AN ORDINANCE TO BE KNOWN AS THE "BUILDING
CONSTRUCTION STANDARDS" ORDINANCE REPEALING CHAPTER
6, CHAPTER 9 , CHAPTER 18, CHAPTER 10, AND CHAPTER
19-1 OF THE PRESENT CITY CODE GOVERNING BUILDING,
ELECTRICAL , PLUMBING, FIRE PROTECTION, AND SIGNS ;
ADOPTING STANDARD BUILDING CODE ; REQUIRING WRITTEN
APPLICATION TO MOVE A BUILDING AND PROVIDING
REGULATIONS THEREFOR ; PROHIBITING USE OF PILLARS FOR
FOUNDATIONS ; REGULATING FENCES, WALLS AND HEDGES ;
ADOPTING STANDARD PLUMBING CODE ; AND PROVIDING FOR
SEWER PIPE REGULATIONS ; ADOPTING NATIONAL ELECTRICAL

Building Construction Standards
ARTICLE I - GENERAL
6 . 1 BUILDING CODE ADOPTED .
The City does hereby adopt that certain Standard
Building Code as proposed and published by Southern
(

Building Code Congress International , Inc . , of the issue
of 1982 with 1983 amendments and any subsequent
amendments of edition or .new edition thereto as the
minimum. code for the, City of Zephyrhills except as
otherwise provided in this chapter . From and after the
adoption of this code , all buildings constructed within
the City shall be built and constructed in accordance
with the specifications and requirements of said building
code , together with other provisions of this chapter , in
all respects , as if all of the provisions of said code
had been set forth in this code verbatim .

6 .2 MOVING OF BUILDINGS-WRITTEN APPLICATION.
( a) Not_ withstandj.ng the above code , any person
desiring to move a building shall first file with the
building official a written application setting forth the
following information :
1 . Type_ and kind of building to be moved ._
2 . The extreme dimensions of the length ,
height , and width of the building .
3 . Its present location and proposed new
location , by lot , block , subdivision and
street numbers .
4. The approximate time such building will be
on the streets , and the contemplated route
that will be taken from present to new
location .
5 . A minimum 5" x 7" photo of all four sides
of the building .
6 . A certificate from a licensed and bonded
termite company that the building is free
of termites and that the structure has not
been damaged by termites .
7 . A certified written statement from the
building official of the county or city in
which the structure was formerly located
which indicates :
( a) That the structure complies with all
current codes in effect within said
county or city;
(b ) That said structure could have been
move'd within said county or city and
that all current code requirements

within said county or city after such
move .
8. Proposed water and sewer facilities .
6 .3 USE OF PILLARS FOR. ..EOUNDATION - PROHIBITED;
FOUNDATIONS TO _BE. CONTINUOUS .
It shall be unlawful for any person to construct or
build within the city limits any type building in which
pillars are to be used for the foundations for such
building . Any foundation or support used for any
building shall be a continuous foundation , as contrasted
to the separate pillar type which is hereby specifically
prohibited .
6 .4 FENCES, WALLS AND HEDGES .
( a) Definitions . The following words and phrases ,
when used in this section , shall have the meanings given
to them in this paragraph :
Clear sight triangle. A triangular area formed at a
street intersection or intersection of a street and
railroad crossing or a street and driveway. The size of
the clear sight triangle shall be determined by using the
Florida Department of Transportation ' s Manual of Uniform
Minimum Standards for Design , Construction and
Maintenance for Streets and Highways , but in no case
shall it be less than that area formed by measuring
ninety ( 90) feet in each direction from the center line
point of 'inte'rsec`tion , provided the ninety ( 90) feet
shall not apply with regard to a residential driveway
where no other inter'secti'on is concerned .
Fence . Any structure of wire, metal , wood or
masonry construction exceeding thirty ( 30) inches in

height .
Front'' Yard': The required open space extending
across the entire width of the lot between the building
set back line and the street right-of-way line . Where
double frontage or corner lots exist , the front yard
shall include the yard fronting both streets .

