ORDINANCE NO. 549 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, A MUNICIPAL CORPORATION, AMENDING THE COMPREHENSIVE PLAN TO INCLUDE ADDITIONAL TERRITORY, AMEND MAPS THEREOF, PROVIDE INTERNAL CONSISTENCY AND ADDITIONAL POLICIES, GOALS AND OBJECTIVES AS REQUIRED BY FLORIDA STATUTE AND IN ACCORDANCE THEREOF. WHEREAS, the City of Zephyrhills, Florida, is amending the Comprehensive Plan of said City, to include tracts of land annexed into the corporate limits of the City of Zephyrhills upon the petition of its owners, with said parcels and owners itemized below: 1. George Neukom and Owen Gall, which tract contains approximately 110 acres and is located north of Pretty Pond Road and lies east and west of Green Slope Avenue ; 2. Charles Bass and Roger Whitworth, which tract- contains approximately 8 acres and is located south of C Avenue at the intersection of 16th Street; _ 3 ... . Th"oma$ F. Oakley (Conc-i re ;_. Tnc, ) ; which trar_-t ..r_,nnt..ains approximately 8 . 9 acres and is located west of Hwy. 301 and south of Pretty Pond Road.; and WHEREAS, the City also is amending all maps of said Comprehensive Plan to include, show, and depict said annexed properties; providing that all goals, objectives, policies, and other planning provisions applicable to properties in the Comprehensive Plan shall pertain and be applicable to the annexed properties; providing that invalidity of any portion shall not affect the remaining portions of this ordinance; and providing for an effective date ; and WHEREAS, by City of Zephyrhills Ordinances 528, 529 and 539, respectively, the above described real properties were annexed by the City and incorporated within the municipal boundaries of the City of Zephyrhills: real property described on Exhibit "A" attached hereto and by this reference incorporated herein and made a part thereof; and Record and Return to: City Clerk's Office0 R. 2061PHEUtIllto 5335 8th Street Zephyrhills, FL 33540 WHEREAS, the Zephyrhills City Council has requested the Zephyrhills Planning Commission, as the local planning agency of the City, to recommend inclusion of this property in the City's Comprehensive Plan; and WHEREAS, based upon the recommendations of the Planning Commission to the Zephyrhills City Council, said Council has prepared amendments to the City 's Comprehensive Plan and transmitted them to the Department of Community Affairs and such other agencies as required by Section 163. 3184, Florida Statutes, and the proposed amendments have been reviewed by the Department of Community Affairs; and WHEREAS, the Zephyrhills City Council desires to.. hereby formally adopt the amendments to the City ' s Comprehensive Plan. BE IT ORDAINED by the City Council of the - ;City of Zephyrhills, Florida, as follows: Section 1: The Comprehensive Plan of the City of Zephyrhills, is hereby amended in the following respects : (a) All maps depicting- land use, traffic__ circulation, public facilities, recreational sites, and housing have been amended to include , show, and depict the annexed properties described above. Copies of the maps as are hereby amended are attached as Exhibit "B" to this Ordinance and are herein incorporated by reference. (b) All necessary data and analyses with references to the annexed properties are included with Exhibit "A" . Section 2: All goals, objectives, policies and other planning provisions applicable to properties within the City of Zephyrhills as shown and set forth in the Comprehensive Plan of the City of Zephyrhills are hereby expressly made applicable and pertinent to the property described on Exhibit "A" . Section 3: The provisions of this Ordinance are severable, and if any section, sentence, clause, or phrase is for any reason held to be unconstitutional, invalid, or ineffective, this holding shall not affect the validity of the remaining portions O.R. 2061 PAGE O317 of the Ordinance, it being expressly declared to be the City Council ' s intent that it would have passed the valid portions of this Ordinance without the inclusion of any invalid portion or portions. J HNSON Ma or ' ` O.R. 2O61PQGEO3iS EXHIBIT "A" - to CITY OF ZEPHYRHILLS, ORDINANCE NO. • The following data and analysis was -presented and approved by motion by the City Council of the City of Zephyrhills, Florida at public hearings held on Oeo4c' /4 and , 1991, and serve as Exhibit "A" of Ordinance No. 5' providing for an amendment to the Comprehensive Plan of the City of Zephyrhills. 1. Availability- of services, traffic : Neukom/Gall annexation - 110 acres: Located north of Pretty Pond Road and:: ',east . and west _of __ Green:: Slope. Avenue,-of which both roadways are 2-lane.. Pretty Pond intersections with a 4-lane portion of Highway 301, which operates at a LOS C. East of Highway . 