ORDINANCE NO. 5.7 4
AN ORDINANCE OF THE CITY OF ZEPHYRHILLS,
FLORIDA, PROVIDING FOR FINANCING OF
IMPROVEMENTS TO ARTERIAL AND COLLECTOR
ROADWAYS; MANDATING THAT LOCAL STREET
IMPROVEMENTS AND NEW DEVELOPMENT BE FUNDED BY
THE DEVELOPER; PROVIDING FOR IMPROVEMENT TO
EXISTING LOCAL STREETS; PROVIDING FOR
ASSESSMENT TO ABUTTING PROPERTY OWNERS TO BE
ASSESSED FOR SUCH IMPROVEMENT; PROVIDING FOR
NOTICE THEREOF; PROVIDING FOR INSTALLMENT
PAYMENTS FOR ASSESSMENTS IN EXCESS OF
$1,000.00; AND PROVIDING THAT SAID ASSESSMENTS
SHALL CONSTITUTE A LIEN UPON THE PROPERTY SO
ASSESSED.
WHEREAS, the City of Zephyrhills, Florida, does from time to
time determine that the public interest is best served by the
construction of new roadways or the reconstruction or paving of
existing roadways within or in proximity to the City of
Zephyrhills, Florida, and
WHEREAS, roadways are classified as either arterial,
collectors or local streets in the City of Zephyrhills
Comprehensive Plan, and
WHEREAS, it is appropriate to define the sources and procedure
for funding roadway improvements.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City
of Zephyrhills that:
1 . ARTERIAL AND COLLECTOR ROADWAY IMPROVEMENTS: Arterial and
collector roadway improvements determined to contribute to
maintenance or achievement of a Level of Service C (as defined by
the Florida Department of Transportation) within the City of
Zephyrhills may be funded from gas tax revenues, transportation
impact fees, joint participation agreements with other governmental
entities, and/or developer contributions.
2 . LOCAL STREET IMPROVEMENTS TO SERVE NEW DEVELOPMENT: Local
street improvements to serve new development will be funded
entirely by the developer, whether or not the street (s) remains in

3 . EXISTING LOCAL STREETS: Improvements to existing platted
local streets may be funded from gas tax revenues, joint
participation agreements with other governmental entities or
assessment of abutting property owners .
4 . ASSESSMENT OF ABUTTING OWNERS FOR IMPROVEMENT TO LOCAL
STREETS: If property owners are to be assessed for improvement to
local streets, the City of Zephyrhills will pay one-third of costs
and the remaining two-thirds will be pro-rated among owners of
abutting land in proportion to the linear frontage on the street to
be improved.
5. NOTICE: After determination of probable costs and before
awarding a contract, all affected property owners will be advised
by registered letter of their estimated share of costs and the
date, time and place of a public hearing by City Council . At the
conclusion of the public hearing, Council will determine by vote,
whether to proceed with the subject roadway improvement. After
roadway improvements are completed and all costs are known, each
affected property owner will be sent a ' registered"letter"=advising
them of the amount due to the City, the date due, and the
alternative for installment payments if the assessment exceeds
$1, 000 . 00 .
6. ASSESSMENTS IN EXCESS OF $1,000.00: Assessments exceeding
$1, 000 . 00 may be paid in up to 12 quarterly installments with a
minimum quarterly payment of $100. 00 and interest at the rate of
yield from a three year U.S . Government Treasury Bill on the date
of requesting installment payments of the assessment.
7 . RESURFACING: Resurfacing of existing pavement is
determined to be a maintenance function and may be funded from any
available source. There will be no mandatory assessment of
property owners . Voluntary contributions may be accepted.
8 . ASSESSMENTS TO CONSTITUTE A LIEN: Any roadway improvement
which results in an assessment of property owners, shall be ordered
by Resolution passed by City Council. Said Resolution shall
include the legal description of properties which shall be assessed RECORD J k„Ju PAGE 44
for said improvement. All assessments for roadway improvement made
pursuant to this Ordinance, shall constitute a lien upon the real
property assessed from the date of the adoption of the Resolution
ordering the improvement.
The foregoing Ordinance No. 5,74 was read and passed on its
first reading by the City Council ,of the City of Zephyrhills,