Hedge . Any plantings , shrubs or natural vegetation
placed so as to form a continuous line or barrier .
(b ) Permits , fees and standards . All persons
desiring to construct any fence , wall or hedge in - excess
of thirty ( 30) inches in height must firstobtain a
permit from the building department . All applications
must include a plot plan showing the relative location of
all streets , easements , property lines and buildings .
Permit fees 'dial 1 be based on the value of the
construction with a minimum fee of five ( $5 .00) . The
construction' of all fences , walls or hedges in all
districts shall comply with the following standards :
( 1 ) Height . The height of any fence located in the
front yard of a lot shall not exceed three ( 3) feet . The
height of any wall or hedge shall not exceed thirty ( 30)
inches . No plantings or shrubs of any type within the
clear sight triangle shall exceed thirty ( 30) inches .
The height of any fence, wall or hedge located in
the rear or side yard of any lot shall not exceed, Ox (6 )
feet in residential districts and eight ( 8) feet in, all
other districts , except where the adjacent property is
zoned residential in which case the residential limit
shall apply. .
(2 ) Material . _ All fences must be constructed of
new materials and the design and appearance shall be.
consistent with that commonly used in any district
Only chain link , welded wire or decorative woven
wire can be used in the front yard of a lot and must be
constructed of a material that is at least ninety ( 90)
percent transparent . Post or top rails cannot exceed two
( 2 ) inches in diameter . Fences located in a side or rear
=_yard may be of any suitable material and may be solid or
semi -transparent . Barbed wire, farm or field-type_ _,
fencing is prohibited , except in agricultural districts

where they are adjacent to residential areas . All fences
o''r walls must have a finished side facing the adjoining
property.
( 3 ) Set backs :
a. All . chain link or wire-type fences that can
be constructed and maintained from one side only must be
set back a minimum of four (4) inches from the lot line .
b . All solid fences less than three (3 ) feet
in height that can be maintained from one side only must
be set back a minimum of four (4) inches from lot line .
c . All solid fences over three ( 3) feet in
height must be set back a minimum of three ( 3) feet from
the lot line .
d . No fence , wall or hedge shall be installed
on or across any roadway, alley or easement and shall be
set back a minimum of four (4) inches from any such
roadway, alley or easement .
(4) Generally: -
a. The property owner prior to constructing
any fence , wall or hedge shall assume the responsibility
for determining by survey the correct boundaries of the
property to be fenced and the existenceof any easements
or rights-of-way that exist . Failure to provide the
building department with complete and accurate
information when applying for a permit shall be
sufficient cause for; the building official to order the
removal of any construction not in compliance with this
code .
b . All fences , walls and hedges shall be
constructed so as to be safe and neat in appearance and
shal be maintained so . Any fence, wall or hedge which
becomes dilapidated and unsafe or is damaged in excess of
thirty ( 30) per cent of its total may be ordered removed
by the building official .

c . Any nonconforming fence damaged in excess
of thirty (30) percent shall be removed in its entirety
or if rebuilt , such reconstruction shall place the entire
fence in conformity with this section .
6 . 5 STANDARD PLUMBING CODE - ADOPTED .
The city does hereby adopt that certain Standard
Plumbing Code, as prepared and published by Southern
Building Code Congress International , Inc . , of the issue
of 1982 edition with 1983 amendments and any subsequent
amendments of editions or new editions thereto as the
minimum code for the City of Zephyrhills except as
otherwise provided in this chapter . From and after the
adoption of this code all construction within the City
pertaining to the same shall be built and constructed in
accordance with the specifications of said code , together
with other provisions of this chapter in all respects , as
if all the provisions of said code had been set forth
herein verbatim.
6 . 6 PLUMBING - MATERIALS .
Notwithstanding the above code, all sewer pipe shall
be four ( 4) inch schedule 40 PVC or equivalent unless the
existing trunk line is three inches . All new
installations shall be' a minimum of four inch .
6 . 7 NATIONAL ELECTRIC CODE - ADOPTED .
The city does hereby adopt that certain National
Electric Code , as prepared and published by National
Fire Protection Association of the issue of 1984 and any
subsequent amendments of editions or new editions thereto
as the minimum code for the City of Zephyrhills except as
otherwise provided in this chapter . From and after the
adoption of this code all construction within the City
pertaining to the same shall be built and constructed in

