Owner agrees to pay Contractor for the described work the total sum of all costs associated with the construction of this residence of$149,350. Contractor shall deliver to the Owner at the time of final payment a complete release of all liens rising out of the contract herein covering all labor,materials and equipment for which a lien could be filed. 5. Work under this contract shall begin within five (5) days receipt of building permit and recordation and posting of Notice of Commencement by Owner, as required by Fla. Stats. L Sec 713.13. 6. Contractor's duties and rights are as follows: a. Contractor shall be solely responsible for all construction under this contract, including the techniques, sequences, procedures, means, and coordination of all work. He shall supervise and direct the work to the best of his ability, giving all attention necessary for such proper supervision and direction. b. Contractor shall provide and pay for all labor, materials, and equipment, including tools, construction equipment, and machinery, utilities, and all other facilities and services necessary for the proper completion of the work of the project in accordance with Contract Documents. c. Contractor shall secure all licenses and permits necessary for the proper completion of the work,paying the fees therefore. d. Contractor shall comply with all laws and ordinances,as well as all rules,regulations or orders of public authorities relating to the performance of work. If anything set forth in any of the Contract Documents or specifications is at variance therewith, Contractor shall notify Owner promptly upon discovery of such variance. If conformity or correction of such variance results in any out-of-pocket expense to Contractor to complete the work, such expense shall be paid to Contractor plus fee as set forth in Section 2. e. Contractor shall be fully responsible for all acts or omissions of his employees on the project, his sub-contractors and their employees, and other persons doing work on the residence under any contract with him. f. Contractor agrees to keep in force at his own expense during the period of construction on the project such liability insurance as will protect him from claims, under workmen's compensation and other employee benefit laws, for bodily injury and death and for property damage that may arise out of work under this contract, whether directly or indirectly by the Contractor or directly or indirectly by a sub- contractor. The minimum liability limits of such insurance shall not be less than $500,000.00 covering bodily injury or death and not less than$300,000.00 covering property damage. Proof of such insurance shall be filed by Contractor with Owner within a reasonable time after execution of this contract. Contractor shall also be responsible for insuring that all sub-contractors have all appropriate workman's compensation and liability coverages. 7. The Contractor shall deliver a Certificate of Completion, Certificate of Occupancy, if applicable, and_final contractor's affidavit to the Owner and the Owner shall, within ten (10)days after receipt thereof,make final payment to the Contractor. 8. Contractor may,on five(5)days written notice to Owner,terminate this contract before the termination date hereof when for a period of ten(10) days after a progress payment is due or a payment is due as a result of a change order,through no fault of the Contractor, Owner fails to make payment. If Owner makes the progress payment during the five days following receipt of written notice, then such payment is deemed to cure any potential non-payment default. 9: If Contractor defaults in any provisions herein or fails to carry out the construction in accordance with the Contract Documents, Owner shall provide Contractor with written notice of the specific act or acts constituting such default. If Contractor fails to commence to correct such default within ton 10 days from receipt of such notice, Owner may terminate this contract before the termination date hcrcof.On such termination Owner may take possession of the work site and all material thereon and finish the work in whatever manner he deems expedient. 10. This agreement is binding on the parties hereto, their respective personal representatives, heirs,successors and assigns. 11. The Contractor is not responsible for any delays as a result of any act of God,material or labor shortages, as a result of transportation difficulties, delay in architectural or interior design plans, delay in finish selections or permitting pTrocessing.
