AN ORDINANCE OF THE CITY OF
ZEPHYRHILLS, FLORIDA, A MUNICIPAL
CORPORATION, ADOPTING SMALL SCALE
AMENDMENT TO THE COMPREHENSIVE PLAN
TO INCLUDE ADDITIONAL TERRITORY AND
AMEND THE FUTURE LAND USE MAP IN
ACCORDANCE WITH CHAPTER 163.3187
FLORIDA STATUTES
WHEREAS,the City of Zephyrhills, Florida, is adopting an amended Future Land Use map
and small scale amendment to the Comprehensive Plan of said City, to include those certain parcels
of lands annexed into the corporate limits of the City of Zephyrhills upon the petitions of its owners
or agents, with said parcels and owners itemized below:
Concire,Inc.,which parcel contains approximately 4 acres and is located West of Greenslope
Drive and North of Spanish Trails Mobile Home Park. Proposed City Future Land Use: Single
Family Residential.
Larry Kirkpatrick and Cathy Kirkpatrick, his wife, which parcel contains approximately
17,996.25 square feet and is located at the Southwest intersection of Eiland Boulevard and US 301.
Proposed City Future Land Use: Community Commercial.
James H Mahoney and Caro R Mahoney, his wife, which parcel contains approximately
17,996.25 square feet and is located at the Southwest intersection of Eiland Boulevard and US 301.
Proposed City Future Land Use: Community Commercial.
James D.Haycox,which parcel contains approximately 17,996.25 square feet and is located
at the Southwest intersection of Eiland Boulevard and US 301. Proposed City Future Land Use:
Community Commercial.
Scott R Sanders,which parcel contains approximately 17,996.25 square feet and is located
at the Southwest intersection of Eiland Boulevard and US 301. Proposed City Future Land Use:
Community Commercial.
Pasco County, a political subdivision, which right-of-way contains approximately.46 and
is located at the Southwest intersection of Eiland Boulevard and US 301.
WHEREAS,the City also is amending all maps of said Comprehensive Plan to include, show,
and depict said annexed properties; providing that all goals, objections, policies, and other planning
provisions applicable to properties in the Comprehensive Plan shall pertain and be applicable to the
annexed properties; providing that invalidity of said portions shall not affect the remaining portions
of this Ordinance; and providing for an effective date, and
WHEREAS, by City of Zephyrhills Ordinance No.: 710, the Concire, Inc., real property
described above was annexed by the City and incorporated within the municipal boundaries of the
City of Zephyrhills; real property described in Exhibit "A" attached hereto and by this reference
incorporated herein and made a part thereof; and
WHEREAS,by City of Zephyrhills Ordinance No.: 712, the Larry Kirkpatrick and Cathy
Kirkpatrick, his wife;James H Mahoney and Cam R Mahoney, his wife; James D. Haycox and
Scott E. Sanders, real property described above and Pasco.County's right-of-way was annexed by
the City and incorporated within the municipal boundaries of the City of Zephyrhills; real proplerty
described in Exhibit"B", as Parcel "A" "B" "C" "D" and "E" is attached hereto and by this refer nce
incorporated herein and made a part thereof; and
WHEREAS,the Zephyrhills City Council has requested the Zephyrhills Planning Commiss on,
as the local planning agency of the City, to recommend inclusion of these properties in the City's
Comprehensive Plan; and
WHEREAS, based on the recommendation of the Planning Commission to the Zephyr ' is
City Council, said Council has prepared a small scale amendment to the City's Comprehensive lan
and is hereby transmitting it to the Department of Community Affairs and such other agencies as
required by Section 163.3184,Florida Statutes; and
WHEREAS,the City Council of the City of Zephyrhills desires to thereby formally adopt the
small scale amendment to the City's Comprehensive Plan.
BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows
SECTIONI: The following small scale amendments to the Comprehensive Plan of the City
of Zephyrhills are hereby proposed:
(a) All maps depicting land use, traffic circulation, public facilities, recreational sites, and
housing have been amended to include, show and depict the annexed properties described ab ve.
Copies of the maps as hereby amended are attached as Exhibit "C" to this Ordinance and are he eby
incorporated by reference. -
(b) All necessary data and analyses with references to the annexed properties are included
with Exhibit "A" and Exhibit "B". All prior reviews of these properties are included and lab led
Exhibit "C".
SECTION 2: All goals, objectives, policies and other planning provisions applicabl to
properties within the City of Zephyrhills as shown and set forth in the Comprehensive Plan of the ity
of Zephyrhills are hereby expressly made applicable and pertinent to the properties describe on
Exhibit "A" and Exhibit "B".
SECTION3: The above small scale amendment shall be forwarded to the State of Flo 'da,
Department of Community Affairs for their appropriate review and comment.
SECTION 4: The provisions of this Ordinance are severable, and if any section, sente ce,
clause, or phrase is for any reason held to be unconstitutional,invalid, or ineffective, this holding hall
not affect the validity of the remaining portions of the Ordinance, it being expressly declared to be
the City Council's intent that it would have passed the valid portions of this Ordinance without the
inclusion of any invalid portion or portions.
SECTIONS: This Ordinance shall become effective immediately upon its passage.
