A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ZEPHYRHLLLS,FLORIDA VACATION OF RIGHT-OF-WAY FOR CBD
REAL ESTATE,LLC. •
WHEREAS,pursuant to Section 7.03.02.03 of-the City of Zephyrhills Land Development Code, •
Vacation of Right-of-Ways,

t'- WHEREAS, the City Council finds that the requested vacation is consistent with the Traffic
Circulation Element of the City of Zephyrhills Comprehensive Plan;
WHEREAS,the City Council finds that the right-of-way does not provide the sole access to any
prePerty;
WHEREAS, the City Council finds that vacation would not jeopardize the current or future
location of any utility;
WHEREAS,the City Council finds that the vacation is not detrimental to the public interest,and
provides a positive benefit to the City of Zephyrhills.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS,FLORIDA:
Section 1. That the City Council of the City of Zephyrhills hereby vacates the
following Right-of-Way:
LEGAL DESCRIPTION:
• A 15 foot wide strip of land being a portion of the North 15 feet of the Southeast 1/4
of the Southwest 1/4 of Section 4, Township 126 South; Range 21 East, Pasco County,
Florida, being more particularly described as follows:
COMMENCE at the Northwest corner of the Southeast 1/4 of the Southwest 1/4 of
Section 4. Township 26 South, Range 21 East, PascoCounty, Florida, some being an
• East corner of Tract A. according to the plot of SILVERADO PHASE 1A, as recorded in
Plat Book 61, Page 71, of the Public Records of Pasco County, Florida; thence
N89'47'56"E, along the North line of said Southeast 1/4 of the Southwest 1/4 of
Section 4, same being the East line of said Tract 'A". for 15.01 feet to an East corner
of said Tract A, some being the POINT OF BEGINNING; thence leaving said East line of
Tract 'A", continue N89'4756'1, along said North line of the Southeast 1/4 of the -
Southwest 1/4 of Section 4, same being the North line of a 15 foot, unnamed
Right—of—Way, according to the plat of ZEPHYRHILLS COLONY COMPANY, as recorded in •
Plat Book 1, Page 55, of the Public Records of Pasco County, Florida, for 1,325.53 feet
thence leaving said North line of the Southeast 1/4 of the Southwest 1/4 of Section 4,
some being said North line of a 15 foot, unnamed Right—of—Way, S0219'21"W, for 15.01
feet to the point of Intersection with the South line of said 15 foot. unnamed
Right—of—Way, same being a point on the West Right—of—Way line of DEAN DAIRY ROAD, •
same also being the Northeast corner of Tract 101, both according to said plat of
ZEPHYRHILLS COLONY COMPANY; thence leaving said West Right—of—Way line of DEAN
DAIRY ROAD. S89'47'56"W, along said South line of a 15 foot. unnamed Right—of—Way,
the North line of said Tract 101 and the North line of Tract 102, according to said plat
of ZEPHYRHILLS COLONY COMPANY, respectively, for 11,325.41 feet to the Northwest

Section 2. That is Resolution shall take effect immediately upon its adoption.
