HomeMy WebLinkAbout558 Proposing Amendments to Comprehensive Plan - ORDINANCE NO. 558 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, A MUNICIPAL CORPORATION, PROPOSING AMENDMENTS TO THE COMPREHENSIVE PLAN TO INCLUDE ADDITIONAL TERRITORY, AMEND MAPS THEREOF, PROVIDE INTERNAL CONSISTENCY AND ADDITIONAL POLICIES, GOALS AND OBJECTIVES AS REQUIRED BY FLORIDA STATUTE AND IN ACCORDANCE THEREOF. WHEREAS,^ -the City of Zephyrhills, Florida, is proposing to amend the Comprehensive Plan of said City, to include tracts of land annexed into the corporate limits of the City of Zephyrhills upon the petition of its owners, with said parcels and owners itemized below: 1. George . Neukom and Owen Gall, which tract contains approximately 110 acres and is located north of Pretty Pond Road and lies east and west of Green Slope Avenue ; 2 . Charles Bass and Roger Whitworth, which tract contains approximately 8 acres and is located south of C Avenue at the intersection of 16th Street; 3 . Thomas E. Oakley (Concire, Inc . ) , which tract contains approximately 8 . 9 acres and is located west of Hwy. 301 and south of Pretty Pond Road; and WHEREAS, the City also is proposing to amend all maps of said Comprehensive Plan to include, show, and depict said annexed properties; providing that all goals, objectives, policies, and other planning provisions applicable to properties in the Comprehensive Plan shall pertain and be applicable to the annexed properties; providing that invalidity of any portion shall not affect the remaining portions of this ordinance; and providing for an_ effective date; and _ WHEREAS, by City of Zephyrhills Ordinances 528, 529 and 539, respectively, the above described real properties were annexed by the City and incorporated within the municipal boundaries of the City of Zephyrhills: real property described in Ordinance 533 and by this reference incorporated herein and made a part thereof; and 41. act O.R. 3O31PAGE 11U Record and Return to: City Clerk's Office 6F 5335 8th Street A Zephyrhills, FL 33540 • WHEREAS, the Zephyrhills City Council has requested the Zephyrhills Planning Commission, as the local planning agency of the City, to recommend inclusion of this property in the City' s Comprehensive Plan; and WHEREAS, based upon the recommendations of the Planning Commission to the Zephyrhills City Council, said Council has prepared the proposed .amendments„ ,to..the Cit.Vs—CompreherxsiVe_P1_a.n and transmitted them to the Department of Community Affairs and such other agencies as required by Section 163. 3184, Florida Statutes and the proposed amendments have been reviewed by the Department of Community Affairs; and WHEREAS, the Department of . Community Affairs had desired additional information' concerning these annexations to insure the City ' s ability to provide services as indicated in the proposed amendements; and WHEREAS, in response to objections, recommendations and comments made by the DCA, further information, data and analysis has been provided to conform to the Growth Management Act and Laws of Florida, specifically, Chapter 163 and Rules 9J-5 and 9J-11, FAC, and WHEREAS, it is the desire of the Zephyrhills City Council to hereby formally adopt the amendments to the City 's Comprehensive Plan. BE IT ORDAINED by the City Council of the - City of Zephyrhills, Florida, as follows : Section 1: The following amendments to the . .Comprehensive Plan of the City of Zephyrhills, are hereby proposed: (a) All maps depicting land use, traffic circulation, public facilities, rec:reat-i6nE1 =sites, and "housing have been • amended to include, show, and depict the annexed properties described above. Copies of the maps were amended and are attached as Exhibit "B" to Ordinance 553, and are hereby incorporated by reference. (b) Additional and necessary data and analyses with O.R. 3031 PAGE 11 I 0 references to the annexed properties are included with this Ordinance and are referenced as Exhibit "A - 558" . Section 2: All goals, objectives, policies and other planning provisions applicable to properties within the City of . Il Zephyrhills as shown and set forth in the Comprehensive Plan of the City of Zephyrhills are hereby expressly made applicable and ..partinenL -to- Lt_he--prope_rty :described:nn Exhibit !IA" . Section 3: The provisions of this Ordinance are severable, and if any section, sentence, clause, or phrase is for any reason held to be unconstitutional, invalid, or ineffective, this holding shall not affect the validity of the remaining portions of the Ordinance, it being expressly declared to be the City Council ' s intent that it would have passed the valid portions of this Ordinance without the inclusion of any invalid portion or portions . Section 4: This Ordinance shall become effective immediately upon its passage. EXHIBIT "A" - to. CITY OF ZEPHYRHILLS, ORDINANCE NO. 558 The following data and analysis was presented and approved by motion by the City Council of the City of Zephyrhills, Florida at public hearings held on May 11, 1992, and May 26, 1992, and serve as Exhibit "A" of Ordinance No. 558, providing for a proposed amendment to the Comprehensive Plan of the City of Zephyrhills. This exhibit specifically responds to the ORC report from the Florida Department of Community Affairs with reference to the proposed Comprehens-ive -P-La.n-- amendm.e.n_t- 92-1, City. of Zephyrhills, Florida. The amendment is therefore revised, as requested, to provide additional information with regard to the three annexed sites . 