ORDINANCE NO. 542 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA, FIXING MONTHLY RATES AND CHARGES FOR SOLID WASTE COLLECTION AND DISPOSAL SERVICE FOR BOTH COMMERCIAL AND RESIDENTIAL PROPERTY, MAKING PROVISION FOR ROLL-OFF COMPACTOR SERVICES AND ESTABLISHING AN EFFECTIVE DATE. III Section 11-21. Rates and Charges Established. There are hereby fixed and prescribed monthly rates and charges (herein sometimes called the- service charges) for the service and facilities furnished and to be furnished by the City of Zephyrhills for collection and disposal of solid waste to be . paid by the owner, tenant, or occupant of each premises or parcel of land which shall be used or be serviced by such services and facilities, which rates and charges shall be payable monthly for services rendered, as follows : • ( 1) Residential Premises : - a. For residential premises, including mobile homes and recreational vehicles where the solid waste is collected curbside in individual cans or containers, the rate shall be Seven Dollars and Eighty Cents_ ( $7 . 80) per month for each dwelling unit. b. For residential premises served by a refuse bin or bins collected at centrally designated points, the rate shall be Five Dollars and Eighty-five Cents ($5.85) per month, per dwelling unit. (2 ) Commercial Premises : a. For commercial premises where the solid waste is collected curbside in individual containers, the rate shall be Seven Dollars and Eighty Cents ( $7 . 80 ) per month for each business unit. b. For commercial premises served by refuse bins, the ' rate shall be the greater of Eight Dollars and Seventy Cents ( $8 . 70) per month, per business unit served, or a monthly rate . computed by the volume of the bin in cubic yards, and the frequency of collection per week. The City may require the use of dumpsters in lieu of conventional garbage cans for other than . single-family 111 residential use. d. The number of pickups required by users, together with the requirements as to container size and capacity for dumpsters, shall be determined by the City Manager. e. For installation of new containers, it is the responsibility of the customer to have an adequate pad of concrete, asphalt or timber of proper size and storage capability at a location acceptable to the City. f. There shall be a charge of Twenty-five Dollars ( $25 .00) for delivery, removal, exchange or replacement of a dumpster for users. An additional charge of Twelve --Dollars ( $12 . 00 ) per cubic yard size of the bin shall be made for extra trips or return trips due to overspillage . h . For any commercial premises upon which or in which there shall be in addition to the commercial establishment, one ( 1) or more living units with kitchen facilities, there shall be a charge of Seven Dollars and Eighty Cents ( $7 . 80) per month. i. . There shall be no refund of any service charge prescribed herein on account of partial vacancy. j . There may bea refund of service charges, not to exceed charges assessed for a one-year ( 1) period, for total vacancy of the premises,- provided that the owner of the premises requests the refund from the department, in writing, and the department determines that no service has been rendered the premises for the period for which the refund is requested. No refunds or credits are authorized for partial vacancies of sixty ( 60) days or less. k. There shall be no free services rendered by the department for the collection, transportation or disposal of O.R. 2023PAGEl276 solid waste. (3 ) Special Services : a. The term "special services" shall include , but not .be limited to: . 1. Collection of yard trash which As-neithercontainerized, bagged nor bundled; 2 . _Collection of junk or, rixb} 1sh not_ `placed within containers or bins; • 3 . Collection of junk or rubbish from. lot's . or property not paying a monthly fee for collection s-eryi.cce;'s -and 4 . Provision and service of roll-off compactors by private haulers. b. Rates for special services: ,, 1 . Yard trash, junk or rubbish ollection':, An additionalcharge for the collection and disposal of yard trash, junk or rubbish not containerized, bagged: or- bundledshall be $100 . 00 per trip/load, plus the County tipping:See. compactor se .cces.. Any commercial establishment may retain the services of a private hauler to provide. a roll-off compactor for solid waste disposal. The private hauler shall be required to obtain a _general;i'City license and to remit 20% of the fees collected from' each customer within the City to the City of Zephyrhills Sanitation Fund. ( 4 ) Effective Time : • The rate schedules provided in subsections. ( 1) and (21 of:,--this section shall remain in effect until changed by Resolution of City Council after a public hearing, regarding any change in such rate schedule. ( 5) Conflicting Ordinances or Parts Thereof . Repealed: Any Ordinance or Resolution or any part thereof shall , be hereby repealed - to the extent that said Ordinance or Resolution conflicts herewith.
