PROHIBITED SIGNS; PROVIDING FOR CHANGEABLE COPY SIGNS; PROVIDING FOR NONCONFORMING SIGNS; PROVIDING FOR SIGNS ON WINDOWS, DOORS AND FIRE ESCAPES; PROVIDING FOR COMPUTERIZED SIGNS ; PROVIDING FOR OFF-SITE SIGNS ; PROVIDING FOR POLITICAL SIGNS ; PROVIDING FOR TEMPORARY SIGNS; PROVIDING FOR REAL ESTATE SIGNS; PROVIDING FOR TRADEMARK SIGNS; PROVIDING FOR VEHICLE SIGNS; PROVIDING FOR PUBLIC UTILITY VEHICLE SIGNS; PROVIDING FOR PERMITS ; PROVIDING FOR FEES ; PROVIDING FOR PENALTIES FOR VIOLATION; PROVIDING FOR SEVERABILITY CLAUSE; PROVIDING FOR . SIGN SETBACK REQUIREMENTS; OBSTRUCTION TO VISION; PROVIDING FOR HOW TO DETERMINE SIGN DIMENSIONS; PROVIDING FOR HOW TO DETERMINE NUMBER OF SIGNS; PROVIDING FOR HOW TO DETERMINE ALLOWABLE SIGN LOCATIONS; PROVIDING FOR OTHER GENERAL STANDARDS; PROVIDING FOR STANDARDS FOR ERECTION AND MAINTENANCE OF SIGNS; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR LEGAL NOTICE; AND PROVIDING FOR PROOF OF PUBLICATION & ADOPTION. BE IT ORDAINED, by the City Council of the City of Zephyrhills , sitting in regular session, as follows : 1. PURPOSE AND INTENT. Whereas, increased numbers and size of signs as well , as certain types of signs and lighting can distract the attention of motorists and pedestrians and constitute hazards to trafficsafety, interfere with emergency access for firefighting and other purposes , interfere with pedestrian and vehicular circulation, create hazards of electrical shock and injury or damage from windblown structures , impair ' visual orientation to the environment and the effectiveness of public 'safety and other necessary signs ; and Whereas , effectively designed and located signs can enhance visual orientation and safe traffic movement and Record and Return to. i City O "Clerk's, ffice 1 AA I 5335 `8th S ;, J' ; :, O. Pu 0708 Zephyrhills FAL-: - -&335Vo can contribute significantly to the appearance and attrac- tiveness of commercial , industrial and other activities and the vitality of the local economy; it is therefore, the purpose of this chapter to regulate the use of signs within the City in order to protect and promote the public health, safety and general welfare and to facilitate easy and pleasant communication between people and their environ- ment. It is also the intent of this chapter to supplement and act in conjunction with the City zoning, local comprehen- sive plans and any other local , state and federal regulations to carry out these purposes . 2. ADOPTION OF REGULATIONS INCORPORATED BY REFERENCE. A document entitled "Sign Regulations of the City of Zephyrhills , originally adopted - , _ is hereby adopted by reference. Each page of the referenced regulations shall be sequentially numbered and bear the - s-urname of the City Clerk and President of the City Council and date of adoption by this Ordinance or subsequent amendment. 3. REPEAL OF CONFLICTING ORDINANCES AND/OR REGULATIONS OF THE CITY OF ZEPHYRHILLS. All previously adopted Ordinances or Regulations of the City of Zephyrhills conflicting with this Ordinance or referenced regulations are hereby repealed. 4. VALIDITY. If any Section, part of a Section, paragraph, sentence, clause, phrase or word of this Ordinance is , for any reason, held or declared to be unconstitutional , inoperative, or void, such holding of invalidity shall not affect the remaining portions of this Ordinance and it shall be construed to have been the intent to pass this Ordinance without such constitutional , invalid, or inoperative part therein. 5. ENFORCEMENT. A. The Zephyrhills Building Official , shall be in charge of sign administration and enforcement of the O. R. 1827 PG 0709 regulations incorporated herein and shall issue or cause to be issued, notices of correction or citations , to any person in violation of this Ordinance. B. Any person who violates the provisions of this Ordinance upon a finding of guilt by a court of- competent jurisdiction, shall be subject to a fine ,of not more ,than $500 .00 or by imprisonment for a term of" not exceeding sixty (60) days or by both such fine and imprisonment. 6. LEGAL NOTICE. That this Ordinance shall be published . -in --the; local newspaper for four (4) consecutive weeks- and that proof of publication of this Ordinance shall be filed herein. 7. PROOF OF PUBLICATION & ADOPTION. That upon the filing of the Proof of -Publication and final adoption of this Ordinance, a copy of same shall be filed with the Clerk of the Circuit Court of Pasco County, Florida and a copy will be forwarded to the Department of State, Tallahassee, Florida. 8. This Ordinance shall beeffective after its third reading and upon signing by the Mayor.
