ORDINANCE NO. 349
AN ORDINANCE TO BE KNOWN AS THE "ZEPHYRHILLS FENCE
ORDINANCE PROVIDING FOR DEFINITIONS; REGULATING
I CONSTRUCTION AND PLACING OF FENCES, WALLS AND
HEDGES; REGULATING HEIGHTH, MATERIAL AND- SET-BACKS ;
PROVIDING FOR DETERMINING PROPERTY BOUNDARIES;
REQUIRING CONSTRUCTION PERMIT; AUTHORIZING ORDER TO
REMOVE FENCES ; PROVIDING FOR DILAPIDATED OR UNSAFE
OR DAMAGED- FENCES AND THEIR RECONSTRUCTION ;
PROVIDING FOR REPEAL OF ORDINANCE PROVISIONS IN
• CONFLICT; PROVIDING FOR EFFECTIVE DATE .
WHEREAS, the City deems it to be in the best
interest of the City to provide for the safety of the"
City residents 'and to provide '.'for ' uniformity within ' the
City as to the construction and maintenance of fences .
NOW; ' THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL
sitting in regular session as follows :
SECTION 1 .. DEFINITIONS :
111 a. Clear Sight Triangle : A triangular area formed
at a street intersection or intersection of a street and
railroad crossing or a street and driveway. The size of
the clear sight triangle shall be determined by using
the Florida Department of Transportation ' s Manual of
Uniform Minimum Standards for Design , Construction and
Maintenance for Streets and Highways but in no case
shall it be less than that area formed by measuring 90
feet in each direction from the centerline point of
intersection provided the 90 feet shall not apply with
regard to a residential driveway where no other
intersection is concerned.
b. Fence : Any structure of wire, metal , wood or
masonry construction exceeding thirty inches in

c . Hedge : Any plantings , shrubs or natural
vegetation placed so as to form a continuous line or
barrier .
SECTION 2. :
- ( a) All persons desiring to construct any fence,
wall or hedge i n ,excess of 30 -inches in height must,
first obtain,-a permit from the Building Department . All
applications must include a plot plan showing the
relative. location of of all streets ,, easements , property
-lines and buildings . Permit fees shall be based on the
value of the construction with a minimum fee of $5 . 00.
( b ) The construction of all fences , walls or hedges
shall comply with the following standards :
1 . All Districts : .
— a. Height
Y — — - -
The height of any fence located in the front
yard or the side yard, of a corner . lot shall not exceed
three ( 3) feet . The height of any wall or hedge shall
not exceed thirty (30) inches . No plantings or shrubs
of any type within the clear sight triangle shall exceed
thirty inches .
The height of any fence, wall , or hedge located
in a side or rear yard shall not exceed six (6) feet in
residential districts and eight (8) feet in all other
districts except where the adjacent property property is zoned
residential in which case the residential limit shall
apply. .

b . Material All fences must be constructed
of new materials and the design and appearance shall- be
consistent with, that commonly used in any district .
Only chain link , welded wire, or decorative
woven wire. can be used in the. front. yard or side yard of
a corner lot and. must be constructed of a material that
- .i s at least.. 90% ' transpar.ent . . Post • o,r. top- rails-- cannot
exceed two (2) inches in diameter . Fences located- in a
Ode- or rear yard. may. be of any 'suitable material and
may be solid or semi -transparent . Barbed wire, farm or
field type fencing is prohibited except 'in agricultural
districts except where they are adjacent to residential
areas . All fences or walls must have a finished side
facing the adjoining property. .
c . Set Backs
1. All chain link or wire type fences that
can be constructed and maintained from one side.' only
111. must be- -set back a minimum of four inches from the lot
line.
2 . • All solid fences less than three feet
in height that can be maintained from one side only must
. - be set back a minimum of four inches from the lot line.
;,3•. ,, All • solid- fences over three ( 3) feet ' in
• height must be set back a minimum of three ( 3) feet from
the lot line.

4. No fence, wall or hedge shall be in-
' stalled on or across any roadway, alley or easement and
shall be, set back .Va •minimum of four' inches_fr._om ' any' such
roadway, alley, or -easement .. ,
d. General '
1. The property owner prior to construct-
ing any- fence, wall, or hedge shall assume the responsi -

bility for determining by survey the correct boundaries
of the property to be fenced and the existence of . any
easements or rights-of-way that exist . Fai"lure- to pro-
vide the Building Department with complete and accurate"., .;.

cient cause for the Building Official to order the

removal of any construction not in compliance with ' this-
code .
2 . All fences , walls and hedges shall be '
constructed so as to be safe and neat in appearance and
shall be maintained so . Any fence, wall or hedgewhich
becomes •dilapidated :and unsafe or is damaged in excess
of 30% of its total may be ordered removed by the Build-
ing Official .
3. Any non-conforming fence damaged An
"excess of. 30% shall be removed in its entirety or if ' ;-
rebuilt , such reconstruction shall place the entire
fence in:conform:ity-with this ordin-abce-.-- ""
SECTION 3. -
e
This ordinance shall repeal any part of any prior
ordinance in conflict .
SECTION 4.
This ordinance shall take effect upon "its -.third
reading and when signed by the Mayor .
The foregoing Ordinance No. 349 . was read and
passed on its first reading by the City Council of the
City of Zephyrhills , Florida, on the 9th day of
May , 1983 . . . .
