BE . IT ORDAINED by the City Council of the City of Zephyrhills , sitting in regular session as follows : 1 . ADOPTION OF CONSTRUCTION CODES BY REFERENCE: The following construction codes are adopted in their entirety unless otherwise specifically modified by their Ordinance. (a) Standard Building Code as published by Southern Building Code Congress International , Inc . (S .B.C.C. I. ) ,. 1985 Edition, and all subsequent amendments or editions. (b) Standard Plumbing Code. as published by S .B. C. C. I. , 1982 Edition, and all subsequentamendments or editions . (c) National Electrical Code as published by National Fire Protection Association (TT.F.P.A. ) , 1984 Edition, and all subsequent amendments or editions . (d) Standard Excavation and Grading Code as published by S .B.C.C. I. , 1975 Edition, and all subsequent amendments or editions . The City does hereby adopt the above cited codes (a) through (m) and any subsequent amendments or new editions thereto as minimum codes for the City of Zephyrhills except as otherwise provided in this Chapter. After the adoption of these codes , all construction. within the City pertaining to the same shall be built and constructed in accordance with the specifications of said codes ,. -together with other provisions of this Chapter in all respects , as if all the provisions of said codes had been set forth herein verbatim. 2 . SPECIFIC SUPPLEMENTS AND/OR MODIFICATION TO ADOPTED Adopted by City Council Eff,ctive Date: 9/jy/J/ Pre i ie r/of CCitp� Couuncil 7 K City ager FU R-1. PG-- - STANDARD CODES : A. Regarding Modular Structures , manufactured buildings as required in Chapter -163 .O3 Florida Statutes shall be setup in accordance with the manufacturer ' s specifications ; and in addition to the specified setup procedures , all structures shall have a continuous masonry skirting at least 32" in width around the entire building perimeter... - Mobile Homes : Regarding Manufactured Housing shall be setup in accordance with the manufacturer' s specifications and shall be fully skirted around perimeter with aluminum or masonry. B. Interceptors shall be installed in all restaurants , service stations , airport maintenance shops , dry cleaners , laundromats and/or any business that allows lint , grease or grease oil by-products to enter and be dumped into the City of _Zephyrhills central sewage system. (a) Location: Interceptors shall be located so as to provide easy access for routine inspections , cleaning and maintenance. Manholes shall be provided over the inlet and the outlet of each interceptor and be brought to finish grade. (b) Discharging: Whenever an interceptor is required, waste shall ,pass through the interceptor and then be discharged , into the sewage system. (c) Sizing: The size of an interceptor shall be determined by the Site Flan Review Committee with a minimum size ofSeven Hundred _ and Fifty (750) gallons . All interceptors shall be baffled . Automatic pretreatment systems may be used in lieu of interceptor tank when approved by the City. (e) Maintenance: All interceptors shall be cleaned (materials removed from tank) monthly, unless predetermined by City Inspector. Records shall be kept and signed each month by Inspector. (f) Disposing: Disposing of waste from any 11/ interceptor shall be done by a licensed qualified company and disposed by them at a certified state land fill . C . Plumbing - Materials : All sewer pipe shall be four (4) inch schedule 40 P.V.C. or equivalent unless the existing trunk line is three (3) inches . All new installations shall be a minimum of four (4) inch diameter. D. Wire Sizes : Aluminum wire is prohibited in the use of any wire size three (3) or smaller. Wire size fourteen (14) or smaller is prohibited for any use. E. All branch circuits shall include a separate insulated grounding wire, size and marking per National Electrical Code. All wiring in commercial type zoning districts shall be in approved conduit . F. Electrical Connection: The person currently holding a franchise from the City to furnish electric power to . the residents of the City shall not connect the meter or install electric service to any new construction or building within the corporate limits of the City, unless the electrical installations thereof have been inspected and approved by the Electrical Inspector. G. Issuance of Final 'Certificate of Inspection: When any electrical wiring, apparatus or fixtures covered by a permit shall be found on inspection by the Electrical Inspector, to conform to the Rules and Regulations provided by this Ordinance, the Electrical Inspector shall issue a Adopted by City Coun it Eff ctive Date: Pres)aen of Cit Counc ' l City 14anag'`' O. R. 1643 PG _0007 5 final certificate of inspection, certifying that the wiring , apparatus or fixtures have been inspected and found to comply with the terms of this Ordinance. Oo such certificate shall be issued until such equipment is made to conform to all applicable Rules and Regulations . 