ORDINANCE NO. 310
AN ORDINANCE OF THE CITY OF ZEPHYRHILLS , AMEND-
ING ORDINANCE 280 (CHAPTER 11 of ZEPHYRHILLS
CITY COUNCIL) , REGULATING THE COLLECTION AND
REMOVAL OF GARBAGE AND TRASH; PROHIBITING CERTAIN
PLACEMENTS OF DISPOSABLE MATERIAL; PROVIDING
FOR DEFINITIONS, PROVIDING FOR THE REQUIREMENT
THAT SERVICES BE UTILIZED; SCHEDULE OF FEES CHARGED;
PROVIDING FOR BILLING, PAYMENT AND DELINQUENT ACCOUNTS:
PROVIDING FOR PUNISHMENT IN THE EVENT OF A VIOLATION
OF THIS ORDINANCE TOGETHER WITH SETTING PENALTY AND
REPEALING ORDINANCE 110 , 189 , 205 , 232 , 280 AND
RESOLUTION 24 .
Chapter 11, Code of Zephyrhills and Ordinance 280 (effective
date 4/10/78) are hereby amended to delete all provisions and to
substitute the following :
Article I . In General
§ 11-1 . Definitions .

ARTICLE I . IN GENERAL
Sec. 11-1. Definitions .
The following terms and phrases , when used in this chapter,
shall have the meanings ascribed to them by this section:
Business : A_commercial or industrial establishment or enter-
prise except mobile home parks .
Dwelling Unit: Any place where persons live and reside and
where the usual housekeeping tasks are performed. For the purpose
of this chapter, mobile home and/or travel trailer parks shall be
regulated under the rate schedule for dumpsters when dumpsters are
used for collection and storage of garbage debris . Furthermore ,

said dumpster rates shall apply when owners of stated uses
collect and deposit garbage debris in dumpster(s) . If the city
assumes the responsibility of collecting garbage from individual
lots , then each lot shall be charged according to rates for
single-family dwellings .
Garbage : Every residence, restaurant, kitchen, store or
factory accumulation of animal , fruit or vegetable matter, liquid
or otherwise that attends the preparation, use or cooking, deal-
ing in or storage of meats , fish, fowl , fruit or vegetables , and
any bottles , cans or other containers which, due to their ability,
to retain water, may serve as breeding places for mosquitoes or
other water-breeding insects . Garbage products are also inclu-
sive of paper boxes , paper products , tar paper, appliances , wire
and other similar matter.
Trash: Leaves , 5hrubbery, trimmings , tree trimmings , tree
limbs , sweepings and all other accumulations of any nature other
than garbage which are usual to housekeeping and to the operation
of stores , offices and other places of business . Tree limbs shall
not exceed six (6) feet in length, except that any such tree limbs
having diameters of one (1) foot or more shall be cut in lengths
not exceeding three (3) feet.
Sec. 11-2 . Deposit on public right-of-way.
It shall be unlawful for any person to deposit , discard,
throw, place or pile any trash, litter of any type , paper,
garbage, cans , cartons , bottles or other waste or discarded
materials along any public street, sidewalk or right-of-way
within the city limits ; however, materials left on property
by the respective property owners for collection by the street
and garbage department shall be excluded from the provisions
hereof.

ARTICLE II . REMOVAL BY CITY
Sec. 11716 Required.
All residents , occupants or owners of premises in the
city, and all other uses as determined by the city council ,
shall be required to have accumulation of garbage and. trash
removed in a manner and at rates prescribed by the .city council .
Sec. 11-17 . Charges- -Schedule of fees .
(a) Garbage Removal. For the removal services required
by section 11-16 , all residents , occupants or owners of premises
shall pay to the city a monthly collection charge , as per the
following schedule :
(1) Dwellings .
Single-family dwellings , per month . . . . . . . . $4 . 00
Duplexes (each unit) , per month 4 00
Multi-family dwellings (each unit if individual
garbage cans are used) , per month 4 00
Multi-family complexes that utilize dumpsters
shall be charged according to rates defined
in subsection (b) .
(2) Motels ,. hotels .
First twelve (12) rooms , per room, per month. . 2 . 00
Motels , hotels having more than twelve (12)
rooms shall utilize a dumpster of proper ,
capacity.
(3) Business establishments , regardless of
nature, not hereinabove provided for,
minimum:
Two (2) pickups per week and removal of twelve
(.12) thirty-gallon cans or containers of
garbage,- per month 4 00
The removal of garbage in excess of the amount
provided for in :the minimum above shall be
at the rate of one dollar ($1 . 00) per month
for each twelve (12) thirty-gallon cans or
containers _or any part thereof.
(b) Use of Container for Garbage Removal . Should
the use of containers be authorized and used,
in lieu of conventional garbage cans , the
following rate schedule shall apply :