accordance with the specifications of said code, together
with other provisions of this chapter in all respects , as
if all the provisions of said code had been set forth
herein verbatim.
6 . 8 STANDARDS SUPERCEDING 6 . 7 ABOVE .
Notwithstanding the provisions of 6 . 7 , pertaining to
Electrical Construction the following subsections set
forth hereafter shall apply.
6. 9 USE OF WIRING OR APPARATUS PRIOR TO INSPECTION AND
CERTIFICATION.
It shall be unlawful for any person to use any
electrical current in or through any wiring apparatus or
fixtures for light , heat or power in or on any building
or structure within the limits of the city, until the
same shall have been inspected and approved by the
111 electrical inspector and the certificate provided for in
subsection ( 9) of section 9-12 shall have been issued
therefor .
6 . 10 CONNECTION OF SUPPLY BY ELECTRIC COMPANY PRIOR TO
INSPECTION, APPROVAL AND ISSUANCE OF COMPLETION PERMIT.
The person currently holding a franchise from the
city to furnish electric power to the residents of the
city shall not connect the meter or install electric
service to any new construction or building within the
corporate limits of the city, unless the electrical
installations thereof have been inspected and approved by
the electrical inspector .
6. 11 ISSUANCE OF FINAL CERTIFICATE OF INSPECTION. When
any electrical wiring , apparatus or fixtures covered by a
permit shall be found , on inspection by the electrical
inspector, to conform to the rules and regulations
provided by this chapter the electrical inspector shall

one of his duly authorized assistants , to be especially
or immediately hazardous to life or property, such
inspector or one of his duly authorized assistants shall
immediately open the switch or circuit breaker
controlling the supply of current to such wiring ,
apparatus or fixtures and shall post in a conspicuous
place near such switches or circuit breaker a notice ,
printed in red letters, as follows :
"Notice--Wiring Condemned . The use of electric
current is prohibited through this wiring or
equipment until proper repairs have been made
and approved by the electrical inspector . "
Repairs shall be made by a licensed electrician or owner
and the electrical inspector shall be notified when such
repairs are completed . After such notice is posted as
provided above, no person shall close the switch or
circuit breaker which has been opened by the electrical
inspector or his duly authorized assistant , nor use nor
attempt to use any current through such wiring, apparatus
or fixture which has been condemned , until necessary
repairs have been made and approved by the electrical
inspector . The electrical inspector may also notify the
person furnishing current to such wiring apparatus or
fixtures to disconnect the supply wires and cut off the
current from the premises where such wiring , apparatus or
fixtures are located .
6 . 15 HINDERING OR INTERFERING WITH .
It shall be unlawful for any person to hinder or
interfere with the electrical inspector in the discharge
of his duties under this chapter .
111 6 . 16 . A master electrician shall not employ a person on
any job in the capacity of an electrician without such
person being in possession of a certificate of
competency, as provided for in this article; provided ,

that nothing in this article shall be held to prohibit
the working of helpers or apprentices on any job of
electrical construction , when the work of such helpers or
apprentices is performed under the personal supervision
of and accompanied by an electrician holding a
certificate of competency.
6 . 17 MATERIALS ANDSPECIFICATIONS - COMPLIANCE WITH
CHAPTER AND OTHER REGULATIONS .
All electrical construction and all materials and
appliances used in connection with the installation ,
maintenance and operation of electrical wiring , apparatus
or equipment for light , heat or power within the city
limits shall conform to the rules and regulations
embodied in this chapter and such as may be adopted as
herein provided , and shall conform with such
construction as is reasonably necessary for safety to
life or property. The latest current regulations as laid
down in the National Electrical Code, as approved by the
American National Standards Institute and the National
Safety Code , as approved by the American Standards
Association , and other installation and safety
regulations approved by the American Standards
Association shall be prima facie evidence of such
approved methods as of the time and regulations are laid
down .
Conformance with approved safety regulations ;
maker ' s trademark , ratings , etc , to be placed on
materials sold , installed or used .
No electrical materials , devices or appliances ,
designed for attachment to or installation in any
electrical circuit or system for light , heat or power ,
shall be installed , used , sold or offered for sale for
use in the city, unless they are in conformity with
O. R. 1372 PG __0__759_-
approved methods of construction for safety to life and
property. Conformity of electrical materials, devices or
appliances with the standards of Underwriter ' s
Laboratories , Inc . , as indicated by the list of inspected
electrical appliances published and distributed from time
to time by Underwriter ' s Laboraties , Inc . , or with other
standards approved by the American National Standards
Institute, shall be prima facie evidence that such
electrical materials , devices or appliances comply with
the requirements of this article . The maker ' s name ,
trademark or other identification symbol shall be placed
on all electrical materials devices or appliances sold ,
installed or used under the provisions of this article,
together with such other markings giving voltage ,
current wattage, or appropriate ratings as are prescribed
in the National Electrical Code, or as may be necessary
to determine the character of the material , devices or
equipment and the uses for which they are intended .
6 . 18 WIRE SIZES . -
In the use of any wire size three ( 3 ) or smaller ,
aluminum wire is prohibited . Wire size 14 or smaller is
prohibited for any use .
6. 19 STANDARD AMUSEMENT AND DEVICE CODE - ADOPTED .
,,, The city does hereby adopt that certain Standard
Amusement and Device Code , as prepared and published by
Southern Building Code Congress International , Inc . , of
theissue of 1979 with 1982 amendments and any subsequent
amendments of editions ornew editions thereto as the
minimum code for the City of Zephyrhills except as
otherwise provided in this chapter . -From and after the
adoption of this code all construction within the City
pertaining to the same shall be built and constructed in
accordance with the specifications of said code, together

