ORDINANCE NO. 1412-21
AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA,
APPROVING A ZONING PUD (PLANNED UNIT DEVELOPMENT)
MASTER PLAN AMENDMENT FOR TROTTER'S CROSSING; FOR
PARCEL 27-25-21-0010-00300-0000 AND A PORTION OF 27-25-21-0030-
04900-0000 PROVIDING FOR CODIFICATION, SEVERABILITY, AND
AN EFFECTIVE DATE.
WHEREAS, the City Council has been given authority by the State of Florida pursuant
to Chapter 163 and 166, Florida Statutes, to rezone property within the City Limits upon receipt
of written consent of the land owner, together with the approval of the City Council of said
rezoning duly expressed by Ordinance; and
WHEREAS, due public notice of hearing on the proposed rezoning was given by the
City Council, as required by the Zephyrhills Land Development Code, as amended, and Chapters
163 and 166, Florida Statutes; and
WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold a
public on December 15, 2020 hearing to consider said proposed PUD zoning amendment and has
recommended approval; and
WHEREAS, the City Council has determined that the PUD (PLANNED UNIT
DEVELOPMENT) zoning amendment would be appropriate, would promote the general
welfare, and would encourage proper development within the City; and
NOW, THEREFORE, BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL
OF ZEPHYRHILLS, FLORIDA, AS FOLLOWS:
SECTION 1: The above Whereas clauses are hereby adopted and incorporated herein.
SECTION 2: The following described lands, lying and being situated in Pasco County, to wit:

the zoning designation is hereby rezoned to City PUD (Planned Unit Development).
The following Zoning conditions shall apply:
l.) Development shall comply with the PUD final master plan and landscape plan with
conditions signed and sealed on 9/20/2019;
2.) The property owner / applicant shall be required to prepare / record a conservation
easement (as depicted on the master plan — Tract OS -1) and provide the City Planning
Department with the recording;
3.) City water and sewer shall be provided to the subject property;
4.) A FDOT ROW and Utility permit shall be required to be obtained for improvements
completed in the FDOT ROW and provide a copy of issued permits to the City Planning
Department;
5.) Developer / Builder shall minimize lot grading and utilize the existing topography to the
greatest extent possible to conserve the existing topography to the greatest extent possible

to conserve the existing topography / hill;
6.) Finished lot grading plan for each lot to be reviewed / approved by City Planning
Department to ensure that there is no extensive cut / fill outside of the house pad prior to
issuance of individual home building permits;
7.) Home builders shall provide staggered front yard setbacks, not less than two feet on
adjacent lots and shall be allowed to reduce the rear yard setback a distance equal to the
additional front setback;
8.) Monotony Control — houses shall be required to have sufficient differences in both front
elevation and color schemes, and includes the following situations being subject to the
monotony code:
2. 1 Two houses on each side of a proposed home that all face the same street.
2.2 The houses directly across the street from the proposed home.
2. 3 One house on each side of the house directly across the street from the proposed
home.
9.) Roofing shingles shall be dimensional type shingles, commonly referred to as architectural
shingles;
10.) Street Trees and two trees per lot shall be provided;
11.) Decorative underground lighting to be provided; and
12.) PVC Fencing to be provided along the Kovac's property.
SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to
the extent of such conflict.
SECTION 4: That if any section, sentence, clause, or phrase of this ordinance is held to be
invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no way
affect the validity of the remaining portions of this ordinance.
SECTION 5: This'Ordinance shall become effective upon passage on the second reading and
signing by the Mayor.
