HomeMy WebLinkAbout314 Annexation – 6th Avenue Mobile Home Park • Clik ORDINANCE NO. 314 OO r /e 4.13 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS , FLORIDA, A MUNICIPAL CORPORATION ANNEXING A CERTAIN. PARCEL OF LAND TO THE CORP- ORATE LIMITS OF SAID CITY UPON PETITION OF OWNER OF SAID LANDS: PROVIDING FOR REDEFINING OF BOUND- ARY LINES OF SAID CITY TO INCLUDE SAID PROPERTY; PROVIDING FOR THE PUBLICATION OF SAID ORDINANCE AFTER ADOPTION WITH THE CLERK OF THE CIRCUIT COURT AND IIDEPARTMENT OF STATE. WHEREAS, Florida Statute 171. 044 does provide a procedure - whereby all owners of real property being contiguous to the corporate limits of the City of Zephyrhills may be annexed to said City upon Petition of said owner and the adoption of an ordinance annexing same, and WHEREAS, a certain owner of real property of lands contiguous " to the corporate limits of the City of Zephyrhills has by petition requested the annexation of said lands to the City of Zephyrhills , and WHEREAS, the City Council of the City of Zephyrhills has deemed it in the best interest of said City that the lands des- crived on said petition be annexed within the corporate limits of " the City of Zephyrhills. NOW, THEREFORE, BE IT ORDAINED, by the CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, as follows : 1. That the following parcels of real property be annexed to the City of Zephyrhills pursuant to petition filed by the owner of said lands as approved by the City Council of the City of Zephyrhills, said real property and owner of same being as follows : • Parcel #1 : That part of Tract 4 , lying West of the railroad right-of-way of SW 1/4 of NE 1/4 . Parcel #2 : That part of Tract 5 , lying West of the Atlantic Coast Line Railroad Right of Way and all of Tract 6 , all being in the SE 1/4 of the SE 1/4_." - - -- - -of- the NW 1/4. ----- Parcel #3 : Tract 7 , less the West 150 feet of the South 175 feet in the SE 1/4 of the NW 1/4 ; all property being in Section 12 , Township 26 South, Range 21 East of the Zephyrhills Colony. Company Lands -I as per plat thereof recorded in Plat Book 2 , page lei , ; M Public Records of Pasco County, Florida, a/k/a/ idi Sixth Avenue Mobile Home Court. It is acknowledged that the owner and the City have entered into certain covenants which shall apply to the afore-described portions and which covenants shall be binding upon the owner, its successors, heirs and assigns , to-wit: (a) Mitchell & Mitchell Enterprises, Inc. , and Ross Mitchell shall retain ownership and maintenance of- all streets and all water and sewer lines located in the mobile home park. -- (b) The annexed property shall continue to be zoned for mobile home park. (c) All lots will be charged the normal sewer impact fee. (d) Garbage dumpsters and trash bins will be required in the mobile home park. - 3 . The property shall continue to be serviced by one master water meter and all lots connected as of October 24 , 1980, shall not be assessed an impact fee, provided, however, all lots connected after the afore-referenced date shall be charged the normal municipal water impact fee. -------4. The present mobile home lots located thereon shall be grandfathered as approved lots; the front unplatted section of the property is approved for three additional mobile home lots with the remainder of that area to be left as open space. 5. All lots shall be connected to the sewer system within twelve months; the four lots presently used as drain fields located in the NE corner shall remain open space on which no mobile home shall be located. 6 . The owner shall be responsible for all expenses , including legal fees reasonably necessary to accomplish the - afore-stated purposes. 7. That it is hereby deemed to be in the best interest . of the City of Zephyrhills that the lands above described be annexed to and become a part of the City of Zephyrhills upon , 0I.1117 PG 0442 the above conditions ; that upon adoption of this Ordinance the boundary lines of the corporate limits of the City of II Zephyrhills shall be redefined so as to include the real property described above . 8 . That this Ordinance shall be published in the Zephyr- ✓ . hills News for four consecutive weeks and that proof- of the publication of this Ordinance be filed herein prior to the final' reading of this Ordinance . 9 . That upon the filing of proof of publication and' ' ' . - final adoption of this Ordinance , copy of same shall be filed with the Clerk of the Circuit Court of Pasco County, Florida, and a copy be forwarded to the Department of State , Tallahassee , Florida.