6. 20 STANDARD FOR ELIMINATION OR REPAIR OF UNSAFE
BUILDINGS - ADOPTED .
The city does hereby adopt that certain Standard for
Elimination or Repair of Unsafe Buildings Code , as
prepared andpublished by Southern Building Code Congress
International , Inc . , of the issue of 1982 and any
subsequent amendments of editions or new editions thereto
as theminimum code for the. City. of Zephyrhills except as
otherwise provided in this chapter . From and after the
adoption of this code all construction within the City
pertaining to the same shall be built and constructed in
accordance with the specifications of said code, together
with other provisions of this chapter in all respects , as
if all the provisions of said code had been set forth
herein verbatim.
6 . 21 STANDARD EXCAVATION AND GRADING CODE - ADOPTED .
The city does hereby adopt that certain Standard
Excavation and .Grading Code , as prepared and published
by Southern Building Code Congress International , Inc . ,
of the issue of 1975 and any subsequent amendments of
editions or new ed.itions thereto as the minimum - co:de for
the City 'of' Zephyrhills'' except as otherwise provided in
this chapter . From and after the adoption of this code
all construction Within the City pertaining to the same
shall be built and constructed in accordance with the
specifications of said code, together with other
provisions of this chapter in all respects , as if 'all the
provisions of said' code had been set forth herein
verbatim.

6 . 22 STANDARD FIRE PREVENTION CODE - ADOPTED .
The city does hereby adopt that certain Standard
Fire Prevention Code , as prepared and published by
Southern Building Code Congress International , Inc . , of
the issue of 1982 with 1983 amendments and any subsequent
amendments of editions or new editions thereto as the
minimum code for the City of Zephyrhills except as
otherwise provided in this chapter . From and after the
adoption of this code all construction within the City
pertaining to the same shall be built and constructed in
accordance with the specifications of said code, together
'with other provisions of this chapter in all respects , as
if all the .provisions of said code had been set forth
herein verbatim.
6 . 23 STANDARD GAS CODE - ADOPTED .
The city does hereby adopt that certain Standard Gas
Code , as prepared and published by Southern Building
Code Congress International , Inc . , of the issue of 1982
with 1983 amendments and any subsequent amendments of
editions or new editions thereto as the minimum code for
the City of Zephyrhills except as otherwise provided in
this chapter . From and after the adoption of this code
all construction within the City pertaining to the same
shall be built and . constructed in accordance with the
specifications of said code , together with other
provisions of, this chapter in all respects, as if all the
provisions of said code had been set forth herein
verbatim.
6 . 24 STANDARD HOUSING CODE - ADOPTED .
The city does hereby adopt that certain Standard
Housing Code , as prepared and published by Southern
Building Code Congress International , Inc . , of the issue
of 1982 with 1983 amendments and any subsequent

minimum code for the City of Zephyrhills except as
otherwise provided in this chapter . From and after the
adoption of this code all construction within the City
pertaining to the same shall be built and constructed in

