Home My WebLink About528 Annex – Neukom/Gall C � Ci, 2- *-\,\ \\5-0Z9 134° ORDINANCE NO. 528 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, ANNEXING ADDITIONAL TERRITORY TO BE INCLUDED WITHIN THE BOUNDARIES OF SAID CITY PURSUANT TO THE REQUEST OF THE OWNERS OF SUCH LAND AND IN ACCORDANCE WITH FLORIDA STATUTE 171. 044, LAWS OF FLORIDA. WHEREAS, GEORGE NEUKOM and OWEN GALL, are the present owners of the lands hereinafter described in Section 1, and WHEREAS, said GEORGE NEUKOM and OWEN GALL, have requested and consented to the annexation by the City- of Zephyrhillsof,, the- lands herein described in Section 1, and WHEREAS, the City Council approves the annexation of said lands and the inclusion of said lands within the corporate limits of said City, NOW, THEREFORE, BE IT ENACTED AND ORDAINED by the City Council 'of the City of Zephyrhills, Florida, as follows : SECTION 1. That the following described lands, lying and being situate in Pasco County, Florida, to-wit: George Neukom: Parcel 1: Zephyrhills Colony Company Lands, PB 1, PG 55, Tracts 28 and 37, OR 1866, PG 1678 ; Parcel 2 : Zephyrhills Colony Company Lands, PB 1, PG 55, Tract 13 & Tracts 14, 19 and 30, lying west of maintained right-of-way for Sunnyside Drive exc east 10 ft thereof for rd r/w and Tracts 20, 29 and Tracts 36, 45, 52 and 61, exc east 101.81 ft thereof, OR 1866, PG 1678; and Parcel 3 : Zephyrhills Colony Company Lands, PB 1, PG 55, Tracts 35, 46, 51, 62 and the east 101. 81 ft of Tracts 36, 45, 52 & 61, less that portion of Tracts 35, 46, 51 and 62, lying east of maintained r/w for Sunnyside Dr, OR 1215, PG 1373 and -OR 1859, PG 152 . All in Section 34, Township 25, Range 21. Owen Gall: Parcel 1: Zephyrhills Colony Company Lands PB 1, PG 55, Tracts 18, 31, 34 & 47, less the east 124 . 50 ft thereof and less west 10 ft thereof for road r/w, OR 1880, PG 134; Parcel 2 : Zephyrhills Colony Company Lands, PB 1, PG 55, Tract 50, less the west 10 ft thereof for road r/w and less the east 124 . 50 ft thereof, OR 412, PG 142 ; Parcel 3 : Zephyrhills Colony Company Lands, PB 1, PG 55, Tract 63, less the south 10 feet and west 10 ft thereof for road r/w and less the east 124 . 50 ft thereof, OR 28, PG 582 ; Parcel 4 : Zephyrhills Colony Company Lands, PB 1, PG 55, that portion of Tracts 51 and 62, lying east of maintained r/w for Sunnyside Dr. , less east 10 ft thereof for road r/w, OR 1859, PG 1306; and • Parcel 5 : Zephyrhills Colony Company Lands, PB 1, PG ' 55, that portion of. R. 1946 PG Zephyrhi 11 s, FL . 33540 - 1655_- be, and the same is hereby annexed to and included within the boundaries of the City of Zephyrhills, Florida, a municipal corporation. SECTION 2. Said lands are contiguous to the present City limits of the City of Zephyrhills. That said lands are now unincorporated and lie in the same County as said City, and when annexed would form a compact addition to the incorporated territory of said City. That the owners of said lands contained in said area to be annexed have given written consent to have such area annexed and the City Council does hereby approve the annexation for said area. SECTION 3. That the City of Zephyrhills, Florida, has been given authority by the Legislature of the State- of- Florida, pursuant to Florida Statute 171 . 044 and pursuant to the Charter of the City of Zephyrhills to annex contiguous areas to said City and to extend the City limits or territorial boundaries upon receipt of a written consent of all owners of land contained in the area to be annexed, together with the appxova.l of City Council of the City of Zephyrhills, of said annexation duly expressed by Ordinance. SECTION 4. That it is the intention of the City :Council of the City of Zephyrhills, Florida, to annex the above-described lands to said City within its territorial limits and the-boundary lines of said City are hereby redefined and extended so as to include said area of land within its territorial limits upon the final passage of this Ordinance. SECTION 5. That this Ordinance shall be published in a newspaper of general circulation for four ( 4) consecutive weeks and that proof of publication of this Ordinance shall be filed herein. SECTION 6. That upon the filing of - the Proof of Publication and final adoption of this Ordinance, a copy of same shall be filed with the Clerk of the Circuit Court of Pasco County, Florida and a copy will be forwarded to the Department of State, Tallahassee, Florida. 0.