111 H. Temporary Permission to Connect Before Final Certifi- cation: The Electrical Inspector may before a certificate is issued, give temporary permission to connect and furnish electric current to any wiring, apparatus or fixtures for a period not exceeding thirty (30) days , if such wiring, apparatus or fixtures are in such condition that current may safely be connected therewith for such period of time and there exists a necessity for such use; provided, that prior to any connection, written application is filed with the Building Official , requesting such permission. I. Inspection. of Conductors or Apparatus - Generally: The Electrical Inspector is empowered to inspect or reinspect all interior wires and apparatus conducting or using electrical current for light , heat or power. When such conductors or apparatus are found to be unsafe to life or property, he shall notify the person owning, using or operating electrical apparatus to place same in a safe and secure condition within twenty-four (24) hours , or within such time as the Electrical Inspector shall reasonably determine is necessary. J. Disconnection and Notice of Immediately Hazardous Condition: Whenever any wiring, apparatus or fixtures conducting or using electrical current for light ,. heat or power are found, upon inspection by the Electrical Inspector, 111 to constitute an immediate hazard to life or property, such Inspector shall immediately open the switch or circuit Adopted by City Council Ef. ctive Date: /k7 red 1dent o ' C'ty Council City Manager I O. R. 1643 PG 0008 breaker controlling the supply of current to such wiring, appartus or fixtures , and shall post in a conspicuous place near such switches or circuit breaker a notice , printed in red letters , as follows : "Notice--Wiring Condemned . The use of electric current is prohibited through this wiring or equipment until proper repairs have been made and approved by the Electrical Inspector. " Repairs shall be made by a licensed electrician or owner and the Electrical Inspector shall be notified when such repairs are completed. After such notice is posted as provided above, no person shall close the switch or circuit breaker which has been opened by the Electrical Inspector or his duly authorized assistant , nor use nor attempt to use any current through such wiring, apparatus or fixture which has been condemned, , until necessary repairs have been made and approved by the Electrical Inspector. The Electricial Inspector may also notify the person furnishing current to such wiring, apparatus or fixtures to disconnect the supply 111 wires and cut . off the current from the premises where such wiring, apparatus or fixtures are located. K. Hindering or Interfering with Electrical Inspector: It shall be unlawful for any person to hinder or interfere with the Electrical Inspector in the discharge of his duties under this Chapter. L. Electrician Certification: A master electrician shall not employ a person on any job in the capacity of an electrician without such person being in possession of a certificate of competency. Nothing in this Ordinance shall prohibit the use of helpers or apprentices on any job of electrical- construction when the work of such helpers or apprentices is performed under the personal supervision of and by an electrician holding a certificate of competency. Moving of Buildings - Written Application: Any person desiring to move a building shall first file with the Building Official a written application setting forth the following information: 1 . Type and kind of building to be moved. 2 . Extreme dimensions of the length, height , and width of the. building. 3 . Location and proposed new location, by lot , block, subdivision and street numbers . 4. Approximate time such building will be on the streets , and the contemplated route that will be taken from present to new location. 5 . A minimum 5" x 7" photo of all four (4) sides of the building. 6 . A certificate from a licensed and bonded termite company that the building is free of termites and that the structure has not been damaged by termites . 7 . A certified written statement from the Building lit Official of the County or City in which the structure was formerly located which indicates : (a) That the structure complies with all current codes in effect within said County or City; (b) That said structure could have been moved within said County or City and that it will comply with all current code requirements of said County and City after such move. - 8 . Proposed water and sewer service/facilities . N. Unit Numbers for Buildings : The owner • of each dwelling unit and commercial establishment shall attach to 111 the structure, the number assigned to such dwelling unit or commercial establishment . The Building Inspector of the City shall be responsible for assigning the street numbers referred to in this Section. Any person convicted of violating, this Section shall pay a fine of Twenty-five Dollars ($25. 