HomeMy WebLinkAbout415 Defining Lots of Record, Public R.O.W., parking per dwelling units (all contained in Ord #397) loOt 4,10 ORDINANCE NO. 415 `3l AN ORDINANCE OF THE CITY COUNCIL OF THE 6 CITY OF ZEPHYRHILLS REPLACING DEFINITIONS 1\ OF "LOT OF RECORD" AND "PUBLIC RIGHT-OF- WAY" AS CONTAINED IN 3-2 ; AND REPLACING 5- 7 ; 5-8; 5-9; AND AMENDING THE MINIMUM LOT REQUIREMENTS FOR OFF-STREET PARKING PER DWELLING UNIT IN MULTIFAMILY RESIDENTIAL 111 DISTRICT (R-4) , ALL AS CONTAINED IN ORDINANCE NO. 397 , KNOWN AS THE ZONING REGULATIONS . OF THE CITY OF ZEPHYRHILLS , ORIGINALLY ADOPTED JULY 23 , 1.986 . 3-2 LOT OF RECORD A lot which is part of a subdivision, the plat of which has been recorded in the Office of the Clerk of the Circuit Court of Pasco County, OR, any parcel of land, whether or not part of a subdivision, that has been officially recorded, through a deed or other recorded legal instrument , in the Office of the Clerk, prior to July 28 , 1986 . PUBLIC RIGHT-OF-WAY Land reserved by a recorded instrument for use as a road, street , or access for the public . 5-7 LOT REQUIREMENTS All lots of record , or combination of lots of record under single ownership, which have width, depth and area which constitute sufficient size to construct or erect a structure thereon, as of the date of recording of a deed or other legal instrument shall continue to be vested with the same rights to construct or erect a structure thereon, provided: 1 . The proposed use of the lot , or combination of lots , meets all other current provisions of City Regulations , 9,n14. 2 . The lot (s) contain a minimum of 6 ,000 square feet . No lot area, lot width, or lot depth shall be reduced or diminished so that the yards or other open space shall be O. R. 1599 PG 0593 smaller than prescribed by this Zoning Code except as expressly approved by the Board of Adjustment . No space which has been counted as part of a yard, or other open space required by this Ordinance, may, by reason of change in ownership or otherwise, be counted or calculated to satisfy or comply with a yard or other open space requirement of or for any other building. 5-8 REQUIRED FRONTAGE OF LOTS AND REQUIRED ORIENTATION OF PRIMARY BUILDINGS All lots of record that are to be used for buildings shall have frontage on a public right-of-way. All primary buildings (residential , commercial or industrial) shall have primary access from a public right-of-way. In no case shall primary access be from an alley, crosswalk or pedestrian way. All single family and duplex dwelling units shall have a primary entrance facing a public right-of-way and be on a lot which has street frontage. All lots of record that are to be used for buildings 11/ shnll acness to a public t,rcct J-. _ ?i ect frontage or via a public right-of-way. Adequacy of access ,• shall be determined by the Site Plan Review Committee if not by direct street frontage . Specific criteria for adequacy of ;"' access shall be approved by City Council . 5-9 DIVISION OF LOTS No lot of record shall hereafter be divided unless , following any division, each part by itself or in combination with adjoining lot(s) shall conform with all regulations of the zoning district in which the property is located. To insure that lots or parcels which are created shall not subsequently be subdivided, transferred, conveyed or sold in , any unit other than its entirety, the owners shall •.be required to execute a "Unity of Title" document which shall be recorded with the Clerk of the Circuit Court , Pasco County, Florida. 0. R. 1599 PG 0594 4 . , • ARTICLE V - ZONING DISTRICTS - MULTIFAMILY RESIDENTIAL (R-4) MINIMUM PARKING REQUIRED IN MULTIFAMILY RESIDENTIAL ZONING DISTRICT (R-4) as contained in Page V-16 , is amended to read: Two (2) off-street parking spaces per dwelling unit IIIIII unless the development has on Public Record, legally binding restrictions which limit parkingto less than two (2) spCes per dwelling unit. However, in no case, shai.i the minimum parking ratio be less than 1 . 5 parking spaces per - dwelling unit . These Amendments to Ordinance No . 397 , sh 1. he_ome effective upon third reading and signing by the Mayor.
