A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA, ESTABLISHING A CHARTER
REVIEW COMMITTEE; ESTABLISHING A LIMITED PERIOD
OF EXISTENCE; MEMBERSHIP; PROVIDING A STATEMENT
OF DIRECTION; SETTING A FINAL COMMITTEE REPORT
DATE; PROVIDING FOR REVIEW OF THE FINAL
COMMITTEE REPORT AND A DECISION BY CITY COUNCIL
ON WHAT RECOMMENDATIONS TO PLACE BEFORE THE
VOTERS IN A REFERENDUM; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, an initial review of the City Charter by the City Council and City staff revealed
that many provisions of the Charter had been repealed or needed updated, and that other sections
were outdated or in conflict with City ordinances; and
WHEREAS, the City Council desires to initiate a further review of the Charter by an appointed,
temporary committee of City Council members to recommend what, if any, changes or
amendments should be made to the Charter so that it will continue to meet the City's needs as the
City's primary governing document and will not be in conflict with existing City ordinances; and
WHEREAS, the City Council desires that the review of the Charter shall be accomplished
within a reasonable time frame and shall be guided by the principles, purposes and directives set
forth herein.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Zephyrhills,
Florida, in regular session duly assembled, as follows:
Section 1. Charter Review Committee Established. The City Council hereby
establishes a Charter Review Committee (the "Committee") to review and make
recommendations to the Council regarding changes and amendments to the City Charter. The
Committee shall be wholly advisory in nature.
Section 2. Term of Existence. The Committee shall exist from the date of this
resolution and continue for a period not to exceed three hundred sixty-five (365) days therefrom
or the date on which it tenders its Final Report to the City Council, whichever first occurs, unless
otherwise extended by further resolution of the City Council.
Section 3. Membershi . The Committee shall consist of the Mayor plus all five (5)
City Council members.
Section 4. Committee Chair* Meetin s & Procedure. The Chairperson of the
Committee shall be selected by the members thereof at the initial meeting of the Committee. The
City Manager shall notify the members of the initial meeting which shall be held no later than
thirty (30) days from the date of adoption of this resolution. Thereafter, all subsequent meeting
dates of the Committee, its additional officers, meeting procedures, operational bylaws and other
methods of operation shall be adopted as a majority of the Committee sees fit, consistent with
Section 286.011, Florida Statutes and Florida's Sunshine Law.
Section 5. Statement of Committee Direction. The Committee is directed to
undertake a complete, timely, and thorough review of the City Charter. They are specifically
directed to receive public input from City residents and the Committee's members as to changes
and amendments that will allow the City's government to function efficiently, effectively and in
the best interests of its citizens. In addition, they are directed to schedule quarterly public
workshops with the City Council to update the Council on their progress and to provide
completed reviews to the Council for their consideration.
Particular attention should be paid to providing a document that is both consistent with the City's
current ordinances and that will enable the City's governing body and administrators to meet the
needs of the citizens well into the new millennium. Areas best regulated by ordinance or
resolution should not generally be considered for inclusion in the Charter.
Section 6. Final Re ort Date. The Committee shall issue a written final report
with their recommendations to the City Council on or before December 13, 2022.
Section 7. Review b Ci Council' Referendum. Upon receipt of the final
report from the Committee, the City Council shall consider, at a regular or special meeting,
which, if any, of the Committee's recommended changes, amendments or alterations to the City
Charter to submit to a referenda of the citizens of the City of Zephyrhills pursuant to Section
166.031, Florida Statutes. The Council may accept or reject any recommendation of the
Committee, in whole or in part.
Section 8.