(1) The number or pickups required by users ,
together with requirement as to container size and capacity
for dumpsters , shall be determined by the city.
(2) For installation of new containers , it is the
responsibility of the customer to havean adequate pad of con-
crete , asphalt or timber of proper size and storage capability
at a location acceptable to the city.
(3) There shall be a charge of Twenty-five Dollars
($25 . 00) for delivering, removing, exchange or placement of a
dumpster for users .
(c) " Trash Removal .
(1) Single-family dwelling, per month $1 . 50
(2) Duplexes (each unit) per month 1 . 50
(3) Multifamily dwellings (each unit if
individual garbage cans are used) , per
month.- 1 . 50
(4) Multifamily complexes that utilize dump-
sters (each unit) , per month. . . . . . . . . . 25
(5) Hotels and motels , per month. . . . . . . . . 2 . 00
(6) Commercial and industrial .
Business establishments , regardless of
nature , not hereinabove provided for:
Minimum per month 1 . 50
Each additional occupant in common
building, per month . 25
(7) There shall be a charge of twenty-five cents
per lot per month for trash removal from
mobile home and/or travel trailer parks . The
number of lots to be assessed is the total lots
located within a park.
(8) Should trash removal from any of the afore-
mentioned three (3) locations exceed one (1)
truck load (twevle-foot by eight-foot truck
bed) in any two-week period of time , an
additional charge of five dollars ($5 . 00) shall
be made for any such additional load or por-
tion thereof.

(d) Multiple Businesses in Same Building. In the
event that more than one (1) business establishment is con-
tained in a common building, the owner of the building, at his
option,. may provide for a single place of deposit for the
garbage of all such occupants of that building and be billed for
garbage collections by paying one (1) minimum charge of four
dollars ($4 . 00) per month and whatever additional charge
provided for in this section. This charge shall be._in lieu
of the minimum..charge being paid by each occupant of such common
building, plus any overcharge , as is provided in this section.
Nothing contained in this section shall prohibit the city council
from designating a different type of garbage contained than that
presently in use and setting charge accordingly, as provided by _ �J
subsection (b) of this section.
(e) Effective Time . The rate schedules provided in
subsections (a) and (b) of this section shall reman in . ffect
until changed by the city council . A public hearing shall:, be .
had by the city council regarding any change in such rate schedule ,
and notice of such public hearing shall be duly published at
least fifteen (15) days prior to the date of such public hearing.
Sec. 11-18 . Same--Billing ; payment, delinquent accounts .

(a) The monthly charge provided for in subsections_ (a)
and (b) of section 1.1-17 shall be billed on quarterly statements ,
issued by the city for water services ; but such garbage and tras1 )
collection shall be itemized separately on such statement.
(b) Such garbage and trash collection charge herein -17
provided for shall be paid within" thirty (30) days after the date
of mailing of the statement, as stamped thereon; or such collection
sezvice shall be discontinued until all of such charges shall be
paid in full .
(c) No customer shall be allowed to terminate charges for
garbage and trash fees unless such customer also terminates water
service to the premises .

Sec. 11-20 . Penalty for violation of article .
Any person or persons found guilty of the violation of
this article shall be guilty of a misdemeanor of the second =-
degree as defined by State law,

This ordinance repeals Ordinance numbers 110 , 189 ,
205 , 232 , 280 and Resolution Number 24 dated 9/7/74 .
This Ordinance shall become effective when passed on
its third reading and is signed by the Mayor. ,
The foregoing Ordinance No . 310 was read and passed
on its first reading by the City Council of the City of Zephyr-
hills , Florida, on the 24th day of November , 1980 .
