TITLE II, CHAPTER 1, SECTIONS 21.06, COMMITTEES, AND 21.12, FILLING OF OFFICES; AMENDING TITLE III, CHAPTER 5, TO INCLUDE NEW HEADING, POLICE DEPARTMENT; AND- ENACTING NEW SECTION 35.001, , POLICE DEPARTMENT; BY. ENACTING A NEW TITLE III, CHAPTER 6, ENTITLED 'TIRE DEPARTMENT',, INCLUDING SECTIONS 36.01, FIRE DEPARTMENT AND.36.02; DUTIES AND POWERS OF.FIRE CHIEF; BY DELiETING TITLE IV, JUDICIARY DEPARTMENT, CHAPTER 1, MUNICIPAL COURT, SECTIONS 41.01, MAYOR'S COURT ABOLISHED, AND 41.02, MAYOR'S DUTY, ETC. UNIMPAIRED; AND BY ENACTING A NEW TITLE VIII, MISCELLANEOUS PROVISIONS, CHAPTER 1, APPOINTMENT MEMBERS OF BOARDS, SECTION 81.1, AUTHORITIES, COMMISSIONS AND BOARDS: APPOINTMENT LIMITATION; AND PROVIDING THAT SAME SHALL BECOME EFFECTIVE UPON AFFIRMATIVE VOTE OF THE MAJORITY OF THE ELECTORATES VOTING IN A REFERENDUM UPON THE .AMENDMENTS AND FILING WITH THE DEPARTMENT OF STATE. WHEREAS, the City Council appointed a Charter Revision Committee to review the City's existing Charter and recommend to the City Council any changes that the Charter Revision Committee felt appropriate, and WHEREAS, the City Council has received the report of the Charter Revision Committee, recommending certain amendments to the Charter which are set forth below, and WHEREAS, Chapter 166 of the Florida Statutes mandates that in order to amend the • City's Charter, an ordinance 'must be adopted by the City Council, incorporating the proposed amendments to the City Charter, and WHEREAS, pursuant to Chapter 166 of the Florida Statutes, all such amendments are RECORD VERI ED JED PITTMAN • Clerk Circuit • o asco ounty Record and Return to': trie City Clerk's Office • '3268' 1627 5335 8th Street Zephyrhills, FL 33540 • subject to referendum by'the City electors, and WHEREAS, regular City elections are set for April 12, 1994. BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, that the following amendments and deletions to the City Charter are proposed to the electorates of the City for referendum at the elections herein to be held on April 12, 1994. All references to title and chapter, unless otherwise stated, refer to the Charter of the City of Zephyrhills. TITLE L INTRODUCTION Chapter 1: Creation of Municipality Section 11.02, shall be amended to read as,follows: Section 11.02: Boundary Description: ` ` • The corporate limits of the City of Zephyrhills shall be those presently existing or as the same may be established hereafter. TITLE II. LEGISLATIVE DEPARTMENT Chapter 1: City Council The following sections shall be deleted in their entirety: -` - Section 21.06. Committees. Section 21.12. Filling of offices. TITLE III. EXECUTIVE AND ADMINISTRATIVE DEPARTMENT Chapter 5: Shall be reheaded and henceforth shall be titled"Police Department" A new Section 35.001 shall be enacted and shall henceforth read: Section 35.001. Police Department. The City shall establish and maintain a Police Department consisting of a Chief of Police and such other officers, and personnel of said department, as may be provided for by the City Council. Personnel shall be appointed in the manner provided by law, rule or regulation. A newly enacted Chapter shall read as follows: TITLE HI. EXECUTIVE AND ADMINISTRATIVE DEPARTMENT Chapter 6. Fire Department Section 36.01. The Fire Department. The City shall establish and maintain a Fire Department consisting of a Fire Chief and such other officers and other personnel of said Fire Department as may be • • provided for by the City Council. Personnel shall.•be:appointed in the manner : provided by law, rule, or regulation. Section 36.02. Duties and Powers of the lire Chief. The Fire Chief, shall be the City's Fire Marshall, and shall have exclusive control of the operation of the Fire Department, including the Departments apparatus, • equipment, personnel', both paid and voluntary, daily operations, emergency operations and all other functions which are necessary inpursuit of the objective- of the prevention and extinguishment of fire and protection of-life and property within the corporate ,city limits and those unincorporated areas protected by contractual agreement. TITLE 1V. JUDICIARY DEPARTMENT ... • Chapter 1. Municipal Court The following sections shall be deleted in their entirety: _ Section 41.01. Mayor's court abolished. Section 41.02. Mayor's duties, etc., unimpaired. The newly enacted-Section shall read as follows: <- - - , _ TITLE VIII. MISCELLANEOUS PROVISIONS Chapter 1. Appointment Members of Boards Section 81.01. Authorities, Committees and Boards limitation of Appointment The City Council shallIappoint members of each authority, committee or board of the City of Zephyrhills.in accordance with the provisions of general law. ;No person shall serve on more than one authority,-board or committeeatthesame time.. This provision shall not effect any person who is presently serving on an authority, board,or committee,.until that person's appointed term has expired. TheP rovisions of this,Ordinance are severable, and if any section, sentence, clause, or phrase is for any reason held to be unconstitutional, invalid, or ineffective, this holding shall not affect the validity of the remaining portions of the Ordinance, it being expressly declared to be the City Council's intent that it would have passed the valid portions of this Ordinance without the inclusion of any invalid portion or portions.
