AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ZEPHYRIULLS, FLORIDA,
ENACTING RESTRICTIONS AND.PROCEDURES

WHEREAS,the City Council of the City of Zephyrhills has determined that it is in the best
interest of the citizens of the City of Zephyrhills to establish restrictions and procedures to safeguard
and protectthem from unauthorized, illegal or hazardous burning; and
WHEREAS, certain dangerous conditions may arise from the clearing of land within the city
limits by burning trees and/or vegetation thereon.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills,
Florida, sitting in regular session, as follows:
SECTION:I "Definitions" Definitions are as follows:
FIRE NUISANCE is defined as any open burning activity which is determined by the
Zephyrhills Fire Department to be potentially harmful or injurious to human health or property.
LAND__N1)CLEARING OPERATIONS is the unroofing or clearing of vegetation in connection
with construction of buildings,right-of-way,residential or industrial development, mineral operations,
or the initial clearing of vegetation to enhance property value and does not include yard trash.
LAND CLEARING DEBRIS is the uprooted or cleared vegetation resulting from a land

clearing operation and does not include yard trash.
YARD TRASH is vegetative matter resulting from landscaping and yard maintenance
operations and includes materials such as tree and shrub trimmings, leaves, grass clippings, palm
fronds, trees and tree stumps.
AIR CURTAIN INCINERATOR is a portable combustion device that directs a plane of
high velocity forced draft air through a manifold head into a pit with vertical walls in such a-manner
as to maintain a curtain of air over the surface of the pit and a recirculating motion of air under the
curtain.
BONFIRE is a fire which when piled or stacked, shall not exceed384 cubic feet of space
(approximately 8 feet Wide x 8 feet in Length x 6 feet High) nor shall the height exceed 6 feet.

CAMP FIRE is afre which when piled or stacked, shall not exceed 27 cubic Feet
(approximately 3 feet Wide x 3 feet in Length x 3 feet High)nor shall the height exceed 3 feet
SECTION:II. "Prohibited Acts": It is unlawful for any person to willfully or carelessly burn or
cause to be burned, or to set fire to or cause fire to be set to, any combustible materials within the
city limits of the City of Zephyrhills without submitting to the Zephyrhills Fire Department a detailed
drawing or map showing the location of the burn site and securing an on-site inspection from the City
of Zephyrhills Fire OfiOals of the site and anprovol to burn. .
SECTION III: "Exceptions" The exceptions are as follows:
(A) All camp fires and bonfires will be allowed provided they are used solely for
recreational or ceremonial purposes and further provided that a permit be obtained from the
Zephyrhills Fire Department.
(B) Outdoor non-commercial food preparation or fires for warming of outdoor workers
on cold days, as long as visible emissions are not emitted.
(C) Open burning is allowed for the instruction and training of organized fire fighter's or
industrial employees under the supervision of the appropriate public fire control official provided that

(D) Burning of yard trash shall be permitted provided:
(1) The material to be burned must be generated on the premises where it is
burned and the premises can be occupied by no more than two (2) family units.
(2) The open burning is fifty feet(50')or more from any residents on the property,
where the burning is being conducted, three hundred feet (300') from any other
occupied building, one hundred feet(100') or more from any public road and twenty
five feet (25') or more from any woodlands, forest or brush.
(3) The fire must be attended and adequate fire equipment readily available at all
times.
(4) The fire must not cause smoke, soot, orders, visible emissions, heat, flame,
radiation or other conditions to the degree that they become a fire nuisance
(5) The fire must be started after 9:00 a.m. and be out by one hour before sunset.
(6) The burning must be enclosed in a noncombustible container or ground
excavation covered by a metal mesh or grill.

(7) The moisture content and composition of the material to be burned must be
favorable to good burning so that the air pollution is minimized. Green or wet material
may not be burned.
(E) The foregoing, notwithstanding the burning of tires, rubber materials, tar, railroad
cross ties, other creosoted lumber,plastics,waste pesticide containers, garbage (food materials) shall
be prohibited.
SECTION IV: "Burning of Land Clearing Debris": If the burning of land clearing debris
is to'take place inside the city limits, than the use of an Air Curtain Incinerator burning method shall
be used and the following provisions should apply:
(1) Prior approval to use an air curtain incinerator must be obtained from the Zephyrhills
Fire Department in conjunction with the permit and authorization procedures in effect through
the Division of Forestry.-

orestry:(2) The open burning shall be three hundred feet (300') or more away from any occupied
building.
(3)The open burning shall be set back one hundred feet(100') or more away from any public
highway or road and the.prevailing winds directthe smokeaway from the public highway or
road.
(4) The open burning is ignited after 9:00 a.m. and is extinguished one hour before sunset.
(5) The burning shall be attended at all times.
(6) The moisture content andcomposition of the material to be burned shall be favorable to
good burning which will minimize air pollution. Wet or green vegetative materials shall not
be burned.
(7) The starter fuel and materials to be ignited shall not emit excessive visible emissions when
burned.

the waste.within the pit will be maintained at an adequate temperature and sufficient air
recirculation to provide enough residence time and mixing for complete combustion and
control of emissions.Pit width shall not exceed twelve feet(12'), and vertical side walls shall
be maintained.
(9)No waste may be positioned to be burned above the level of the air curtain in the pit.

(10) Excessive visible emissions are not allowed except for a period of up to thirty (30)
minutes during startup, shutdowns and temporary malfunctions.
SECTION V: The Zephyrhills Fire Department or the Division of Forestry or any authorized
fire control agency may extinguish or cause to be extinguished, any fire that is unauthorized or does
not comply with this rule, or any burn which is deemed to cause a fire nuisance or human health
hazard or endanger any property. Any person responsible for the unlawful open burning may be
responsible for any aY , r. sis vo!ved Px±in »ishingtfire
The open burning authorized herein is not intended to relieve any person from complying with
any other applicable laws, rules or ordinances, including Florida Statutes, and rules of the State of
Florida, Department of Agriculture and Consumer Services, Division of Forestry and the
Environmental Protection Agency.
This Ordinance shall become effective upon third reading and signing by the Mayor.
