HomeMy WebLinkAbout315 Airport Ordinance amending Ordinance 295 . 45 C.A ORDINANCE NO . 315 Q}A AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS , FLORIDA, AMENDING AND SUPPLEMENTING ORDINANCE NO. 295 ; DEFINING CERTAIN TERMS FOR THE PURPOSE OF THIS ORDINANCE ; ESTABLISHING THE AIRPORT ZONING. DISTRICT AND FIVE SUBDISTRICTS ; REQUIRING A PRE-APPLICATION DISCUSSION BETWEEN DEVELOPERS 111 OF LAND WITHIN THE AIRPORT ZONING DISTRICT AND THE CITY MANAGER; ESTABLISHING CERTAIN DEVELOPMENT REQUIREMENTS FOR THE AIRPORT ZONING DISTRICT AND SUBDISTRICTS . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS , FLORIDA, as follows : SECTION 1. This Ordinance shall amend or supplement Zoning T—I Ordinance No. 295 , ZEP.HYRHILLS CITY CODE , Appendix A - Zoning. 0) SECTION 2 . The ZEPHYRHILLS CITY CODE , Appendix A - Zoning , CO Section IV Definitions shall be amended to include the following : OD (a) AIRPORT - Zephyrhills Municipal Airport . (b) AIRPORT ELEVATION - The highest point of an airport ' s usable landing area measured in feet above mean sea level . (c) AIRPORT OBSTRUCTION - Any structure or object of natural growth or use of land which would exceed the federal ob- i/ struction standards as contained in 14 CFRss . 77 . 21 , 77 . 23 , 77 . 25 • and 77 . 28 or which obstructs the airspace required for flight of aircraft in landing and take-off at an airport or is otherwise hazardous to such landing or take-off of aircraft . (d) AIRSPACE HEIGHT - To determine the height limits in all zones set forth in this ordinance, the datum shall be mean sea level elevation (AMSL) unless otherwise specified. (e) MINIMUM DESCENT ALTITUDE - Means the lowest altitude, expressed in feet above mean sea level , to which descent is authorized on final approach or during circling-to-land maneuvering in execution of a standard instrument approach procedure where no electronic glide slope is provided. (f) MINIMUM ENROUTE ALTITUDE - The altitude in effect between radio fixes which assures acceptable navigational signal coverage and meets obstruction clearance requirements between those fixes . ec1:43 8t GO gr;- 5( =_....#_ r 1128 PG 9553 46 (g) MINIMUM OBSTRUCTION CLEARANCE ALTITUDE - The specified altitude in effect between radio fixes on VOR airways , off-airway routes , or route segments which meets obstruction clear- ance requirements for the entire route segment and which assures acceptable navigational signal coverage only within 22 miles of a VOR. (h) NON-PRECISION INSTRUMENT RUNWAY - A runway having a non-precision instrument approach procedure utilizing air navigation facilities with only horizontal guidance, or area type navigation equipment , for which a straight-in-non-precision instru- ment approach procedure has been approved or planned, and for which no precision approach facilities are planned or indicated on an FAA planning document or military service' s military airport planning document. (i) POTENTIALLY HAZARDOUS ACCIDENT AREA - An area within 5000 feet of the approach or departure end of a runway or in proximity to an airport which aircraft may maneuver after takeoff or before landing. and,_are _subject to - the greatest potential to crash into a structure or the ground. (j) RUNWAY - A defined area on an airport prepared for landing and takeoff of aircraft along its length. (k) UTILITY RUNWAY - A runway that is constructed for and intended to be used by propeller driven aircraft of 12 ,500 pounds maximum gross weight or less. (1) VISUAL RUNWAY - A runway intended solely for the operation of aircraft using visual approach procedures with no straight-in instrument approach procedure and no instrument desig- nation indicated on an FAA approved airport layout plan, or by any planning document submitted to the FAA by competent authority. SECTION 3 . The purpose of this Ordinance is to provide pro- tection for the existing and expected future operations of the Zephyrhills Municipal Airport, to provide efficient use of the Airport lands , to provide protection for adjacent land uses and the residents of Zephyrhills and surrounding areas . OA1128PG 0554 47 SECTION 4. To accomplish the purpose in SECTION 3 , the Airport Zoning District shall be established. Said District shall be composed of five Sub-Districts in compliance with the adopted AIRPORT MASTER PLAN and in conformance with the CITY of ZEPHYRHILLS COMPREHENSIVE PLAN. The five Sub-Districts are the following : (1) A - P 1 : Restricted Air Oriented Sub-District . (a) PERMITTED USES : 1 . Airport runways , taxiways , clear zones , buffer areas ;. 2 . Airport terminals and aprons ; 3 . Structures or equipment directly CO related to 1 and 2 ; and CO 4. Utilities . ict O (b) DEVELOPMENT REQUIREMENTS : Q 1. As set forth in this Ordinance for all A-P Sub-Districts . (2) A - P 2 : Air Oriented Sub-District (a) PERMITTED USES : 1 . Maintenance and support facilities for aircraft and airport activities ; 2 .. Parking areas for aircraft and other motor vehicles ; 3 . Industries requiring runway access ; 4. Planned Unit Developments , limited to uses permitted only; 5 . . Customary accessory structures or uses for airport activities ; c 6 . Parks and open space uses ; and 7 . Utilities . (b) DEVELOPMENT REQUIREMENTS : 1 . As set forth for all A-P Sub-Districts , if applicable . 