Pasco County Clerk & Comptroller ORDINANCE NO.: 1385-19 ij/ AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA APPROVING THE 5622 AND 5630 11TH STREET PLANNED UNIT DEVELOPMENT ("PUD") IN ACCORDANCE WITH THE PROVISIONS OF SECTION 166.041, FLORIDA STATUTES; PROVIDING FOR CODIFICATION, CONFLICT SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the property located at 5622 and 5630 11th Street, Zephyrhills, FL was originally developed as a 3,000 SF house of worship and last used as such over 30 years ago; and WHEREAS,the applicant/owner, Kathleen Reed, seeks to revitalize and reuse a building constructed in 1933 that has outlived its original intended use (first, as a house of worship, then later as a large residence)by redeveloping it into four(4) apartments, each approximately 750 sf; and WHEREAS,the proposed redevelopment is consistent with the designated future land use of residential urban (RU) and is under the maximum density allowed by the RU future land use classification; and WHEREAS,the current zoning would require the 3,000-sf structure to be utilized only as a house of worship or a single-family dwelling; and WHEREAS,the size of the structure is significantly larger than any single-family dwelling in the neighborhood where the property is located; and WHEREAS, a request for compliance determination with the terms of Sec. 6.04.01 C (6) modification to minimum site size from one (1) acre to .38 acre is requested on the basis that the proposal is an adaptive reuse project in the central core of the city where one(1) acre parcels are the exception rather than the rule; and WHEREAS, the proposed site plan, devised upon the presumption that the proposed zoning designation of PD will be approved, was presented and approved at the Site Plan Review Committee meeting held on June 18th, 2019; and WHEREAS, the proposed zoning change to Planned Unit Development ("PUD") was reviewed by the Planning Commission on July 16, 2019. The Planning Commission recommends approval; and WHEREAS, the City Council, as the governing body of the City of Zephyrhills, Florida, pursuant to the authority in Chapter 163 and Chapter 166, Florida Statutes, and the City's Land Development Code, is authorized and empowered to consider petitions related to zoning and land development orders; and WHEREAS,the City Council has considered the evidence and testimony presented by the Applicant and other interested parties and the recommendations of the various City of Zephyrhills review agencies, commissions,boards, and staff; and WHEREAS, the City Council deems approval of this Ordinance to be in the best interest of the health, safety, and welfare of the residents and citizens of the City of Zephyrhills, and the public at large. NOW THEREFORE BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL OF ZEPHYRHILLS,FLORIDA AS FOLLOWS: Section 1: The above Whereas clauses are hereby adopted and incorporated herein. Pasco County Clerk & Comptroller development within the City, and that the following described lands, lying and being situated in Pasco County,to wit: SEE LEGAL DESCRIPTION ATTACHED HERETO AND INCORPORATED BY REFERENCE AS EXHIBIT "A". PARCEL I.D.NOS.: 11-26-21-0010-08500-0110 and 11-26-21-0010-08500-0130. CONTAINS APPROXIMATELY 0.38 ACRES M.O.L. are hereby rezoned to Planned Unit Development("PUD"), subject to the following conditions: 1. Development shall be in accordance with the application, plans and information submitted by the Applicant unless otherwise stipulated or modified herein. 2. The property located at 5622 and 5630 11th Street, Zephyrhills, FL is hereby rezoned from R-2 to Planned Unit Development("PUD"). 3. That the parcel located at 5622 11th Street,Zephyrhills,FL 33542 is hereby rezoned to PUD subject to the structure being reconfigured into four(4) 750 SF apartments contingent on complete submission of plans as directed by paragraph 1. above. 4. That the parcel located at 5630 11`x' Street, Zephyrhills, FL 33542 hereby rezoned to PUD contingent on complete submission of plans as directed by paragraph 1. above. 5. Construction plans shall provide full details concerning the development of the interior and exterior of the two parcels subject to this ordinance. 6. The property shall be constructed in accordance with the site plan attached hereto as Exhibit"A"and by reference made apart hereof. Section 3: This ordinance shall supersede all ordinances or parts of ordinances in conflict herewith. Section 4: That if any section,sentence,clause or phrase of this ordinance is held to be invalid of unconstitutional by a court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. Section 5: This Ordinance shall become effective upon passage on the second reading and signing by the Mayor.
