SECTION 1 . DEPOSIT ON PUBLIC RIGHT OF WAY. It shall be unlawful for any person to deposit , discard, throw, place or pile any trash, litter of any type , paper, garbage, cans , carton, bottles or other waste or discarded materials along any public street , sidewalk or right of way within the city limits ; provided, that materials left on property by the respective property owners 111 for collection by the street and garbage department shall be excluded from the provisions hereof. SECTION 2 . DEFINITIONS . The following terms and phrases , when used in this article , shall have the meanings ascribed to them by this section: BUSINESS : A commercial or industrial establishment or enterprise except mobile home parks . DWELLING UNIT: Any place where persons live and reside and where the usual housekeeping tasks are performed. For the purpose of this ordinance, mobile home and/or travel trailer parks shall be regulated under the rate schedule for dumpsters -when dumpsters are used for collection and storage of garbage - debris . Furthermore, said dumpster rates shall apply when owners of stated uses collect and deposit garbage debris in dumpster(s) . If the City of Zephyrhills assumes the responsibility of collect- ing garbage from individual lots then each lot shall be charged according to rates for single family dwelling . 1U 539 FA04428 , � GARBAGE : Every residence , restaurant , kitchen, shop , store or factory accumulation of animal , fruit or vegetable matter , liquid, or otherwise, that attends the preparation, use or cooking, dealing in or storage of meats , fish, fowl , fruit or vegetables , and any bottles , cans or other containers which, -dueto their "ability to retain water, may serve as breeding places for mosquitoes or other water breeding insects . Garbage products are also inclusive of paper ,boxes , paper products , tar paper, appliances , wire and other similar matter. TRASH : Leaves , shrubbery , trimmings , tree trimmings , tree limbs , sweepings and all other accumulation of any nature other than garbage which are usual to housekeeping and to the operation of stores , offices and otherplaces of business . Tree limbs shall not exceed six feet in length; except, that any such treelimbs having diameters of one foot or more shall be - cut in lengths not exceeding three feet . SECTION 3 . REQUIRED. All residents , occupants or owners of premises in the city, and all other uses as deter- mined by the city council , shall be required to have accumula- C71 tion of garbage and trash removed in a manner and at rates prescribed by the city council . SECTION 4 . CHARGES-SCHEDULE OF FEES . For the removal services required by section three , all residents , occupants or owners of premises shall pay to the city a monthly collection charge, as per the following schedule : (a) Dwellings . Single family dwellings . $3 . 00 per mo . Duplexes (each unit) 3 .00 per mo . Multi-family dwellings (each unit if individual garbage cans are used) . . 3 .00 per mo . Multi-family complexes that utilize dumpsters shall be charged according to rates defined in Section 4-b . Motels , hotels-First twelve rooms , per room 1 .00 per mo . Motels , :hotels having more than twelve rooms shall utilize a GF Pdumpster of proper capacity. RCC S39 f;C4429 (1• V Business establishments , regardless of nature, not hereinabove provided for : • Minimum: Dailypickup , except Sunday and Saturday, and removal of twenty-four twenty gallon cans or containers of garbage, trash cans shall have lids and full bottoms $4 .00 per mo . Two pickups per week and removal of twelve thirty gallon cans or containers of garbage $2 . 00 per mo . The removal of garbage in excess of the amount provided for in the minimum above shall be at the rate of one dollar per month for each twelve thirty gallon cans or contain- ers or any part thereof. (b) Use of container for garbage removal . The number of pickups required by users together with requirement as to container size and capacity for dumpsters shall be determined by the City of Zephyrhills . 2 . For installation of new containers , it is the responsibility of the customer to have an adequate pad of concrete, asphalt or timber of proper size and storage capability at a location acceptable to the City of Zephyrhills . 3 . There shall be a. charge of Ten Dollars for delivering, removing, exchange or placement of a dumpster for users . EFFC 939 PAGF'4,, • 4 (c) Trash Removal . 1 . Single family dwelling $1 .00 per mo . 2 . Duplexes (each unit) $1 .00 per mo . 3 . Multi-family dwellings (each unit if individual garbage cans are used) $1 . 00 per mo . III Multi-family complexes that utilize dumpsters (each unit) . . ._ . . . .-$_ . 25 per mo . Hotels and motels $2 . 00 per mo . 4. Commercial and industrial Business establishments , regardless of nature, not hereinabove provided for : Minimum $1 . 00 per mo . Each additional occupant in common building $ . 25 per mo . 5 . There shall be a charge of twenty-five cents (25Q) per lot per month for trash removal from mobile home and/or travel trailer parks . The number of lots to be assessed is the total lots located within a park. 6 . Should trash removal from any of the afore- mentioned three locations exceed one truck. load (twelve foot by eight foot truck bed) in 111 any two week period of time, an additional charge of five dollars shall be .made for any such additional load or portion thereof. (d) In the event that more than one business establishment is contained in a cothuiion building , the owner of the building, at his option may provide for a single place of deposit for the garbage of all such occupants of that building and be billed for garbage collections by paying one minimum charge of four dollars per month and whatever additional charge provided for in this section. This charge shall be in lieu of the minimum charge being paid by each occupant ' of such common building, plus any overcharge, as is provided in this section. Nothing contained in this section shall prohibit the city council from designating a different type of garbage contained „ than that presently in use and setting charge accordingly, as provided by subsection (b) of this section. t1- 939 Pah,1431 AA: ,�, , (e) The rate schedules provided in subsections (a) and (b) of this section shall remain in effect until changed by the city council . A public hearing shall be had :''-: ",,,, - i :l by the city council regarding any change in such rate ,,schedule ' •' and notice of such public hearing shall be duly published ait least fifteen days prior to the date of such public hearing. - I ,`-,_ SECTION 5 . BILLING; PAYMENT;- DELINQUENT ACCOUNTS . J (a) The monthly charge provided for in subs&c-tionsJ (a) and (b) of Section 4 shall be billed on quarterly statements , issued by the city, for water services ; provided, that such garbage and trash collection shall be itemized separately on such statement . (b) Such garbage and trash collection charge herein ,` . provide d for shall be paid within thirty days after 'the date p,f" mailing of the statement, as stamped thereon, or such collection = b III service shall be discontinued until all of such charges" shall be „, paid in full; Vti ;`,- (c) Garbage fees shall be charged to all customers on a monthly basis . No customer shall be allowed to terminate charges for garbage. and trash fees unless such customer also terminates water service to the premises . SECTION 6 . PENALTY FOR VIOLATION OF ARTICLE . Any person or persons found guilty of the violation of this article shall pay a fine of not more than five hundred dollars or spend sixty days in jail at the discretion of the court . SECTION 7 . ORDINANCES REPEALED.