2 . For industrial uses , : compliance also with requirements in Section XIII , (c) (2) , (d) , (e) • (3) A - P 3 : Light Industrial Sub-District (a) PERMITTED USES : 1 . Wholesale establishments ; 2 . Warehousing; OIL 1128 PG 0555 48 3 . Light manufacturing ; . 4. Planned Unit Developments , limited to uses permitted only; 5 . Living quarters for guards , custodians or caretakers when need is demonstrated; and 6 . Utilities . (b) DEVELOPMENT REQUIREMENTS : 1 . All requirements as applicable as forth in this Ordinance for all A-P Sub-Districts . 2 . As set forth in Section XIII , (c) (2) , (c) , (e) . (4) A - P 4 : Commercial Sub-District (a) PERMITTED USES : 1 . Motels ; 2 . Restaurants ; 3 . Retail trade establishments ; 4. Offices ; 5 . Utilities ; and 6 . Planned Unit Developments . (b) DEVELOPMENT REQUIREMENTS : _ 1 . All requirements as applicable as set forth in this Ordinance for all A-P Sub- Districts . 2 . All requirements set forth in Section XII , (c) , (d) , (e) and (f) . (5) A - P 5 : Recreation, Open Space & Agriculture Sub-District (a) PERMITTED USES : 1 . Open air, low person-intensive recrea- tional uses such as baseball or softball , tennis , golf, passive recreation, nature trails ; 2 . Utilities ; 3 . Animal grazing and hay or other forage crop production activities ; and 4. Cemeteries . (b) DEVELOPMENT REQUIREMENTS : 1. As set forth in this Ordinance for all A-P Sub-Districts . O1. 1128 PG 0556 49 SECTION 5 . The ZEPHYRHILLS. CITY . CODE, Appendix A - Zoning, Section XIV Administration shall be amended to include: 1. Pre-Application Discussion: Any developer proposing a development requiring site plan review, including but not limited to development proposals in the A - P Airport Zoning District , or his agent , shall discuss the proposed development with the Office of the City Manager prior to investment in engineering studies , lot and block layouts , surveys or tentative design. The purpose of this discussion shall be to acquaint the developer or his agent with existing conditions in the CO area of the proposed development which might affect the area under CO consideration, possible problems in extending utility services , OD existing or proposed zoning, drainage, environmental factors , re- quirements for parks , schools , roads , airport clear zones or other factors and the requirements of the adopted Comprehensive Plan of Zephyrhills , including the AIRPORT MASTER PLAN, as well as bridges , streams , ditches , power lines , railroad rights-of-way, highways , and features of historic, scenic or environmental value . This initial discussion prior to application is not intended to be binding on thepart of either party nor is it intended to reduce the responsibility of the developer for a full investigation of all the conditions which might affect his develop- ment or whereby his development might affect the surrounding area. A simple sketch plan showing the major elements of the proposal shall be submitted by the developer or his agent at the initial discussion meeting to assist with the discussion. The existing Section XIV Administration shall be amended and re-numbered reflecting the addition of Section XIV Administration, 1. Pre-Application Discussion. SECTION 6 . The following Development Requirements shall apply to all Airport Zoning Sub-Districts in Section 4 where applicable : (a) All development , except A - P 5 (a) 3 , shall be initiated by submission to the City of Zephyrhills Building Department of a site plan for review as required in the ZEPHYRHILLS CITY CODE, Section XIV (1) . No building permits shall be issued until the site plan is approved. 0.1. 1128 PG 0557 50 (b) All buffering strips , use controls and height limitations required by the Florida Statutes , by other Sections of the ZEPHYRHILLS CITY CODE , or by other Sections of this Ordinance, shall be included in the site plan. (c) All cowuiercial , industrial and recreational facilities shall provide parking and loading spaces or areas ade- quate for expected maximum number of motor vehicles . (d) Height limitations shall include the following : An area located in more than one of the des- cribed zones is considered to be , only in the zone with the more restrictive height limitation. The various zones are hereby es- tablished and defined as follows : 1 . Public Civil Airport Height Zones and Limitations A. Primary Zone - An area longitudinally centered on a runway, extending 200 feet beyond each end of that runway with the width so specified for each runway for the most precise approach existing or planned for either end of the runway. No structure or obstruction will be permitted within the primary zone, that is not part of the landing and the take-off area, and is of a greater height than the nearest point on the runway centerline. The width of the primary zone is as follows : (1) Runways 18 , 36 , 14 and 32 ; 250 feet for utility runways having only visual approaches . (2) Runway 22 ; 500 feet for visual runways having only visual approaches . (3) Runway 4; 500 feet for nonprecision instrument runways having visibility minimums greater than three-fourths statute mile . The