ORDINANCE NO. 489
1 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS ,
FLORIDA, REZONING LANDS WITHIN. SAID CITY,
PURSUANT TO THE REQUEST OF THE OWNER OF SUCH
LANDS AND IN ACCORDANCE WITH FLORIDA STATUTE
166 .041 (13) (c) 1 .
WHEREAS , EMANUEL BACK and LULU BACK are the owners of the
lands hereinafter described in Section 1 , and
WHEREAS , said property was annexed into the City,
pursuant to Ordinance No . 473 and pursuant to Florida
Statute, continues to maintain its previous zoning
designation under the Pasco County Zoning Ordinance of County
R-4, and
WHEREAS , the Zephyrhills Planning Commission has decreed
that in keeping with the surrounding properties and the
City' s Comprehensive Plan that the appropriate zoning for
said property should be Residential 2 , and
WHEREAS -the property to be rezoned does involve less than
five percent (570 of the total land area of the City of
Zephyrhills and the City is thereby empowered to rezone same
in accordance with Florida Statute 166 .041 (3)' (c) 1 .
NOW, THEREFORE, BE IT ENACTED AND ORDAINED by the City
Council of the City of Zephyrhills , Florida, as follows :
SECTION 1 . That the following described lands , lying and
being situate in !Pasco County, Florida, to-wit : ,

That portion of Lots 117 and 118 , COLONY
HEIGHTS Subdivision (unrecorded) , in Section
12 , Township 26 South, Range 21 East , Pasco

accordance with the Zoning Regulations of the City of
Zephyrhills , dated July 28 , 1986 and incorporated by
reference into Zephyrhills City Ordinance No. 397 , known as
the "City of Zephyrhills Zoning Ordinance" .
SECTION 2. This Ordinance shall become law upon being
passed by the City Council of the City of Zephyrhills after
three (3) readings and execution by the presiding officer and
the clerk of that body" a Accordance with Florida Statute
166 .041 , Laws of Florida.

Council of the City of Zephyrhills , Florida on the 24th day
of October , A.D. , 1988 .
