ORDINANCE NO. 524 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, ANNEXING ADDITIONAL TERRITORY TO BE INCLUDED WITHIN THE BOUNDARIES OF SAID CITY PURSUANT TO THE CONSENT OF THE OWNERS OF SUCH LAND AND IN ACCORDANCE WITH FLORIDA STATUTE 171. 044, LAWS OF FLORIDA. WHEREAS, Pasco County, Florida, is the present owner of the lands hereinafter described in Section 1 A, B, and D, and WHEREAS, the City of Zephyrhills, is the present owner of the lands hereinafter.,--described '-in Section-1 e,-and-- WHEREAS, said the above-mentioned owners have consented to the annexation by the City of Zephyrhills of the lands herein described in Section 1, and WHEREAS, such annexations are authorized by Florida Statute 171.044, of the laws of Florida and the municipal charter, and WHEREAS, the City Council-_ approves the annexation of said elands and the inclusion of said lands within the corporate limits of said City, NOW, THEREFORE, BE IT ENACTED AND ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows : SECTION 1. That the following described lands, lying and being situate in Pasco County, Florida, to-wit: A. Wire •Road- : The existing right-of-way located northerly from the north right-of-way of County Road 54 East, for a distance of 5300 feet, up to and including the intersection of Pretty Pond Road and Wire Road; and B. Dairy Road: The existing right-of-way located northerly from the north right-of-way of County Road 54 East, for a distance of 2600 feet, up to and including the intersection of Dairy Road and Daughtery Road. C. Pretty Pond Road: -- PARCEL A-:_ The -northerly 5 feet of land-that - a—is within -3-5- - feet of the east-west mid-sectionline of Section 35, Township 25 South, Range 21 East and within tracts 58 and 59 in Section 35, Township 25 South, Range 21 East of Zephyrhills Colony Company Lands, according to plat thereof, recorded in Plat Book 1, Page 55 of the Public Records of Pasco County, Florida, excluding the east 100 feet thereof. D. Pretty Pond Road: PARCEL B: The existing right-of-way westerly from the west right-of-way of U.S. Hwy. 301, for a distance of 800 feet, be, and the same are hereby annexed to and included within the -Record and Return to: • toy f City Cler.k' s Office. 5335 8th Street O. R.- 1 19 . PG 02-9_ Zephyrhi11s, FL 33540 , boundaries of the City of Zephyrhills, Florida, a municipal corporation. SECTION 2 . Said lands are contiguous to the present City limits of the City of Zephyrhills. That said lands are now unincorporated and lie in the same County as said City, and when annexed would form a compact addition to the incorporated territory of said City. That the owner of said lands contained in said area to be annexed has given written consent to have such area annexed and the City Council does hereby approve the annexation for said area. SECTION 3. That the City of Zephyrhills, Florida, has been given authority by the Legislature of the State of Florida, pursuant to Florida Statute 171. 044 and pursuant to the Charter of the City of Zephyrhills to annex contiguous areas to said City and to extend the City limits or territorial boundaries upon receipt of a written consent of all owners of land contained in the area to be annexed, together with the approval of City Council of the City of Zephyrhills,-_ of-__ said---an.nexat-ien—chily- - - - expressed by Ordinance. SECTION 4. That it is the intention of the City Council of the City of Zephyrhills, Florida, to annex the above-described lands to said City within its territorial limits and the boundary lines of said City are hereby redefined and extended so as to include said area of land within its territorial limits upon the final passage of this Ordinance. SECTION 5. That this Ordinance shall be published in a newspaper of general circulation for four (4) consecutive weeks and that proof of publication of this Ordinance shall be filed herein. • SECTION 6. That upon the filing of the Proof of Publication and final adoption of this Ordinance, a copy of same shall be filed with the Clerk of the Circuit Court of Pasco County, Florida and a copy will be forwarded to the Department of State, Tallahassee, Florida. 0.