1. Availability of and demand upon services: A. Potable Water and Sanitary Sewer: Neukom/Gall - As noted in the proposed amendment, water and sewer services will be provided to this parcel from the 25 acre Oakley site. At its highest residential use, this. site can be expected to require use of 54, 450 gallons of water per day. This figure is based on the assumption that 363 dwelling units may be developed on the site (110 acres with density 3 . 3 units per acre) and the average household using 150 gallons per day. (Source: City of Zephyrhills Utilities Department. ) This site can be expected to add 40, 838 GPD of wastewater capacity. This figure is based on the assumption that 75 percent of water usage is returned to the wastewater system. Bass/Whitworth . - Water and sewer lines are located at the entrance to this property. The site is comprised of eight acres with maximum density of nine units per acre, for a total of 72 units. Using the 150 gallon average per household, it is estimated that the site, if developed to its maximum potential, would generate usage of 10, 800 gallons per day. This site can be expected to add 8, 100 GPD to the wastewater facility. Oakley ( 8. 9 acres) - This parcel will be added to the 25 acre Oakley site, which was annexed and approved previously. Basing water and sewer consumption on commercial usage, this site can be expected to use 2, 500 GPD of water at its highest use and 1, 875 GPD of wastewater consumption. B. Solid Waste: Neukom/Gall - The leval of service standards for residential units within the City of Zephyrhills are set at 1. 5 tons per year per unit. Using the figure of 363 dwelling units at this site, it is estimated that this parcel may generate 544. 50 tons of garbage per year. Bass/Whitworth - Using the same LOS standards for this site, it is estimated that 72 units using 1. 5 tons per year will generate 108 tons of solid waste per year. Oakley (8. 9 acres) - This is a commercial site. Using actual figures for like 'development within the City of Zephyrhills, it is estimated that this site will generate 109 tons of solid waste per year. (This is figured by converting actual yardage of 142 yards per week for the full 35 acre site and dividngti•:.that by 8. 9 " acres to produce 33 .41 yards per week for this pale 1, thy' multiplying that figure by 52 weeks to arrive at 1, 7 ':; lis per, year. F • • N) O.R. 3 0 3 1 PAGE 111r .,. 2 All solid waste collected within the City of Zephyrhills is delivered to the Pasco County transfer station which is then in turn delivered to the Pasco County Resource Recovery plant. ' The . resourse recovery plant has capacity to handle 1, 050 tons per day. Current capacity averages 940 tons per day. Pasco County estimates it will be at least 10 years before plan expansion is necessary. C . Drainage: Neukom/Gall - Bass/Whitworth - Oakley (8.9 acres) • All site under development within ::t .e City -n-f --Zephyrhills, handle their drainage (run-off) on-site. Each is treated as -a new facility. All development - or redevelopment - is required to provide on-site retention of stormwater of sufficient capacity to assure that post development run-off is no greater than pre-development conditions. The adopted level of service standard is a 25 year storm of 3 . 6 inches of rainfall in one hour. D. Traffic Circulation: Neukom/Gall - This parcel, with a potential buildout of 363 single family dwelling units, and an average of 9 . 25 trips per unit per day, can expect to generate 3, 357 . 75 trips daily. Bass/Whitworth - This site, with buildout of 72 multi-family units, and an average of 7 . 52 trips per day, can expect to generate 541 trips dailey. Oakley ( 8.9 acres) - The entire site under development is 35 acres. Actual traffic counts for the entire development is estimated at 5, 089 trips. This site is comprised of one third of the total development and therefore, trips generated by this parcel can be expected to be 1, 696 trips daily. E. Recreation: Neukom/Gall - Bass/Whitworth - Oakley (8.9 acres) Together at their highest residential capacity, both the Neukom/Gall and Bass/Whitworth annexations will add fewer than 1, 000 new residents to Zephyrhills. Level of ,service standards for Zephyrhills are indicated on REC Table 4 and REC Table 5, City of Zephyrhills Comprehensive Plan, which are attached, and indicate that more than sufficient recreational facilities are in place to handle populations of more than 20, 000, and to serve the City and its residents through the horizon year of 2010. 2 . Analysis of the Character and Magnitude of Existing Land: Neukom/Gall - This site is comprised primarily of _replanted citrus groves . There are three residential units on site. Oakley ( 8.9 acres.) --- This site is cleared and vacant property. Prior to several severe freezes, it was a grove. 3 .
