ORDINANCE NO. 329 NAY ifI 10 10 AM '82 AN ORDINANCE AMENDING SECTION 19-21 OF THE CITY CODE PROVIDING A METHOD FOR PETITION AND APPROVAL FOR REIMBURSEMENT OF WATER AND SEWER LINE EXTENSIONS AND PROVIDING A METHOD OF ASSESSING THOSE CONNECTING TO THE CITY EXTENSION: PROVIDING FOR DATA TO BE CERTIFIED TO THE CITY, AND ESTABLISHING A MAXIMUM TIME PERIOD FOR REIMBURSEMENT ; AMENDING SECTION 19-3 OF THE CITY CODE PROVIDING FOR A WATER IMPACT FEE AND SEWER TIE-IN CHARGES ; PROVIDING A TABLE FOR DETERMINING THOSE FEES ; AMENDING SECTION 19-35 (5) PROVIDING FOR A BASE FEE PER USER OF WATER AND SEWER. BE IT ORDAINED BY THE CITY COUNCIL , OF THE CITY OF ZEPHYR- C9 HILLS , as follows : CO I . Section 19-21 , COSTS : ctr CO (a) The entire cost of extension of the water and/or c water system shall be borne by the person applying for such service . The costs incurred by the applicant shall not be reimbursed to the applicant . This expenditure by the applicant is a direct result from the applicant ' s desiring to obtain the fullest degree of public health and safety for his usage . (b) An exception to paragraph (a) shall be only upon petition and approval by the City Council . When approval has been granted by the City and a developer has paid the cost of an "off-site" water line or sewer line connection or extension, any property owner connecting to said connection or extension shall pay a proportionate amount of the entire cost by paying, prior to connection, in addi- tion to any connection or impact fees otherwise charged by the City, a sum equal to One Dollar per gallon for water connection and a sum equal to One Dollar per gallon for sewer connection based on such property owner ''s daily usage as determined by "Table A" attached hereto and as it may from time to time be amended by resolution of the City Council . If the .' reimbursement to the developer is not made within five ` years of the date of completion of the connection or exten- sion by the developer the money so paid by any property out- III side the City limits thereafter connecting to the connection or extension shall revert to the City until such time as full reimbursement shall occur. The City shall be entitled to ten percent of the gross amount paid during the five year period for its costs in bookkeeping, administration and verification of data supplied by the developer . The developer shall at the time of petition, provide to the City an engineer ' s certified statement as to the capacity of the proposed lines , the developer' s required capacity for use , the excess capacity of the line above developer 's use together with such other data as will enable the City to obtain its own professional corroborative advice based on that data to verify its accuracy.- -Any useor- purported—us-e by--a-developer- over -his- - certified use shall be treated the same as any other user. Upon the completion of the connection or extension by the developer the developer shall provide an engineer 's written certification as to the entire cost to the developer of such a connection or extension which figure shall be broken down into water line construction, sewer line construction and any other pump- ing station costs or expense for which reimbursement is sought . All certifications shall be by a professional engineer registered in the State of Florida and all certifications shall be a condition precedent to receiving any reimbursement in the manner provided. - II O. R. 1188 PG 01t3 271 All reimbursement shall be upon the dollar amount per gallon as stated herein unless otherwise approved by the City based upon construction costs or such other factors as the City shall deem to be reasonable and necessary elements for- consideration. II . Section 19-3 . APPLICATION FOR SERVICE, shall be deleted in full and shall hereafter read as follows : No person shall use the City water and/or sewer system CO without first making written application for such service CO to the City at least fourteen working days in case of initial 00 cut-in before the service is desired, paying all costs ; charges , fees , and deposit incident thereto . Such application shall be on forms furnished by the City and such applicant shall agree by acceptance of such service to abide by all the provisions of this chapter and such applicable rules of the City in regard to the use of its water, sewer , and sewage disposal system as may from time to time be operative and effective. All such applications shall be accompanied by a sum equal to $2. 00 per gallon as a sewer tie-in charge which amount shall 'be for the purpose of future sewer plant expansion and sewer line extension and the sum of $L . 00 per gallon as a water _Qnnection_ fee plus actual cost of water meter. The number of gallons • shall be determined as per a "Table" which shall be- .adopted by the City by resolution and as may be amended from time to ' - - time, o ' `time, which Table shall establish the gallons per day of use according to the type of establishment to be serviced.. .,Appli- cations for service by firms , partnerships , associations , and corporations shall be tendered only by their duly authorized agents and the official title of such party shall be assigned to the application. i_- ( O. Section 19-35 (5) , SERVICE FEE, shall be deleted . in its entirety and shall hereafter read as follows : (5) BASE RATE: There shall be a One Dollar base fee per user of water and a One Dollar base fee per user_ 'f - sewer per lot per month _if such lot is inside the City:. and One Dollar and Fifty Cents ($1. 50) per user of water and One Dollar and Fifty Cents ($1 . 50) per user of sewer if such lot is outside the City during the period service _ is active (lot shall also include each individual lot in mobile home parks , each individual unit of a motel , hotel or apart- ment) . The base amount shall be in addition to any charge for actual usage. This ordinance shall become effective when passed on its third reading and signed by the Mayor of said City.
