Pasco County Clerk&Comptroller I ORDINANCE NO.1415-21 AN ORDINANCE OF THE CITY OF EPHYRHILLS, FLORIDA, AMENDING SECTION 154.02, SUBSECTIONS (C)AND (D),OF THE CITY OF ZEPHYRHILLS CODE OF ORDINANCES;AND SECTION 10.02.05.02 10.02.05.03 OF THE CITY OF ZEPHYRHILLS LAND D VELOPMENT CODE, REGULATING BOARD MEMBERSHIP AND QUALIFICATIONS; PROVIDING FOR REPEALER, i CODIFICATION AND AN EFFECTIVE DATE. WHEREAS,the City Council has determined that it is in the City's best interest to update the Land Development Code from time to time to assure tha the Land Development Code adequately meets the needs of the City. WHEREAS, the City Council wishes to update th , organization of the Historic Preservation Board to update the qualification process and providfor alternate members. WHEREAS,the Historic Preservation Board did hold public meeting on the 25th day of February,2021 to consider the proposed text amendment and has recommended approval. WHEREAS,the Planning Commission, sitting as the cal Planning Agency, did hold public hearing on the 16th day of March,2021 to consider the pr posed text amendment and has recommended approval. NOW, THEREFORE, BE IT ORDAINED by the City Cou cil of the City of Zephyrhills, Florida,as follows: SECTION 1: §154.02,Subsection(C)of the City of Zephyrhills ode of Ordinances and Section I 10.02.05.02 of the City of Zephyrhills Land Development Code are amended as follows: i; : `-- Board Membership:The Board shall consist of five(5)members and(2)alternates.Each City Council members shall have the authority to appcint one member of his or her choosing to the Board.Members shall serve without comp sation,but shall be reimbursed for actual expenses.In addition,the City Council may appoint a first and second alternate member to the Historic Preservation Board. Such altemates may participate in all authorized function of the Historic Preservation Board;provided,however,such alternates shall have no vote in the administrative or quasi-judicial determinations of the Historic Preservation Board,except in the temporary absence or disability of a regular member or members,or when such regular member or members shall be disqualified from voting in any particular case or cases. • SECTION 2:§154.02,Subsection(D)of the City of Zephyrhills¶ode of Ordinances and Section 10.02.05.03 of the City of Zephyrhills Land Development Code are hereby amended as follows: Qualifications:The Board shall consist of a majority of ci:y residents and persons owning a business registered in the city who shall have knowledge of historical or architectural development within the city or have a deep concern for preservation,development, and enhancement of the historical resources of the city. To the extent available in the community,the City Council shall appoint professional members from the disciplines of r architecture, history, archaeology, real estate, building construction or other historic ` preservation related disciplines. Lay persons who have demonstrated special interest, experience or knowledge in history,architecture or relat disciplines shall make up the balance of the Board. SECTION 3:§154.02,Subsection(E)of the City of Zephyrhills ode of Ordinances and Section 10.02.05.04 of the City of Zephyrhills Land Development Codea hereby amended as follows: Terms of Office: Members shall serve three-year terms In order to achieve staggered terms,initial appointments shall be: two members for two years;and three members for three years.Members may be re-appointed on the expiration of their term.Members shall -1- OR BK.1 0347 PG 346 Page 2 of 2 continue in office until the appointment of a successor.M bers appointed to fill a vacancy shall serve the remainder of the unexpired term.Initially,one alternate shall be appointed by City Council for two years and one alternate shall b appointed for three years.The Historic Preservation Board alternates shall be appointed rior to the annual installment in June at the beginning of the term. SECTION 4:Repealer Any ordinance or part of any ordinance in conflict herewith is hereby repealed to the extent of any conflict. SECTION 5:Severability If is declared to be the intent of the City Council of the City of Zephyrhills,Florida,that if any section,subsection,sentence,clause,or provision of this Ordinance shall be declared invalid,the remainder of this Ordinance shall not be construed as not Having contained said section, subsection,sentence,clause,or provision and shall not be affected by such holding. SECTION 5:Inclusion in Code The provisions of this Ordinance shall become and be made p of the Code of Ordinances and Land Development Code of the City of Zephyrhills,Florida.The sections of this Ordinance may be renumbered or re-lettered and the word"ordinance"may be changed to"section,""article,"or such other appropriate word or phrase in order to accomplish such. SECTION 6: Effective Date This Ordinance shall become effective upon passage on the second reading and signing by the Mayor. The foregoing Ordinance No. 1415-21 was read and passed on the first reading in an open and regular meeting of the City Council of the City of Zephyrhills,Florida,on this 26th day of April, ^s.......
