AN ORDINANCE TO BE ENTITLED AN ACT RELATING
TO THE RESTRICTIONS AND REGULATIONS OF MOBILE
HOME PARKS TO BE KNOWN AS THE "ZEPHYRHILLS
111 MOBILE HOME REGULATION ORDINANCE" ; PROVIDING
FOR THE PURPOSE OF THIS ORDINANCE ; DEFINING
THOSE AREAS AFFECTED; ESTABLISHING A PROCEDURE
FOR ESTABLISHING NEW OR REVISED MOBILE HOME
PARKS ; DEFINING PERMITTED USES ; ESTABLISHING
LOT SIZES AND STANDARDS ; ESTABLISHING A STANDARD
FOR STREETS AND ROADS ; ESTABLISHING BUFFERING
REQUIREMENTS ; REQUIRING A SITE AND DEVELOPMENT
PLAN; GOVERNING EXISTING PARKS AND PROVIDING
FOR DECLARATION OF ANY VALIDITY.

gq SECTION 1 . PURPOSE . The purpose of this ordinance is
Q to provide for the development of areas for individual mobile
Q
homes , parks and subdivisions for residents desiring the unique
environments characteristic of mobile home living. Further it is
the purpose of this ordinance to provide for these areas the
community services necessary for their orderly development.
III SECTION 2 . DEFINITION. Those areas developed under single
ownership for purposes of rental or sale of mobile home lots shall
be considered mobile home parks and shall be subject to minimum
site requirements .
SECTION 3 . ESTABLISHMENT PROCEDURE. New or revised mobile
home parks shall be required to comply with all provisions of the ,
city ordinances and regulations . Developers of mobile home parks .
shall file an application with a legal description of the property
to be included, a sketch plan showing the intended overall development
plan, a description of the means by which the open space restrictions
shall be applied, and a description of the manner in which water and
sewer faciliities shall be provided.
The City Manager after receipt of the application shall submit
said application to the City Council for review and comment .
The Council shall have thirty (30) days to review and comment
on the site plan unless it is determined that supplemental information
is necessary in-which case they shall have thirty (30) days from time

After receipt of the Council review the City Manager
shall take the appropriate action, based on the applications
conformance to the stated objectives and regulations of this
Ordinance . The applicant shall be notified in writing of
the reasons for said rejections .
SECTION 4. PERMITTED USES . Upon designation of an
area for use as a mobile home park or subdivision, the
following permitted uses shall be allowed: mobile homes and
accessory or support facilities customarily incidental to the
operation of the facility. This would include such things as
laundry facilities to serve the residents , recreational
facilities , and -maintenance facilities (completely contained in
enclosed structures) , necessary to serve the facility .
SECTION 5 . DEVELOPMENT STANDARDS FOR MOBILE HOME PARKS .
Mobile home parks may be developed as permitted by the
City Council ' s written authorization and in accordance with
the following requirements : -
A. Minimum site area of ten (10) acres .
B . Minimum lot area of four thousand (4, 000) square
feet .
C . Maximum possible gross density 8 . 8 dwelling units
per acre .
D. Mobile homes shall be separated from each other
and other structures by at least fifteen (15) feet .
E . (a) A set-back of fifteen (15) feet in width from
all property lines of parcels of different
use except for public streets shall be pro-
vided and maintained in each mobile home
park. Such set-back shall not be consider-
ed to be part of an abutting mobile home
space nor shall said set-back be used as
part of the recreation area.
(b) Front set-backs from existing or planned
centerlines of rights-of-way of public
thoroughfares shall be required if the
set-backs in (a) are less than the follow-
ing .

1 . Major and minor arterials - 145

2 . Collector Streets - 70 feet from
centerline.
3 . Local Streets - 45 feet from the center-
line .

F. The development of recreational and open spaces
shall be in accordance with the requirements
established by Pasco County for its R-MH Urban
District Subdivisions , however, in no case shall
any part of such recreation area be less than
ten thousand (10 ,000) square feet .
111 G. Each mobile home shall have a living area of
at least four hundred forty (440) square feet .
SECTION 6 . PARK STREETS AND ROADS . Roadways or streets
within a mobile home park may be private but the following
requirements shall apply:
® A. Internal collector streets shall be thirty (30)
`q feet in width, with a minimum of twenty-four (24)
feet of paved surface .

czt B . Internal minor streets shall be twenty-five (25)
Q feet in width, with a minimum of twenty (20)
'Cr feet of paved surface.
SECTION 7 . BUFFERING REQUIREMENTS . In those residential
districts where other than single-family dwellings or workers
quarters are allowed, a buffer shall be required when more than
111 one mobile home , duplex, triplex, quadraplex, or townhouse