width of the primary zone of a runway will be that width prescribed in this section for the most precise approach existing or planned for either end of that runway. O.R. 1128 PG 9558 53 No structure or obstruction will be permitted within the primary zone, that is not part of the landing and take-off facilities and is of greater height than the nearest point on the runway centerline . B . Horizontal Zone - The area around the City of Zephyrhills Airport with an outer boundary the perimeter of which is constructed by swinging arcs of specifie&radii from the center of each end of the primary zone of each airport ' s runway and connecting the adjacent arcs by lines tangent to those arcs . The radius of each arc is : CO (1) Runways 18 , 36 , 14, 32 and 22 ; CO 5 , 000 feet for all runways desig- nated as utility or visual ; O scr (2) Runway 4; 10 ,000 feet for all other runways . The radius of the arc specified for each end of a runway will have the same arithmetical value . That value will be the highest com- posite value determined for either end of the runway. When a 5 , 000-foot arc is encompassed by tangents connecting two adjacent 10 , 000-foot arcs , the 5 , 000-foot arc shall be disregarded on the construction of the perimeter of the horizontal zone . No structure or obstruction will be permitted in the horizontal zone that has a height greater than 150 feet above the airport height . C . Conical Zone - The area extending outward from the periphery of the horizontal zone for a distance of 4, 000 feet. Height limitations for structures in the conical zone are 150 feet above airport height at the inner boundary with permitted height- increasing one foot vertically for every 20 feet of horizontal distance measured outward from the inner boundary to a height of 350 feet above airport height at the outer boundary. D. Approach Zone - An area longitudinally centered on the extended runway centerline and extending outward from each end of the primary surface . An approach zone is desig- nated for each runway based upon the type of approach available or planned for that runway end. 011128" X559 54 (1) The inner edge of the approach zone is the same width as the primary zone and it expands uniformly to a width of: (i) Runways 18 , 36 , 14, and 32 ; 1 , 250 feet for that end of a utility runway with only visual approaches ; (ii) Runway 22 ; 1 ,500 feet for that end of a runway other than a utility runway with only visual approaches ; (iii) Runway 4; 3 ,500 feet for that end of a non-precision instrument runway other than utility, having visi- bility minimums greater than three-fourths of a statute mile; (2) The approach surface extends for a horizontal distance of: (i) Runways 18 , 36 , 14, 32 , and 22 ; 5 ,000 feet for all utility and visual runways ; (ii) Runway 4; 10 ,000 feet for all nonprecision instrument runways other than utility. (3) The outer width of an approach zone to an end of a runway will be that width prescribed in this subsec- tion for. the most precise approach existing or planned for that runway end. (4) Permitted height limitation within the approach zones is the same as the runway end height at the inner edge and increases with horizontal distance outward from the inner edge as follows : (i) Runways 18 , 36 , 14, 32 , and 22 ; Permitted height increases one foot vertically for every 20 feet horizontal distance for all utility and visual runways . (ii) Runway 4; Permitted height increases one foot vertically for every 34 feet horizontal distance for all non- precision instrument runways other than utility. 0.11128 PG 9560 55 E. Transitional Zone - The area extending outward from the sidesof the primary zones and approach zones con- necting them to the horizontal zone. Height limits within the transitional zone are the same as the primary zone or approachzone at the boundary line where it adjoins and increases at -a\rate of one foot vertically for every seven feet horizontally=, with the horizontal distance measured at right angles to the runway cen-terline and extended centerline, until the height matches the .height of 't he horizontal zone or conical zone or for a horizontal dist nce'o.f, 5000 feet from the side of the part of the precision approach zone that 0/ extends beyond the conical zone. CO F. Other areas - In addition to the height OD limitations imposed in paragraphs A through E above, no= structure-)or-.. obstruction will be permitted within the City of Zephyrlills that would cause a minimum obstruction clearance altitude,.: a minimum: ,; descent altitude or a decision height to be raised, - G. Airport Master Plan - The Airport.., ` Master Plan Figure 7 - 2 , Sheet 3 of 8 and Figure 7 - 3 , Sheet 4 of 8 shall be incorporated into this Ordinance as a diagrammatic expla- nation of (d) Height Limitations . SECTION 7 . The ZEPHYRHILLS CITY CODE,Appendix A - Zoning, Section III General Provisions (6) Building height shall be amended by adding the following : Compliance with all requirements set forth in the A - P Airport Zoning District and in other applicable local and state law with regard to heights in the vicinity of airports shall be a part of all review of proposed building heights prior to issuance of building permits .