if all the provisions of said code had been set forth
herein verbatim.
6 . 25 STANDARD MECHANICAL CODE - ADOPTED .
The city does hereby adopt that certain Standard
Mechanical Code, as prepared and published by Southern
Building Code Congress International , Inc . , of the issue
of 1982 with 1983 amendments and any subsequent
amendments of editions or new editions thereto as the
minimum code for the City of Zephyrhills except as
otherwise provided in this chapter . From and after the
adoption of this code all construction within the City
pertaining to the same shall be built and constructed in
accordance with the specifications of said code , together
with other provisions of this chapter in all respects , as
if all the provisions of said code had been set forth
herein verbatim.
6 . 26 STANDARD SWIMMING POOL CODE - ADOPTED .
The city does hereby adopt that certain Standard
Swimming Pool Code, as prepared and published by Southern
Building Code Congress International ', Inc . , of the 'issue
of 1982 with 1983 amendments and any subsequent
amendments of editions or new editions thereto as the
minimum code for the City of Zephyrhills except as
otherwise provided in this chapter . From and after the
adoption of this code all construction within the City
pertaining to the same shall be built and constructed in

accordance with the specifications of said code , together
with other provisions of this chapter in all respects , as
if all the provisions of said code had been set forth
herein verbatim.
6. 27 NATIONAL FIRE CODE - ADOPTED .
The city does hereby adopt those certain ' National

,. as prepared and published by the National Fire Protection
Association of the issue of 1982 with 1983 amendments and
any subsequent amendments of editions or new editions
thereto as the minimum code for the City of Zephyrhills
except as otherwise provided in this chapter . From and
after the adoption of this code all construction within
the City pertaining to the same shall be built and
constructed in accordance with the specifications of said
code , together with other provisions of this chapter in
all respects , as if all the provisions of said code had
been set forth herin verbatim. . •
ARTICLE II CONTRACTORS - CERTIFICATION •
6 .-28 CERTIFICATE OF COMPETENCY.
A certificate of competency shall be required of all
persons engaged in the construction industry in the City
of Zephyrhills . Certificates of competency shall be
issued to persons only. In the case of firmsand
corporations , a certificate of competency shall be issued
to person determined to be qualified and who is actively
in charge of and supervising work . Should the qualified
representative of a firm or corporation sever his
connection with the firm or corporation , it shall become
the duty .of such individual and ofsuch firm or
corporation to immediately notify the building official

of the City of Zephyrhills , in writing . Failure to do so
wil be deemed a violation of this article .
A certificate holder shall be responsible for all
work performed under his certificate and shall supervise
all work so performed . Th extent of such supervision
shall be sufficient to assure that all work performed
under his certificate complies with applicable codes and
is done in workmanlike manner .
Certificates of Competency ( Licenses ) shall only be
issued to persons satisfying one of the following
criteria .
1 . To persons holding valid city certificate of
competency ( active or inactive) on October 1 , 1983 .
2 . To persons providing evidence of a passing grade
of 70 or better on an examination given by the firm of
Block and Associates , Inc . , of Gainesville , Florida.
3 . To persons possessing a current and valid
certificate of competency issued _by Pasco County,
Florida, or any county or municipality reciprocating with
approval of City Council .
4. To persons possessing a current and valid
certificate of competency issued by the State Department
of Professional Regulation . (State Certified
Contractors . )
The following trades shall be certified :
1 . General Contractor .
2 . Building Contractor .
3 . Residential Contractor .
4. Roofing Contractor .
5 . Swim. Pool Contr . (A or B) .
6 . Master Electrician .
7. Master Plumber .
8. Swim. Pool Maint . & Repair .
9 . Sheet Metal Contractor .
10 . Mechanical Conractor .
11 . Air Condit . Contr . , Class A.
12 . Air Condit . Contr . Class B .
13 . Air Condit . Contr . Class C .

