�i, 3 ` 9' i Q.> ORDINANCE NO . 320 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS GOVERN- ING CITY LICENSES AND LICENSE TAXES ; REGULATING LICENSE REQUIREMENTS ; SPECIFYING TERM OF 111 LICENSURE AND TRANSFER OF SAME ; PROHIBITING III PRORATED FEES ; GOVERNING DISPLAY OF LICENSE ; BONDING REQUIREMENTS ; PROVIDING FOR REVOCATION OF LICENSE; PROVIDING FOR EXEMPTIONS ; PROVIDING PENALTIES FOR DELINQUENCY AND/OR FAILURE TO OBTAIN PROPER LICENSE PROVIDING A SCHEDULE OF LICENSE TAX AMOUNTS ; REQUIRING REGISTRATION OF THOSE LICENSED ELSEWHERE BUT OPERATING WITHIN THE CITY LIMITS ; REQUIRING ADHERENCE TO BUILDING AND ZONING REQUIREMENTS; REPEAL OF ALL ORDINANCES INCONSISTENT WITH THESE PROVISIONS. Z.41 No person shall engage in or manage within the City ' pe+ a profession, business or occupation unless a city licen ' s c") r\,) shall be procured from the city manager for each such prcg.---- > c3 fession, business or occupation so engaged in, which license shall be issued to each person on receipt of the amount stated in the license schedule , and the same shall be signed by the City manager, and have the seal of the City affixed. Those persons required to procure a City license are as follows , to-wit : k. (a) Any person who maintains a permanent business location or branch office within the City for the privilege of engaging in or managing any business within city jurisdiction; and (b) ' Any person who maintains a permanent business location or branch office within the city for the privileges of engaging in or managing any RECORD VERIFIED profession or occupation within city jurisdiction; JED PITTMAN s Ier' ircuit court, PErSCO C ad.57 ` and s1f.p,. OA c Any person who does not qualify under the provision of subsections (a) and (b) above and who transacts any interestate commerce where such license tax is not prohibited by Section 8 Article 1 of the United States III Constitution. 2 . Term of License ; Transfer of Same . All license taxes imposed, shall. be due and payable on the first day of October of each year shall expire on the thirtieth day of September of the succeeding year. Upon written request and pre- sentation of the original license , any license may be transferred from one location to another location within the City upon payment of a transfer fee of three dollars ($3 . 00) . 3 . Part year licenses . Licenses will not be prorated. 4 . When Certificate Required. No license shall be issued to any person otherwise required by ordinance of the City or by state law to have a certificate of competency or to have passed an examination before engaging in a business or profession in the City, until such person shall have exhibited to the City Manager proof of having a __ - valid certificate or of having passed said examination. 5 . Display of License . Every person required to have a city license shall at all times from the issuance of said license by the City con- spicuously display said license in his place of business , and where the licensee does not have a place of business , he shall be prepared at all times while engaged: in his occupation to present his license for inspection by any official of the city when requested to do so . 6 . Circuses , carnivals and tent shows-Permit and Bond Required. It shall be unlawful for any person to set upon or operate any circus , carnivals , tent or attraction, or any amusement with temporary structure or tent within the corporate limits of the City until a permit has been issued by said City, and the sum of Two Hundred Fifty Dollars O�i.1150 PG 0117 5 ($250 . 00) shall have been deposited with the City Manager to insure the City against loss in cleaning the premises to be occupied and used by said entertainment . Before any permit shall be issued, the applicant shall IIIfirst present bona fide evidence of financial responsibility and insurance coverage acceptable to the City and compliance with the laws of the state . The said deposit shall be credited by the City Manager to the sanitary department of the City and so much of said deposit as shall be necessary to defray the expenses of cleaning said premises shall be retained by COCO the City and the balance thereof, if any, shall be returned to c the person depositing same . If the person shall clean said 00 Q premises in a manner satisfactory to the City, the manner of cleaning and the result thereof to be determined by said City, the entire deposit shall be returned by the City Manager. 7 . Revocation .of License . The right to revoke any license issued under the provisions of this chapter for cause is reserved to the City and said revocation shall be made at the direction of the City Council . 8 . Exemption from Provisions . The provisions of this chapter shall not apply to the sale of farm products or dairy products grown or raised by the seller. The provisions of this chapter shall further not apply to any vehicles used by any person licensed under this chapter for the sale and delivery of tangible personal property on which a license is paid. Such vehicles shall not be con- ; strued to be separate places of business , and no licensemay be levied on such vehicles or the operators thereof as salesmen or otherwise . 9 . Delinquent License Taxes ; Failure to Obtain License . All licenses shall be sold by the City Manager beginning September each year and shall be due and payable on October 1 of each year and shall expire on September 30 of the succeeding OIL 1150PG 0118 V' r, year . Licenses not renewed by October 1 shall be considered delinquent and subject to a delinquency penalty of ten percent (10%) for the month of October plus an additional five per cent (5%) penalty for each month of delinquency thereof until paid; provided, however, that the total delinquency penalty shall not exceed twenty-five percent (25%) of the occupational license fee . Any person engaging in or managing any business , occupa- tion or profession within the City without first obtaining a City occupational license , if required hereunder , shall be subject to a penalty of twenty-five percent (25%) of the license determined to be due , in addition to any other penalty provided by law or ordinance . It shall be the duty of the City Manager to make an affidavit for the arrest of any person failing or refusing to obtain and p--rocure ,any occupational license required hereunder 11/ and to cause the said person to be brought before Court of applicable jurisdiction for trial . - 10 . Dates and penalties will correspond with those of occupational licenses . Annual charge. will be $10 _00 -per registrat, on . - 12 . Adherence to Building and Zoning Requirements . All business applying for a City Occupational .License must be housed in a building that meets current Building Codes and in an area properly zoned for such activity. 13. Repeal of Inconsistent Ordinances and State Imposed Requirements . All ordinance provisions inconsistent with this or- dinance are hereby repealed. Any State imposed prerequisite for occupational licenses and any overriding exemptions from occupational licenses imposed by the State shall be a tt. adhered to. . 14 . EFFECTIVE DATE . . This ordinance shall become effective upon its third reading and signature by the Mayor..
