PLANNING ORDINANCE" WHICH:. STATES THE
PURPOSES OF PLANNING; DESIGNATES THE
PLANNING COMMISSION AS THE LOCAL PLANNING
AGENCY AND LAND DEVELOPMENT REGULATION,. _
COMMISSION; ESTABLISHES , COMPOSITION .
ORGANIZATION AND PROCEDURES FOR. TrIE
PLANNING COMMISSION; DESCRIBES DUTIES OF
THE PLANNING COMMISSION PERTAINING TO THE _`-I;. COMPREHENSIVE PLAN AND AMENDMENTS ; REPEALS :- -
CONFLICTING ORDINANCES AND/OR REGULATIO?:'?
CF THE CITY OF ZEPHYRHILLS .
BE IT ORDAINED by the City Council of the City ` bf
Zephyrhills , sitting in regular session as follows :
SECTION 1 : SHORT TITLE. This Ordinance may be referred
to by short title as "THE. ZEPHYRHILLS COMPREHENSIVE PLANNING
ORDINANCE" .
SECTION 2 : PURPOSE. It is the purpose of this Ordinance
to encourage planning for the most appropriate use of land,
water and resources consistent with the public interest ; and
to effectively mitigate effects of future land- useand
development .
ST.CTION 3 : DESIGNATION OF PLANNING COMMISSION AS THE
LOCAL PLANNING AGENCY AND LAND DEVELOPMENT REGULATION COMMIS-
SION. The City of Zephyrhills Planning Commission •`; is
herewith designated as the Local Planning Agency (LPA) for.
purposes of preparing and maintaining a Comprehensive Plan-"-an
required by F. S . Chapter_ 163 . The Planning Conmission, is .
also designated as the City of Zephyrhills Land Development
Regulation Commission.
Section 4: POWERS OF THE PLANNING COMMISSION. Planning
Commission recommendations to City Council are advisory only.
All recommendations of the Planning Commission shall be

applicable State and City Regulations .

t Section 5 : ORGANIZATION OF PLANNING COMMISSION.
A. City Council as empowered by F. S . , Ch. 163 . 3174,
has established a Planning Commission and appointed members

thereto .
B. The Planning Commission shall be comprised of
Five (5) members : Three (3) citizens of the City of
Zephyrhills will be appointed by the Council from the
community at large and One (1) member shall be appointed from
the City staff from a planning related department . The Mayor
also shall serve upon the Planning Commission.
C . In addition, the City Council may appoint a
First and Second Alternate member to the Planning Commission.
Said Alternates may participate in all authorized functions
of the Planning Commission provided, however , such Alternates
shall have no vote in the administrative or quasi-judicial
determinations of the Planning Commission except in the
temporary absence or disability of a regular member or
members , or when such regular member or members shall be
disqualified in any particular case or cases . The term of
the Alternates shall be for a Two (2) year period provided
that the Second Alternate shall _he. for _ . One..(l) -ye r__,_per od _
the first initial year . One (1) Alternate shall be from the
City staff; One (1) shall be a non-staff person.
D. Members of the Planning Commission shall be
appointed for staggered terms of Two (2) years . Three (3) of
the original appointees shall serve for only One (1) year to
establish the staggered terms .
E. City Council may remove any member of the
Planning Commission for just cause, including but not limited
to absence without valid excuse of more than Three (3)
meetings annually after written notice and public hearing .

of office of any member shall be filled by City Council for
the remainder of the term. Such vacancy shall be filled
within Thirty (30) days of its occurrence .
G. The Planning Commission shall elect a

Chairperson and Vice-Chairperson from among its members . A
qualified City employee shall serve as Secretary.
H. The Planning Commission shall meet at regular
intervals , which it shall determine, falling not more than
One (1) month apart . It shall adopt rules for the
IIItransaction of its business and keep a properly indexed
public record of its resolutions , transactions , findings and
determinations . All meetings of the Planning Commission
shall be public .
I . The Building Department shall act as staff to
the Planning Commission by providing background information
and professional assistance in the development of
recommendations . The Building Department shall also act as
the coordinator of the Planning Commission' s activities and
represent the Planning Commission before City Council as
requested.
SECTION 6 : DUTIES OF THE PLANNING COMMISSION. The
planning Commission shall :
A. Be responsible for preparation of - the
comprehensive plan and make recommendations to City Council
regarding the adoption of such plan or element or portion
thereof. During the preparation of the plan and prior to any
recommendation to the governing body, the Local Planning
Agency shall hold at least One (1) public hearing, with due
public notice , on the proposed plan or element or portion
thereof. The governing body in cooperation with the Local
Planning Agency may designate any agency, committee,
department , -or person to prepare the comprehensive plan, or

III of such plan to the governing body shall be '<' Lhe
responsibility of the Local Planning Agency. -
B. Monitor and oversee the effectiveness and status
of the comprehensive plan and recommend to City Council such

changes in the comprehensive plan as may from time to time be
required.
C. Review proposed land development regulations ,
land development codes , or amendments thereto , and make
recommendations to City Council as to the consistency of the
proposal with the adopted comprehensive plan, or element or
portion thereof.
D. Perform any other functions , duties , and
responsibilities assigned to it by City Council or general or .
special law.
SECTION 7 : REPEAL OF CONFLICTING ORDINANCES AND/OR REGU-
LATIONS OF THE CITY OF ZEPHYRHILLS . All previously adopted Y`
Ordinances or Regulations of the City of Zephyrhills in
conflict with this Ordinance and specifically Ordinances No ..

272 , 278 and 377 are hereby repealed in their entirety.
SECTION 8: VALIDITY. If any section, part of a sect>ion,
paragraph, sentence, clause, phrase or word of this Ordinance
is , for any reason, held or declared to be .lncc st_i tu_t_ional ,
inoperative , or void, such holding of invalidity shall not
affect the remaining portions of this Ordinance and it shall
be construed to have been the intent to pass this Ordinance
without such unconstitutional , or inoperative part therein.
The foregoing Ordinance No . 414 was read and passed
on its first reading by the City Council of the City of
Zephyrhills , Florida on the 9th day of February
