HomeMy WebLinkAbout787-21 Hounds Town USA Conditional UseINSTR# 2022005790 OR BK 10521 PG 245 Page 1 of 2 01/10/2022 07:47 AM Rcpt: 2398816 Rec: 18.50 DS: 0.00 IT: 0.00 Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller RESOLUTION NO. 787-21 A RESOLUTION RELATED TO PET CARE SERVICES (INDOOR/OUTDOOR); APPROVING A CONDITIONAL USE TO ALLOW FOR THE UPDATE OF THE DEFINITION IN TABLE 2.02.01 OF THE CITY OF ZEPHYRHILLS LAND DEVELOPMENT CODE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, an application was filed by DCLD Enterprises for a conditional use to allow for overnight inside boarding of dogs in a C2 (Community Commercial) zoning district located on parcel ID no. 03-26-21-0020-00000-0022; and WHEREAS, the subject property zoning is C2 (Community Commercial) which allows for pet care services (indoor/outdoor) as a conditional use with a level three review; and WHEREAS, the City of Zephyrhills Land Development Code, Part 11.10.01(B) has standards that the City Council may or may not grant approval for the conditional use as follows: 1. The proposed conditional use will not adversely affect or contribute to the deterioration of quality of life or property values in the immediate neighborhood; and 2. The proposed conditional use is consistent with the character of and existing land use patterns in the surrounding area; and The proposed conditional use will not create or excessively increase traffic or parking congestion or otherwise affect public safety; 4. The site upon which the proposed conditional use is to be located has suitable drainage, access, ingress and egress, off-street parking and loading areas; 5. The site upon which the conditional use is to be located has or may have screening or buffering to prevent interference with the enjoyment of surrounding areas; 6. The proposed site meets the applicable requirements of the zoning district in which it is located; 7. Any existing or proposed signs or lighting will not adversely affect surrounding areas or vehicular traffic; and 8. The proposed conditional use will not interfere with or adversely affect the health, safety or welfare of the surrounding community area. WHEREAS, the application for a conditional use to allow overnight inside boarding of dogs has been found to be in compliance with the requirements of Part 11.10.02 of the City of Zephyrhills Land Development Code; and WHEREAS, the granting of a conditional use shall be subject to the following: The holder of a conditional use permit shall be authorized to utilize the site or location of the use only in a manner specified in the written approval and conditions specified therein. Any substantial expansion, alteration or change in the conditional use authorized by the written approval must be reviewed by City Council in the same manner in which the original conditional use was reviewed. The Building Official or his or her designee shall determine whether a substantial alteration or change of an authorized conditional use exists and may initiate review of the same by the City Council; and 2. For purpose of this section, an expansion, alteration or change of a conditional use shall be deemed to exist where a substantial modification of any of the standards provided for in subsection (1) above, results from activity associated with the conditional use or where a substantial change of circumstances or conditions arise. - 1 - OR BK 10521 PG 246 Page 2 & 2 3. A secure outside play area for the dogs will be required with opaque fencing/walls that prevent the dogs from leaving the property. 4. A building permit will need to be applied for the installation of an opaque perimeter fence that meets the current City building code. 5. The existing landscaping will be updated to meet the current Type A landscaping code required by the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA: Section 1. The foregoing findings are incorporated herein by reference and made a part thereof. Section 2. The application for overnight inside boarding of dogs in a C2 zoning district, on property with parcel ID no. 03-26-21-0020-00000-0022 is hereby approved. Section 3. The conditional use is approved for the benefit of the applicant and applicant's successors and/or assigns and for the use as specified within the application only, subject to the conditions herein. The character or benefit of this conditional use shall not change but may be transferred without City Council approval by resolution. Section 4. The City Council does hereby expressly find that the provisions of this resolution are in conformity with the Comprehensive Plan of the City of Zephyrhills, as amended. This Resolution No. 787-21 shall run with the subject property and shall inure to the benefit of and be binding upon DCL15 Enterprises and its successors and assigns.
