florida Statute 775.082 or 775.083.

4. In the event any section, paragraph, subsection, sentence, clause, phrase, or
word of this ordinance shall for'any reason be held unconstitutional, invalid or ineffective, thesame
shall-not repeal,nullify or in any way affect any other section, paragraph, subsection, sentence, clause
or portion of this ordinance irrespective of any other section, paragraph, subsection, sentence, clause
or portion thereof.
5. This Ordinance shall become effective immediately upon passage and shall
remain in effect for 15 days or until the State of Emergency no longer exists for Pasco County, as
determined by the Florida Department of Forestry, whichever occurs first.