6 . 29 APPLICATION.
1 . Any person making application for Certificate of
Competency shall :
( a) Furnish , an affidavit stating that applicants
will not undertake any work which would have not have
been within the scope of the Certificate of Competency
for which they are applying .
( b) Give bond in the sum of FIVE THOUSAND AND
00/100 ( $5 ,000.00) DOLLARS .
( c) Furnish proof that Public Liability Insurance
is maintained with a company authorized to do business in
Florida, with minimum limits of $25 ,000 . 00 for one person
in any one accident , and property damage insurance with a
minimum of $10,000.00 for any one accident .
( d ) Furnish proof that the requirements of Worker ' s
Compensation Law in the State of Florida have been met .
( e) The .fee for Certificate of Competency issued
by the City of Zephyrhills shall be $50 . 00 annually,
except state certification .
6 .30 RENEWAL .
A holder of a Certificate of Competency issued by
the City of Zephyrhills must renew the same prior to

October 1st of each year . The penalty for renewals of
Certificates of Competency on or after October 1st , but
prior to November 1st , shall be $25 . 00 . For renewals on
or after October 1st , but prior to November 1st of the
following year , the penalty shall be $200 . 00. The holder
of a Certificate of Competency who fails to renew his
certificate within the thirteen month period , as set out
above , shall successfully pass a re-examination before
said certificate may be renewed .
Inactive Status - Any person , firm or corporation
who engages in any construction work , may request the
building division to place the Certificate of Competency
on an inactive status . In no event shall the inactive
status exceed a three year period . A person or firm so
seeking to place a Certificate of Competency on an
inactive status must pay a Fifteen ( $15 .00 ) Dollar fee
per year , while said Certificate is on an inactive
status . Such person or firm must surrender its
Certificate of Competency to the building division until
such time as they desire to activate it . The building
division , by registered mail , shall send out a notice to
all persons or firms presently on an inactive status ,
stating that they have ninety ( 90) days within which to
comply with the provisions of this subsection . All
those , except those who are actively engaged in their
trade under the supervision of a certificate holder , who
are or have been on an inactive status for three ( 3 )
years or more, must reactivate their certificate of
competency within the above-prescribed ninety ( 90) day
period . Failure to reactivate will result in a
forfeiture of their Certificate of Competency.
6 .31 BOND REQUIREMENTS .

The City shall require that , subsequent to
qualifying for and prior to the issuance of a Certificate
of Competency under this Chapter, persons qualifying for
the •-said Certificate shall either be bonded through Pasco
County or shall post bond in their name as principal , in
the sum of FIVE THOUSAND AND OO/100 ( $5 ,000 .00) DOLLARS.
, Said bondshall be payable to the Governor of the State
'of Florida, and his successors in Office and may be a
cash bond or a bond with a corporation surety authorized
to do business in' the State of Florida . The individual
so qualified for a bond must indicate on the bond whether
he/she is doing business as a corporation and is not the
President , Vice President , or Secretary of said
corporation , the bond must also bear the signature of one
of these officers , or the principal
must show his/her authority to bind the corporation . The
form of said bond shall be approved and adopted by the
111 Clerk of the Circuit Court . The conditions of said bond
shall be as follows :
( 1 ) The principal , and any and all agents and
employees of said principal , shall protect and compensate
all persons suffering any loss or damage occasioned by
said principal failing to comply with any of the
provisions of this Chapter or any rules , regulations ,
and/or codes adopted pursuant thereto .
(2) The principal shall , without additional cost to
the person for whom any work is performed ,. remedy all
defects in workmanship or material furnished or used by
'said principal ., The principal shall , within sixty (60)
' days ' after the completion of said work , reconstruct any
defective work and replace or make good any defective
material , to the satisfaction of the department having
jurisdiction of the class of work embraced in the code

applicable thereto , after notice from such department to
reconstruct , replace or repair the same .
( 3 ) Upon the failure or default on the part of the
principal in remedying any defects in faulty workmanship
or incorrect construction: or installation , or upon
failure or default of the principal to replace or make
good faulty materials furnished or used by said
principal , then the preson for whom such work has been
performed shall have a right of action against the
principal and surety under this obligation; provded ;
however, that no suit , action or proceeding by reason of
any default shall be brought on this bond after one ( 1 )
year from date of final inspection by the Building
Departmentof the, work done by the principal for any such
person .
(4) Thebond shall expire on September 30 of each
year , unless renewed .
6 .32 VIOLATIONS - PUNISHMENT.
If any person shall violate the terms of this
chapter by the constructing or repair of any
building within the corporate limits of the City in any
manner whatsoever in conflict with the provisons of these
Codes , he shall be guilty of a misdemeanor punishable by
fine of up to $500 . 00 or thirty ( 30) days in jail , or
both .
6 . 33 UNIT NUMBERS FOR BUILDINGS.
Each dwelling unit and commercial establishment
shall attach to the premises upon which it is constructed
the number assigned to such dwelling unit or commercial
establishment . Such numbers , when attached , shall be
clearly visible from the street fronting the premises .
The building inspector of the city shall be responsible
for assigning the street numbers referred to in this

