HomeMy WebLinkAbout261 Provisions Appointing City Manager ORDINANCE NO. 261 "612-� � I'�� AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ( �.i>;� ZEPHYRHILLS, FLORIDA, PROVIDING THAT CITY MANAGER SHALL BE APPOINTED SOLELY ON THE BASIS OF EXECUTIVE AND ADMINISTRATIVE QUALIFICATIONS; PROVIDING FOR THE PROCEDURE TO BE FOLLOWED FOR REMOVAL OF CITY MANAGER; PROVIDING THAT CITY MANAGER SHALL BE CHIEF ADMINISTRATIVE OFFICER OF THE CITY AND SETTING FORTH ,HIS AUTHORITY AND DUTIES; GRANTING CITY MANAGER THE AUTHORITY TO APPOINT OR SUSPEND ALL CITY EMPLOYEES AND APPOINTED ADMINISTRATIVE OFFICERS WITH CERTAIN EXCEPTIONS; PROVIDING THAT CITY MANAGER SHALL BE HEAD OF CERTAIN DEPARTMENTS OF THE CITY.AND BE RESPONSIBLE FOR THE ACTIVITIES OF SAID DEPARTMENTS; PROVIDING THAT CITY MANAGER SHALL MANAGE AND CONTROL ALL CITY OWNED PUBLIC UTILITIES; AND PROVIDING FOR A REFERENDUM. WHEREAS, the Legislature of the State of Florida has enacted legislation requiring the change in the Municipal Charter of the City of Zephyrhills, as the same pertains to elections, and WHEREAS, it is required that an Ordinance be adopted incorporating said amendments to the City Charter, and WHEREAS, pursuant to Florida Statutes all such amendments are subject to referendum by City Electors, and WHEREAS, regular City Elections are set for April 6, 1976,, and if said suggested amendments can be included on the ballot of the April 6, 1976, election the expense of a special election can be avoided. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA, as follows :.. SECTION 1 : That the Zephyrhills City Charter be and the same is, hereby, now amended by adding the following sections : (1 ) SECTION 21 . 13 : That the City Council shall fix . compensation for city manager. The manager shall be appointed solely on the basis of his executive and administrative qualifications. • He need not be a resident of the city or the state at the time of his appointment, butmay reside outside the city while in office only with the approval of the council. S . ' (2) SECTION 21 . 14: The Council may remove the manager from office in accordance with the following pro- cedures : (a) The council shall adopt by affirmative vote of a majority of all its members a preliminary resolution which must state the reasons for re- moval and may suspend the manager from duty for a period of not to exceed forty-five (45) days . A copy of the resolution shall be delivered promptly to the manager. (b) Within five (5) days after a copy of the resolution is delivered to the manager, he may file with the council a written request for a public hearing. This hearing shall be held at a council meeting not earlier than fifteen (15) days after the request is filed. The manager may file with the council a written reply not later than five (5) days before the hearing. (c) Thecouncil may adopt a final resolution of removal, which maybe made effective immediately, byaffirmativevote of a majority of all its members at any time after five (5.) days from the date when a copy of the preliminary resolution was delivered to the manager, if he has not requested a public hearing, or at any time after -the public hearing, if he has requested one. The ,manager shall continue to receive his salary until the effective date of a final resolution . (3) SECTION 21 . 15 : The city manager shall be the chief administrative officer of the city. He shall be responsible to the council for the administration of all city affairs placed in his charge by or under this charter. He shall have the following powers and duties : (a) He shall appoint and when he deems it nec- essary for the good of the city,- suspend or re- move all city employees andappointed adminis- trative officers provided for, by or -under this charter, such suspension or removal to be in accordance with the provisions of the City of Zephyrhills employee 's handbook in force at the time of such suspension or removal. That such right of suspension or removal shall not include those city officials or departmentheads of the city as designated by ordinance of the City Council. He may authorize any administrative officer who is subject to his direction and supervision to exercise these powers with respect to subordinants in that officer's department or agency. (b) He shall direct and supervise the adminis- tration of all departments., offices and agencies of the city, except the offices of the city attorney, city auditor, police department and fire department.
