AN ORDINANCE OF THE CITY OF ZEPHYRHILLS ,
FLORIDA, REZONING PROPERTY WITHIN THE
BOUNDARIES OF SAID CITY TO A PLANNED UNIT
DEVELOPMENT IN ACCORDANCE WITH FLORIDA STATUTE
1 /5- 3 ( 166 .041 , LAWS OF FLORIDA.
WHEREAS , W. A. NEUMANN, being the owner of the lands
IIherein described in Section One, has requested that the
property described below, also known as WEDGEWOOD MANOR, be
rezoned from Multi-Family Residential (R-4) , - to e_ a..,._zoning
designation as a Planned Unit Development District , , in
accordance with the zoning regulations of the City of
Zephyrhills , dated July 28 , 1986 , and incorporated by
reference into Zephyrhills City Ordinance No. 397 , known as
the "City of Zephyrhills Zoning Ordinance" , and
WHEREAS , the Planning Commission and other appropriate
Cityauthorities , have reviewed the general site plan for the
Planned Unit Development , together with the Declaration of
Covenants , Restrictions and Easements for Wedgewood Manor ;
Articles of Incorporation for Wedgewood Manor Homeowners
Association, Inc . ; Bylaws of Wedgewood Manor Homeowners
Association, Inc . ; and other related documents submitted by
W. A. Neumann, and
WHEREAS , the Planning Commission after review of the
above reference documents has recommended approval of the
request of W. A. Neumann to rezone the property described in
Section One, to a Planned Unit Development District , subject
to the City' s rezoning regulations and the representations .
made by W. A. Neumann, as developer of Wedgewood Manor ,
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of Zephyrhills as follows : -
SECTION 1 . That the following described lands , lying
and being situate in Pasco County, Florida, to-wit:
That portion of the E 1/2 of the NE 1/4 of the
NW 1/4 of Section 10 , Twp. 26S , Rng. 21 E,
Pasco County, Florida, South of the right-of-
way for Geiger Road, less and except the North
208 . 71 ' of the East 208 . 71 ' thereof; together
with Tracts 38 , 39 , 40 , 41 and 42 Zephyrhills
Colony Company Lands in Section 10 , Twp. 26S.,
Rng. 21 E, as recorded in Plat Book 1 , Page
55 , Public Records of Pasco County, Florida,
Less the South 522 . 5 ' of the West 500 .5 ' of
said Tracts 41 and 42; subject to an easement
for ingress and egress over and across the
West 15 .O' of Tract 42 , less the South 522 . 5 '
thereof. Containing 37 . 67 acres .
be, and the same are rezoned from Multi-Family
Residential (R-4) zoning designation, to that of a Planned
Unit Development District .
SECTION 2 . Development of the above _ describedland _ . .
shall be subject to, and in accordance with, the City of
Zephyrhills Zoning Ordinance, and the zoning regulations of
the City of Zephyrhills , together with the following
documents and instruments , which are hereby incorporated by
reference herein.
A. General Site Plan for Wedgewood Manor , bearing
date of , 198
B. Declaration of Covenants , Restrictions and
Easements for Wedgewood Manor , as approved by City Council
and recorded of public records in the Public Records of Pasco
County, Florida.
C. Articles of Incorporation of Wedgewood Manor
Homeowners Association, Inc .
D. Bylaws of Wedgewood Manor Homeowners
Association, Inc .
E. Developer agrees to pay 9.7% of cost to widen
pavement to. 24 feet_ and resurface. Geiger. Road between the
Wedgewood Manor entrance and U. S . 301 if no firm decision is
made to construct the C.R. 54 west by-pass prior to September
30 , 1989. This cost will not include any acquisition of
additional roadway right-of-way or relocation of utilities .
The current estimated costs are $40 ,000 .00 . The maximum cost
to developer of Wedgewood Manor would be $3,880 .00. This
agreement is effective when 125 dwelling units have been
permitted. It is expressly understood that the Geiger Road
improvements will be contracted by the City of Zephyrhills .

F. Developer shall dedicate fifteen (15) feet
additional right-of-way along that portion of Planned Unit
Development that is contiguous to Geiger Road.
SECTION 3 . This Ordinance shall become lawuponbeing
passed by the City Council of the City of Zephyrhills after
three (3) readings and execution by the preciding officer and
the clerk of that body in accordance with Florida Statute
166 .041 , Laws of Florida.
The foregoing Ordinance No. 455 was read and passed -
on its first reading in open and regular meeting by the City
Council of the City of Zephyrhills , Florida on the 14th day
of March , A.D. , 1988 .