section . Any person convicted of violating this section
shall pay a fine of Twenty-Five ($25 . 00) Dollars .
6 .34 CERTIFICATE OF COMPETENCY NUMBER - ASSIGNMENT:
FILING WITH THE BUILDING OFFICIAL, APPEARANCE PERMITS.
It shall be the duty of the building inspector to
assign to each general contractor and subcontractor a
certificate number , which number shall be filed in the
city records , and shall also appear on all building
permits secured from the building inspector of the
City.
6. 35 DISPLAY ON VEHICLES .
It shall be unlawful for any person engaging in the
business of or of acting in the capacity of a contractor '
or subcontractor to use any vehicle for 'the purpose of
conveying or transporting tools , equipment , machinery,
materials or workmen in connection with any construction
work , unless there shall be first placed upon each side
of such vehicle, in a prominent place , visible from a
bearing of ten degrees. from directly ahead or behind such
vehicle, the certificate number of such contractor or
subcontractor, in bold letters , in a color sharply
contrasting with the background thereof, which
certificate number shall be in letters of no less than
three inches in height .
6 . 36 PERFORMANCE OF WORK BY PERSONS WITHOUT
CERTIFICATES .
It shall be unlawful for any person to whom a
certificate of -competency has not been issued in
accordance with the provisions of this ordinance to do
any -construction or make repairs , alterations , additions
or changes to any existing building , except as follows :

Nothing herein contained shall prohibit any bona
fide home owner from personally working on his premises ;
provided , that he abides by the following rules and
regulations :
( a) He shall submit plans and specifications to the
inspector for approval .
(b ) He shall satisfy the inspector as to his
ability and qualifications to do the work .
( c) He shall make application and secure a permit
before starting any work of any character .
(d ) He shall file an affidavit that he is the bona
fide owner and will personally do the work on his own
premises only.
( e) He shall pay the required permit fees set forth
in this chapter .
(f) He shall perform the work according to the
rules and regulations of all codes and standards set by
this ordinance .
(g ) He shall notify the inspector when the work is
ready for the rough inspection . No work shall be covered
or concealed until inspection has been made .
( h ) Any work under these rules and regulations
shall be done by the owner , for himself, on his own
premises , without compensation or pay from anyone for his
labor or installation .
( i ) That in the event various phases of
construction are subcontracted , he will engage only
properly licensed subcontractors and will personally
supervise such work .
ARTICLE III PERMITS
6. 37 PRIOR TO THE INITIATION OF ANY CONSTRUCTION, A
PERMIT SHALL BE OBTAINED .
The charges for permits shall be as follows :

1 . Building permits . The City does hereby adopt
the recommended schedule of permit fees as contained in
the Standard Building Code and as may be amended from
time to time .
2 . Plumbing permits . The City does hereby adopt
the recommended schedule of said fees as contained in the
Standard Plumbing Code and as . may- be amended from time to
time .
3. Mechanical permits . The City does hereby adopt
the recommended schedule of permit. fees as contained in
the Standard Mechanical Code and as may be amended from
time to time .
4. Permits based on _valuation .
1 . For any permit based on valuation the
following values shall be used .
( a) Residential Construction - $25 . 00 per
square foot or contract price .
( b) Commercial Construction - $35 . 00 per
square foot or contract price .
(c) Accessory Buildings - $12 . 00 per square
foot or contract price .
(d) All other - contract price .
5 . Electrical Permits . Electrical Permits shall be
issued based on the following :
Minimum Fee $ 10 . 00
Residence - 25 .00
Mobile Home 15 .00
Each Fixture , Switch or Outlet 110V . 25
Each Fixture, Switch or Outlet 220V 1 . 00
Each A/C System 5 . 00
Electric Signs 15 .00
0 through 100 AMP Service 5. 00
100 through 200 AMP Service 10 . 00
200 through 400 AMP Service 20 . 00
400 through 800 AMP Service 40 .00
Over 800 AMP Service 80. 00
- Outdoor Temporary Service 100-200AMP 50 . 00
Outdoor Temporary Service Over 200AMP 100. 00
ARTICLE IV CODE ENFORCEMENT

