HomeMy WebLinkAbout700-98 Adopt Small Scale Amendment to Comp Plan I ORDINANCE NO. 7 0 0 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, A MUNICIPAL iIMMO CORPORATION, ADOPTING A SMALL SCALE AMENDMENT TO THE COMPREHENSIVE PLAN TO INCLUDE ADDITIONAL TERRITORY AND AMEND THE FUTURE LAND USE MAPS IN ACCORDANCE WITH CHAPTER 163.3187 FLORIDA STATUTES WHEREAS,the City of Zephyrhills, Florida, is adopting an amended Future Land Use map and a small scale amendment to the Comprehensive Plan of said City, to include a certain parcel of land annexed into the corporate limits of the City of Zephyrhills upon the petition of its owner, with min said parcel and owner itemized below: 4.0 • 1. Iglesia Evangelica Internacional Soldados De La Cruz De Cristo, Inc., a Florida not- for-profit Corporation,which parcel contains approximately.6 acres and is located on the North side of 6th Avenue and East of 24th Street. Proposed City Future Land Use: Church =n WHEREAS,the City also is amending all maps of said Comprehensive Plan to include, show, and depict said annexed property; providing that all goals, objections, policies, and other planning 1: provisions applicable to properties in the Comprehensive Plan shall pertain and be applicable to the 28g annexed property; providing that invalidity of said portion shall not affect the remaining portions of this Ordinance; and providing for an effective date, and WHEREAS,by City of Zephyrhills Ordinances No.: 698, the above-referenced real property was annexed by the City and incorporated within the municipal boundaries of the City of Zephyrhills; - _. Parcel No.: 12-26-21-002B-00700-0020 ; ® CO Q mop WHEREAS,the Zephyrhills City Council has requested the Zephyrhills PlanningCommission, ! E as the local planning agency of the City, to recommend inclusion of this property in the City's Comprehensive Plan; and I 7 .. WHEREAS, based on the recommendation of the Planning Commission to the Zephyrhills City Council, said Council has prepared a small scale amendment to the City's Comprehensive Plan and is hereby transmitting it to the Department of Community Affairs and such other agencies as required by Section 163.3184,Florida Statutes; and WIIEREAS,the City Council of the City of Zephyrhills desires to thereby formally adopt the small scale amendment to the City's Comprehensive Plan. BE IT ORDAINED by the City Council of the City of Zephyrhills,Florida, as follows: SECTION 1: The following small scale amendment to the Comprehensive Plan of the City of Zephyrhills is hereby proposed: Record and Return to: City Clerk's Office e •4 5335 8th Street Zephyrhills, FL 33540 OR BK '9BB PG a-G4- 2of2 (a) All maps depicting land use, traffic circulation, public facilities, recreational sites, and housing have been amended to include, show and depict the annexed property more particularly described above. Copies of the maps as hereby amended are attached as Exhibit "A" to this Ordinance and are hereby incorporated by reference. (b) All necessary data and analyses with references to the annexed property is included within the description herein. All prior reviews of the property are included and labeled Exhibit "A". SECTION 2: All goals, objectives, policies and other planning provisions applicable to properties within the City of Zephyrhills as shown and set forth in the Comprehensive Plan of the City of Zephyrhills are hereby expressly made applicable and pertinent to the real property described herein. SECTION3: The above small scale amendment shall be forwarded to the State of Florida, Department of Community Affairs for their appropriate review and comment. SECTION 4: The provisions of this Ordinance are severable, and if any section, sentence, clause, or phrase is for any reason held to be unconstitutional,invalid, or ineffective, this holding shall not affect the validity of the remaining portions'of the Ordinance, it being expressly declared to be the City Council's intent that it would have passed the valid portions of this Ordinance without the inclusion of any invalid portion or portions. SECTION 5: This Ordinance shall become effective immediately upon its passage.