1 . Buffer areas shall not be less than five (5) feet
in width measured at right angles to property
lines and shall be established along the entire
length of and contiguous to the designated property
line or lines except where modified by this ordinance.
2 . Buffers shall be in the form of walls , fences or
landscaping . Landscape buffers shall be designed
to be seventy-five (75) percent or more opaque
within one (1) year after start of construction
and all buffers shall be a minimum height of six
(6) feet .
3 . Buffering shall be required of all open storage
in accordance with 2 above .
4. Where landscape buffers are used, irrigation shall
be required within the buffer are-a and maintenance
shall be theresponsibilityof the property owner.
5 . Parkingofpassenger vehicles shall be permitted
in any required yard except buffer areas as other-
wise established in this Ordinance .
6 . All portions of an improved lot or parcel not con-
tained within a building or within paved parking
and loading areas , aisles , drives , or walkways ,
shall be landscaped with sod, shrubs , trees or
other materials .
7 . Fences , hedges or other plantings , structures or
walls at street corners shall not be located so
as to interfere with the clear sight triangle on
corner lots . The height of such objects is restricted
to three and one-half (3 . 5) feet within the clear
sight triangle .

SECTION 8 . SITE AND DEVELOPMENT PLAN.
A. Procedure : Where by the terms of this
Ordinance a site and development plan is required which
shall be prior to the issuance of a building permit , such
site and development plan shall be submitted to the City

Manager. He shall circulate the site and development plan
for comment and criticism to the City Council and any other
City officer or department which may have a responsibility
for some aspect of the site and development plan. The City
Manager shall review the site and development plan applica-
tion within thirty (30) days from the date of submission of
all data required in this section for an adequate review.
B . Contents . The site and development plan required
to be submitted under subsection A above and by the require-
ments of this Ordinance shall include the following elements ,
where applicable:
1 . Statements of ownership and control of the
. proposed development .
2 . Statement describing in detail the character
and intended use of the development .
3 . General location map , showing: relation of the
. site for which site and development plan
approval is sought to major streets , existing
utilities , important physical features in
and adjoining the project, and the like.
4. A site plan containing the title of the project
and the names ofthelproject planner and developer
date, and north arrow and, based on an exact
survey of the property drawn to a scale of
sufficient size to show (a) boundaries of the
project, any existing streets , buildings , water
courses , easements , and section lines ; (b)
exact location of all buildings and structures ;
(c) access and traffic flow and how vehicular
traffic will be separated from pedestrian and
other types of traffic ; ,.(d) off-street park-
ing; (e) recreation facilitie's locations ; (f)
all screens and buffers ; (g).. refuse collection
areas ; and (h) access to utilities and points
of utilities hookups .
5 . Tabulations of total gross acreage in the- project
and the percentages thereof proposed to be devoted
to (a) various permitted uses ; (b) ground
coverage by structures ; and (c) impervious surface
coverage .

6 . Tabulations showing (a) the derivation of
numbers of off-street parking and (b) total
pmject density in dwelling units per acre .

If common facilities (such as recreation areas
or structures , private streets , common open
space, etc. ) are to be provided for the
development , statements as to how such common
facilities are to be provided and permanently
maintained. Such statements may take the form
of proposed deed restrictions , deeds of trust,
home owners associations , surety arrangements ,
or other_ legal instruments providing adequate
guarantee to the City that such common facilities
will not become a future -liability for -the City.

Items (3) , (4) , (8) , and (9) above shall be prepared by a
registered surveyor, engineer, or architect or practicing land,
planner as may be appropriate to the particular item.. --'— �� t
SECTION 9 . EXISTING PARKS . Those mobile hothel'parks/' x --

shall be governed in accordance with the above criteria as )
practicably as possible, provided, however, that such,

subdivisions may be completed and operated in accordance with

plans for development as previously approved, or can continue
to be •operated in such manner as they were as of the date of
adoptiort of this Ordinance; and provided further, thatsuch,; :j`R.'`'

SECTION 10 . VALIDITY. If any section, part of a
section, paragraph, sentence, clause, phrase or word of this
Ordinance is , forany reason, held or declared to be un-
constitutional , inoperative, or void, such holding of in-
validity shall not affect the remaining portions of this It-

Ordinance and it shall be construed to have been the intent
to pass this Ordinance without such unconstitutional , invalid,
or inoperative part therein.
SECTION 11 . EFFECTIVE DATE . This ordinance shall become
effective when signed by the Mayor or upon becoming law.