00) . 3 . Registration - Trades Performed Within the City: A. All those persons duly registered or certified through the State of Florida shall register their respective license with the City of Zephyrhills Building Department annually. All persons required to obtain an occupational license from the City shall register their license with the City at the time of obtaining their occupational license or renewal thereof. Persons required to obtain occupational licenses shall incur no additional charge for registration. Any person not required to obtain an occupational license and who are required to register with the City . Building Department , pursuant to this Section, shall pay an annual charge of Twenty Dollars ($20.00) . B. Construction Contractor Licenses and Registration: A City of Zephyrhills construction contractor license or registration shall not be issued to persons who do not satisfy one or more of the following: 1 . State Registration in that respective trade with a County competency card issued by any County within the State of Florida. 2 . Registration Holder Responsible: A registration holder shall be responsible for all work performed under his certificate and shall supervise all work so performed. The extent of such supervision shall be sufficient to assure that all work performed under his registration complies with applicable codes and is done in .a workmanlike manner. D. Notification of Termination: Should the qualified representative of a firm.:or corporation sever his connection with the firm or corporation, it shall become the duty of. — such individual and of such firm or corporation to ;i s;. immediately notify the Building Official of the City of Adopted by City Counc ' l Effctive Date : 8 Preset Council City Manager 1' 4` I O.. A643 PG 0 012 1 Zephyrhills , in writing. Failure to do so will be deemed a violation of this Ordinance. 4. Registration Number Assignment : A. It shall be the duty of the Building Inspector to assign to each general contractor and subcontractor a registration number, which number shall be filed in the City records , and shall also appear on all building permits secured from the Building Inspector. 5 . Display on Vehicles : A. It shall be unlawful for any person engaging in the business of or acting in the capacity of a contractor or subcontractor to use any vehicle for the purpose of conveying or transporting tools , equipment , machinery, materials or workmen in connection with any construction work, unless there shall be first placed upon each side of such vehicle, in a prominent place, visible from a bearing of ten (10) degrees from directly ahead or behind such vehicle, the certificate number of such contractor or subcontractor , in 111 bold letters , in a. color sharply. contrasting with the background thereof, which certificate number shall be in letters of no less than three (3) inches in height . . 6 . Performance of Work by Person Without a Valid License or Registration: A. It shall •be unlawful for any person to whom a license or registration has not been issued in accordance with the provisionof this Ordinance to do any construction or make repairs , alterations , additions or changes to any existing building, except as follows : Nothing herein contained shall prohibit any bona fide homeowner from personally working on his premises , provided , -that he abides by the following Rules and Regulations : Adopted by City Council Ef , ctive Date: Pre,Afen/ o�City • `ounci1 • ,F City v1( ager ®. R. 643- G 0013 1 /1 (a) Submit plans and specifications to the Inspector for approval . (b) Satisfy the Inspector as to his ability and qualifications to do the work. (c) Make application and secure a permit before starting IIIany work of any character. (d) File an affidavit that he is a bona fide owner and will personally do the work on his own premises only. (e) Pay the required permit fees set forth in this Chapter. (f) Perform the work according to the Rules and Regulations of all codes and standards set by this Ordinance. (g) Notify the Inspector when the work is ready for the rough inspection. No work shall be covered or concealed until inspection has been made. (h) All work subject to this-Ordinance shall be done by the owner himself, on his own premises , without compensation 111 or pay-from anyone for his labor or instalation. - (i) In the event various phases of construction are subcontracted, he will engage only properly licensed subcontractors and will personally supervise such work. 7 . Violations - Punishment : If any person shall violate the terms of this Ordinance by the constructing or repair of any building within the corporate limits of the City in any mariner whatsoever in conflict with the provisions in these Codes , he shall be guilty of a misdemeanor punishable by fine of up to Five Hundred Dollars ($500. 