6 .38 CODE ENFORCEMENT BOARD .
The city council shall appoint a panel of . seven ( 7 )
members to be known as the Code Enforcement Board which
board shall whenever possible consist of the follO'wing :
( a) Realtor .'
(b ) Architect .
( c) Building Contractor .
(d ) Electrical Contractor .
( e) Businessman .
(f) Plumbing Contractor .
( g ) Mechanical Contractor .
The Code Enforcement Board shall have all the powers
and duties set forth in Florida Statutes Chapter 162
( 1983 ) .
6. 39 As the need arises for Boards of Appeal and Boards
of Adjustment in the building , plumbing, mechanical and
fire codes for interpreting the codes and resolving
disputes and for such other purposes as set forth in such
codes the chairman of the Code Enforcement Board shall
appoint , subject to the approval of the Council ,
additional members from persons in the field with which
the specific code is involved . These additional members
shall be appointed and serve as the need exists .
6 .40 ADDITIONAL DUTIES - LICENSE SUSPENSION .
The Code Enforcement Board shall have the power to
suspend or revoke the license of any contractor or
speciality contractor as the same are defined in F . S . 489
for failure to comply with any code, requirement or
regulation of the City, Pasco County or State of
Florida and found guilty of any of the following acts or
omissions :
( a) Fraud or deceit in obtaining a license or a
certificate of competency.

( b) Negligence , incompetency or misconduct in the
practice of electric construction within the meaning of
this chapter .
(c) Abandonment of any contract for electrical
construction without legal excuse .
,i ( d ) Diversion of property or funds received under
express agreement for-prosecution- to completion of a
specific contract under this chapter .
( e) Obtaining money or property with intention to
defraud or deceive creditors or owners .
( f) Fraudulent departure from or disregard of plans
or specifications in any material respect without the
consent of the owner, the electrical inspector or his
duly authorized representative .
(g ) The doing of any willful or fraudulent act as a
master electrician or journeyman electrician in
consequence of whichanother is substantially injured .
( h ) Willful and deliberate disregard and violation -
of this chapter or the laws of the stated .
6 .41 PREFERENCE AND HEARING OF CHARGES .
Any person directly interested , any City of
Zephyrh'ills Inspector , or the architect or engineer of
any building or construction may prefer charges against a
contractor under this ordinance . Such charges must be
made in writing and sworn to by the complainant and
submitted to the board . It will then be the duty of the
board , at the earliest possible date and not later than
thirty days thereafter , to investigate the charges and
render their decision without delay. A copy of the
charges , together with the time and place of hearing ,
shall be served on the accused at least five days before
the date fixed for the hearing . At the hearing , the
accused shall have the right to appear personally or by

counsel , to crossexamine witnesses against him, and to
produce witnesses and evidence in his defense .
6 .42 ACTION OF BOARD ON CONVICTION OF CHARGES ; EFFECT ON
PERMIT ; ENGAGING IN BUSINESS AFTER REVOCATION.;
RATIFICATION.
( a) If, after the hearing provided for in section \ . -
above , the board ' s decision is that the accused has been
guilty of the charge preferred against him, the board
shall thereupon suspend , for a period of time, or revoke
the accused ' s certificate of competency.
( b ) Upon the revocation of the accused ' s
certificate of competency, all permits issued by the city
to such person for the doing of work shall be revoked and
withdrawn and no refunds will be made on such permits .
If the decision of the board is to suspend the
certificate of competency for a length of time, the
permits issued by the city to the accused will be
suspended of the same period , and no refund shall be made
on such permit .
6 .43 PROVISION IN THE EVENT OF ANY UNCONSTITUTIONAL
CLAUSE . '
In the event any part or parts of this Ordinance
should be found to be unconstitutional , then in that
event the remaining portions of this Ordinance shall
remain in full force and effect .
This Ordinance shall become effective when passed on
its third reading and when signed by the Mayor .
The above and foregoing Ordinance was read and
passed on its first reading in open and regular meeting
on this 27th day of August , 1984,
