AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ZEPHYRHILLS, FLORIDA,
ENACTING PROCEDURES FOR ENFORCEMENT
OF THE CODE OF ZEPHYRHILLS; PROVIDING
FOR ISSUANCE OF CITATION TO VIOLATORS;
PROVIDING FOR THE CREATION OF A
UNIFORM FINE SCHEDULE; PROVIDING FOR
PAYMENT OF FINES OR REQUEST FOR
HEARING; PROVIDING FOR ASSESSMENT OF
PENALTIES UPON DETERMINATION OF GUILT;
PROVIDING FOR ISSUANCE OF WARNING;
PROVIDING FOR SANCTIONS FOR-FAILURE TO
PAY FINE OR REQUEST HEARING AND
PROVIDING FOR EFFECTIVE DATE.
BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows:
SECTION 1: Any Zephyrhills code enforcement officer is authorized to issue a citation to
a person when, based upon personal investigation,the officer has reasonable cause to believe that the
person has committed a civil infraction in violation of the duly enacted code or ordinance of the City
of Zephyrhills. Prior to issuing the citation, a code enforcement officer shall provide notice to the
person that the person has committed a violation of a code or ordinance and shall establish a
reasonable time periodwithin which the person must correct the violation. Such tulle period shall
be no more than thirty(30) days. If, upon personal investigation, a code enforcement officer finds
that the person has not corrected the violation within the time period, a code enforcement officer may
issue a citation to the person who has committed the violation. A code enforcement officer does not
have to provide the person with a reasonable time period to correct the violation prior to issuing a
citation and may immediately issue a citation if a repeat violation is found or if the code enforcement

officer has reason to believe that the violation presents a serious threat to the public health, safety or
welfare or if the violation is irreparable or irreversible.
SECTION 2: The following are designated code enforcement officers for the enforcement
of the Municipal Code of the City of Zephyrhills:
a. Code Inspectors; b. Law Enforcement Officers _ -
c. Fire Safety Inspectors
SECTION 3: City Council shall adopt a uniform fine schedule, which shall be applicable to
all violations of the code unless specifically excluded. All such violations of the code included in the
uniform fine schedule shall constitute a civil infraction. The officer issuing the citation shall cause to
be displayed on the citation the amount of the fine to be assessed for the violation.
SECTION 4: The violator shall pay the fine displayed on the citation to the City of
Zephyrhills within ten(10)days of the issuance. If the violator desires a hearing, on the propriety of
the citation, then the violator must request same in person at the office of the Clerk of the Court,
Pasco County Courthouse, Dade City, Florida. Said request must be made within ten(10) days of
the issuance of the citation. A date for appearance at a hearing in the County Court will be forwarded

to the violator by the Clerk of Court. If after requesting a hearing the violator pleads guilty or is
found guilty of the violation(s) he may be fined up to Five Hundred Dollars ($500.00) for each
offense, together with court costs and imprisonment for a period not to exceed sixty(60) days.
SECTION 5: Failure to pay the fine assessed in the citation or request hearing sliall
constitute a separate violation of this Code punishable by fine up to Five Hundred Dollars ($500.90)
together with court costs and imprisonment for a period not to exceed sixty (60) days. A Warrlant
for arrest of the violators shall be issued. 1
SECTION 6: Should any Dart of trait.Ordinance be declared unconstitutional:nal:or void for any
reason, the declaring of said portion, either unconstitutional or void, shall in no way effect the
remaining portion thereof.
SECTION 7: The penalties created herein and the remedies available to the City shall be
deemed cumulative not exclusive. Nothing herein shall be construed as preventing a code
enforcement officer from pursuing any other remedy available to the City pursuant to the Code of the
City of Zephyrhills to abate a nuisance or to redress a violation, including but not limited to
imposition and foreclosure of assessments or liens.
SECTION 8: This Ordinance is created pursuant to Florida Statute 162.21.
SECTION 9: This Ordinance shall take effect immediately upon final passage and approval
by City Council. ' .,.: I