301, Pretty Pond Road was paved in - the fall .of. ._1990, by the City and intersects with Wire Road, a newly resur_fac=e -lane road that connects at the south with County Road ,54. Duringthe winter of. 1991, Pasco, County completed intersection enhancement with turn lanes 'for improved traffic flow. 2. Bass/Whitworth annexation" - 8 acres: Located south of C Avenue. at the,. intersection of 16th Street. C Avenue is currently a dirt road, which extends east and west, andT" intersects with Highway 301, while 16th Street is a paved, 2-lane city street. 16th Street runs north and south and running --northerly, intersects with South Avenue. The City is in the process of surveying C Avenue for paving from 7th Street to 20th Street. Developer participation into the improvements of this intersection will be subject to City Site Plan Review. 3. Oakley annexation- - 8. 9 acres: This site is located immediately south of Pretty Pond Road, west of Highway--01.. It abuts..25__-acr_e.s___annexad. _pr-e-viously_ (_and____part-_of., heL-.G t 199-0 amendment to the Comprehensive Plan) . This .poperty will, be combined with the 25 acre tract when developed:-,and will abut a 4-lane portion -of ' Highway 301 which operates ,at a LOS r. Site development plans will require the developer to make improvements to Pretty Pond Road. , J _ All three annexations adhere to goals, policies, and objectives set forth. in the Comprehensive Plan with regaid ,, to t.xaffic circulation and include, Policies 1-3-2 and 1-3-3,_' 'Gb al - TRA-2, Objection TRA-2-1 and TRA-2-4, and. policies TRA-2-1-3, TRA-2-1-4, TRA-2-1-5 and TRA-2-3-2 . These goals, policies and objectives deal with non-.motorized access and circulation, prevention of air pollution, achievement and maintenance of LOS standards, coordination of development impacts with Pasco. County_ ,and FDOT, reservation of right-of-way, provisions of adequate s-i'gnalization paid for by the new development, and establishment of standards of traffic flow standards. (both. on and off site):' Traffic analyses,:Of all three. -sites will be required- prior to development as outlined. in the Land Development Code which - will provide information on actual impacts. Impact fees will -be collected and may be used to offset traffic- impacts and- are used solely to provide for road improvements. Availability of services, future land uses: 1. Neukom/Gall - This property is hilly and located on a crest which slopes to the south. It abuts a mobile home park on the east, commercial property to the south and various residential uses north and west. The site is largely vacant, there are three residential units on the property. There are no wetlands or other significant characteristics. 2. Whitworth/Bass - This site is a flat, vacant parcel with no O.R. 2 0 61 PAGE 0 319 wetlands and no significant characteristics. All land uses in the vicinity of this parcel are residential, however, there are mixed residential uses, including single family homes, duplexes, mobile homes, etc. There are no wetlands or other significant characteristics. 3 . Oakley - This property is at higher elevations and slopes to the west. It is vacant and will be added to the adjacent, 25 acre site. It abuts a mobile home park to the south, residential to the north, residential and agricultural on the west and commercial on the east. The site is vacant and there are no wetlands or other significant characteristics. These three properties adhere to policies and objectives set out in the Comprehensive Plan of the City of Zephyrhills, specifically, Policy LU-1-1-3, Objective LU-1-2, Policy LU-1-2-8, Objective LU-1-3, Policies LU-1-2-1, LU-1-3-2, LU-1-3-3, LU-1-3-4 and LU-1-3-6 . All the policies and objectives referenced above deal with buffers, connection to services, availability of services, providing services at adopted levels of service and providing for development in areas where services are in place. All three sites also will be subject to all conditions of development as set forth in the City ' s Land Development Code. Availability of public facilities, water and sewer: 1. Neukom/Gall - Water service for this site will be extended from lines constructed for service to the 25 acre Oakley site (approved in previous amendment) . Those lines, measuring 8 inches, have been extended to the Oakley site and as-built plans have been submitted and approved by the City. A second line, measuring 12 inches, has been required for the development of Qakley_ .ccmrerc.i_a1 site_..and_to provide. _adeq.uate_ _ water.___serv_ice_ to. thisresidential site. Sewer service will be provided from two locations. The first wi.l.l be extended from the Oakley site. In the future, as this site is prepared for development, a second line will be extended from the westward from its current location at the southeast corner of Pretty Pond Road and Highway 301. At its highest residential use, this site can be expected to require use of 72, 500 gallons of water per day. In 1990, the City completed expansion of its waste water treatment plant and improvements to its water system. Water capacity may reach as much as 5 . 