00) or Thirty (30) days in fail , or both. - 8 . Permit Fees : The schedules of permit fees shall be determined by the Adopted by City Council Eff ctive Date : 97// //77 l'resirent ofr it Council City Manager 10: 8. 1.64-3 PG 0014 following methods : (a) Building Permits : The City does hereby adopt the recommended schedule of permit fees as contained in the Standard Building Code and as may be amended from time to time. (b) Plumbing Permits : The City does hereby adopt the recommended schedule of said fees as contained in the Standard Plumbing Code and as may be amended from time to time. (c) Mechanical Permits : The City does hereby adopt the recommended schedule of permit fees as contained in the Standard Mechanical Code and as may be amended from time to time . (d) Permits Based on Valuation: 1 . For any permit based on valuation the following values shall be used. a. Residential Construction - $25 .00 per square foot or contract price. b .. ,. Commercial Construction - $35 . 00 per square foot or contract price . c . Accessory Buildings - $12 .00 per square foot or contract price. d. All other - contract price. Code Enforcement : A. Code Enforcement Board: The City Council shall appoint a panel of seven (7) members to be known as the Code IIIEnforcement Board which Board shall whenver possible consist of the following: (a) aealtor (b) Architect (c) Building Contractor (d) Electrical Contractor (e) Businessman (f) Plumbing Contractor (g) Mechanical Contractor The Code Enforcement Board shall have all the powers and duties set forth in Florida Statutes Chapter 162 (1983) . B. Additional Duties - License Suspension: The Code Enforcement Board. shall have� the power to suspend or. revok :'- lirthe license or registration of any contractor or specialty contractor as the same are defined in F. S . 489 for failure to comply with any code, requirement or regulation of the City of Zephyrhills and found guilty of any of the following acts or omissions : 1 . Fraud or deceit in obtaining a license or registration. 2 . Gross negligence, incompetency or misconduct in the practice of any or all construction within the meaning of this Chapter. 3 . Abandonment of any contract or all construction.. without legal excuse. III4. Obtaining money or property with intention to defaud or deceive creditors or owners . 6 . Fraudulent departure from or disregard of plans or specifications in any material respect without the consent of the owner, the Building Inspector or his authorized11/ representative. - 7 . The doing of any willful or fraudulent act as a contractor in any of the trades registered in consequence of which another is substantially injured. 8 . Willful and deliberate disregard and violation of this Chapter or the Laws of the stated. C. Preference and Hearing of Charges : Any person directly interested, any City of Zephyrhills Inspector, or the architect or engineer of any building or construction may prefer charges against a contractor °under this Ordinance. Such charges must be made in writing and sworn to by the complainant and submitted to the Code Enforcement Board: It 11/ will then be the duty of the Code Enforcement Board, at the earliest possible date and not later than thirty (30) days thereafter, to investigate the charges and render their decision without delay. A copy of the, charges , together with the time and placeof hearing, shall be served on the accused at least five (5) days before the date fixed for the hearing. At the hearing, the accused shall have the right to appear personally or by counsel , to cross examine witnesses against him, and to produce witnesses and evidence in his defense. D. Action of Code Enforcement Board on Conviction of Charges and Effect on. Permits : . 1 . Place the contractor upon a period of probation, subject to any terms or conditions deemed appropriate by the Board. 111 b. Suspend the contractor ' s City occupational ,-r_ license or municipal registration for a specific piariod of`-- time. . c . Revoke the contractor's City •occupatiovial license or municipal registration. 2 . If the decision of the Board is to sus'pend _tie license or registration of a contractor for a length of time, all permits issued by the City to the contractor will be suspended for the period of the contractor' s suspension,_ . an_c1. r J no refund of permit fees shall be made . _ If the decision of the Board is to revoke the license or/ registration of a contractor, all permits issued by the Cify 111 to such person for the doing of work shall be rev6lti.2d and withdrawn and no refundsof permit fees will be made. 10 . Repeal of Conflicting Ordinance and/or Regulations of the City of Zephyrhills : . All . previously adopted Ordinances or Regulations of' the City of Zephyrhills pertaining to the construction "codes , ' licenses , registrations or any conflicting Ordinances shall-__' hereby be repealed. 11 .
