HomeMy WebLinkAbout794-22 Infrastructure Sales Surtax - Penny for PascoRESOLUTION NO. 794-22 A RESOLUTION BY THE CITY OF ZEPHYRHILLS, FLORIDA, IDENTIFYING THOSE PUBLIC FACILITY PROJECTS TO BE FUNDED BY THE GOVERNMENT INFRASTRUCTURE SALES SURTAX OF ONE CENT WHEREAS, Section 212.055(2), Florida Statutes, the "Local Government Infrastructure Surtax Act," authorizes the Board of County Commissioners of Pasco County to impose a local government infrastmcture surtax (of up to one per cent (1%) upon transactions occurring within Pasco County that are taxable under Chapter 212, Florida Statutes; and WHEREAS, monies received from the local government infrastmcture surtax authorized by Section 212.055(2), Florida Statutes, shall be utilized to acquire land, finance, plan, and construct infrastructure and to acquire land for conservation and the protection of natural resources to benefit its citizens: and WHEREAS, the proceeds of the surtax shall be distributed in accordance with an Interlocal Agreement between Pasco County, the six municipalities, and the School District; and WHEREAS, a description of the proposed projects which may be funded by the City of Zephyrhills distribution of the sales surtax is set forth in this Resolution. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Zephyrhills, Florida, as follows: Section 1. Interlocal A reement. Pursuant to the provisions of Florida law, the City has entered into an Interlocal Agreement for distribution of the surtax revenues. That Agreement provides that the parties to this Interlocal Agreement shall each adopt by Resolution a brief general description of projects, which may be funded from the proceeds of the surtax for the period of the tax from January 1, 2025, through December 31,2039. Section 2. Use of Surtax Proceeds. The surtax proceeds may be used by the City of Zephyrhills for the following proposed purposes or projects: 1. Transportation infrastructure which, for the purpose of this Resolution, means any fixed capital expenditure or fixed capital outlay associated with the construction, reconstmction, or improvement of roads, sidewalks, bike/pedestrian trails, parking, and transportation facilities, and any land acquisition, land improvement, design, permitting, and engineering costs related thereto. 2. Public drainage and water quality infrastructure designed to protect and iniprove the City's natural resources. 3. Acquisition of public safety communications equipment; public safety vehicles for use by the Police; or any other vehicles and such equipment necessary to outfit said vehicles for official use. 4. Other public buildings and facilities infrastrucftire which, for the purpose of this Resolution, means any fixed capital expenditure or fixed capital outlay associated with the constmction, reconstmction, or improvement of public facilities and any land acquisition, land improvement, design, permitting, and engineering costs related thereto. 5. Costs incurred for the financing, planning, design, engineering, constmction, reconstruction, or improvement of public facilities, including the acquisition of right of way or land necessary for such public facilities. 6. Economic Development infrastructure projects which may include but not be limited to utilities construction, reconstruction, extension, relocation, to include design, permitting, and engineering cost related thereto; including incentives related to economic development. 7. Specific projects shall be approved as a part of the public hearings for the adoption of the City's annual budget and Capital Improvement Plan. Amendments to the same shall only be made as a part of a noticed public hearing.
