ORDINANCE NO. 02 y j 9-
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ZEPHYRHILLS, FLORIDA, AMENDING ORDINANCE
NO. 153, PERMITTING VOTING BY THE USE OF VOT-
ING MACHINES; PROHIBITING THE SOLICITATION
OF POLITICAL LITERATURE WITHIN 300 FEET OF THE
VOTING PLACE; PROVIDING FOR THEfAPPEAL OF SEC-
TION III, SECTION V, SECTION VI AND SECTION VII
(b) OF ORDINANCE NO. 153; AND PROVIDING FOR THE
ADOPTION OF CHAPTER 101 , FLORIDA STATUTES 1973;
AND PROVIDING FOR THE SUBSTITUTION OF THE WORD
CITY MANAGER OR CITY CLERK IN THE PLACE OF THE
WORD SUPERVISOR IN SAID STATUTE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA, as follows :
SECTION .1 : Repeal of portions of Ordinance No. 153.
Section III, Section V, Section VI and Section
VII (b) of Ordinance No. 153, and the same are,
hereby, now repealed.
SECTION 2 : Qualification of Voters.
Every person over eighteen (18) years of age,
who has complied with the permanent single .reg-
istration system under the laws of the State of
Florida, is a qualified elector of the City of
Zephyrhills, and is entitled to vote in all City
elections.
SECTION 3 : Voting. Amending Section VII of Ordinance
No. 153. Sections (a) and (b) of Section VII. of Ordinance #153
are amended to read as follows :
(a) Voting in all elections in the city shall be
by the ballot, on either written or printed
forms to be made and provided, setting forth
the names of the candidates who have qual-
ified, or such other questions as may be
presented to the voters, or such voting may
be by the use of voting machines.
(b) Absentee Voting. The City does, hereby,
adopt by reference, all provisions of
Chapter 101 of the Florida Statutes of 1973,
as same pertains to absentee voting. That
wherever in the absentee voting law wherein
the word "supervisor" is used, the word
City Manager or City Clerk shall be substi-
tuted therefore.
SECTION 4: Amending Section X of Ordinance No. 153.
Section X of Ordinance No. 153 is amended to read as follows :
Prohibition Against Soliciting Votes and Passing of
Literature.
It shall be unlawful for any person on any election
day held in the city, to solicit votes or pass out
literature or pamphlets on behalf of any candidate
for city, county or state office within three hun-
dred (300) feet of any voting place, This is deemed
to be a matter of public policy for the reason that
such is considered to be a nuisance and not for the
best interest of the public; and the literature
and pamphlets has created a problem of excess rub-
bish and litter. Anyone found guilty of violating
this section of this ordinance, upon conviction,
shall be fined by a fine not to exceed $25.00 or
imprisonment in the City Jail for not more than
5 days, or both.
SECTION 5 : All other sections of Ordinance No. 153,
not herein amended or appealed shall remain in full force and
effect.
The foregoing Ordinance No. 02'45' was read and passed
on its first reading by the City Council of the City of Zephyr-
hills, Florida, on the 2 day of �d rv®ry , 1975.