485 MGD, yet average withdrawal is only 1 .855 MGD. In addition, the majority of the improvements to the water system dealt with providing services to this vicinity of Zephyrhills, including construction of an above ground water tank to improve distribution services and water . pressure. This improvement was constructed to serve both existing and new customers. Treatment plant design capability is for 2 .25 MGD, nearly . 80 MGD greater than current peak flows . Effluent is released to rapid infiltration precolation ponds. Current City policy requires developer-s of sites not served by wastewater collection system to pay - 100 percent of -the costs to extend and connect to the City system. This site, at its highest possible use, will add 72, 500 GPD of wastewater capacity. The City requires those seeking water and sewer service to pay all costs to extend and connect to the City system. This parcel, prior to its annexation, was located within the boundaries of the City ' s fire tax district and interlocal agreement with Pasco County for water and sewer service and was considered in future land use projections and for availability of service. In fact, areas outside the City were considered when the City expanded and improved its utility system. This amendment adheres to policies WAT-1-2-1, WAT-1-2-2, WAT-1-2-3, • O.R. 2 0 61 PM30 6-)E WAT-2-2-2, and WAT-2-2-3, all of which deal with requirements to service all units with public water and sewer, require property owners to connect to public systems within 200 feet of their property, deny annexation if unable to serve with public utilities and deny issuance of a building permit if the development is not served by public utilities. 2 . Bass/Whitworth - Water and sewer lines are located at the entrance to this property. The developer will be required to pay all costs of extending utility service to the site and throughout the development. Using the same rates as in the previous annexation, water usage can be expected to add usage of 3, 960 GPD, with wastewater treatment flows of 3,960 GPD. All sites will be required to handle all stormwater drainage equal to or less than the rate of discharge that existed previously. On-site facilities will accommodate runoff from a storm of 25 year frequency, as required by the City ' s Land Development Code . Solid waste disposal will be collected by the City sanitation department with disposal in the Pasco County incinerator. A transfer station is located within 10 miles of Zephyrhills for solid waste disposal and transfer to the incinerator. 3 . Oakley - Utilities to serve this site are located within several feet of the property and will serve the original 25 acres as well as this property. Using estimates for the 25 acre site, it is assumed that this property can be expected, at its highest commercial use, to use 2, 500 GPD of water. Similarly, at its highest use, this site will add 2 ,000 GPD of wastewater to capacity. Availability of service, housing: In its original submission of the Comprehensive Plan, the City determined_ a need for 480 low income and elderly _housing units by the year 2010 . The Neukom/Gall site, consisting of 110 acres, and the Whitworth/Bass site, consisting of 8 acres, both will significantly assist in reaching these goals. (As a commercial site, the Oakley annexation does not meet any housing needs. ) These annexations will assist the City in attaining its housing goals and objectives by conforming to the following goals, policies and objectives in the current plan, including Goal HOU-1 and HOU-2, policy HOU-1-1, policies HOU-1-1-1, 1-1-2, HOU-2-1-1, 2-1-3, 2-1-4, 2-1-5 and HOU-3-2-2, and objective HOU-2-1. All referenced goals, policies and objectives deal with providing an adequate supply of housing, providing zoning incentives to provide affordable land for housing, providing additional residentially designated property, assure availability of affordable housing, continue pursuit of state and federal funding for housing programs, encourage multi-family and Planned Unit Developments, ensure that public facilities and services are available and facilitate development of at least 35 dwelling units. Availability of service, recreation and conservation: Recreation will not be adversely affected by these three annexations. The City of Zephyrhills currently exceeds level of service standards for recreation based on a population/land area and facilities ratio for both resource based and activity based recreation. Pasco County is currently building two parks in the Zephyrhills area, one within the city limits and one contiguous. Together, both parks comprise more than 95 acres and will provide additional amenities including ballfields, swimming pool, basketball and tennis courts, and other support buildings and equipment. There are no known endangered species located on any of these three sites.
