HomeMy WebLinkAbout1440-22 Hood Family Trust FLU Amendment and RezoningINSTR# 2022191433 OR BK 10681 PG 1006 Page 1 of 4 08/30/2022 09:33 AM Rcpt: 2497456 Rec: 35.50 DS: 0.00 IT: 0.00 Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller ORDINANCE NO. 1440-22 AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA APPROVING A SMALL SCALE FUTURE LAND USE MAP AMENDMENT TO THE CITY'S COMPREHENSIVE PLAN, CHANGING THE FUTURE LAND USE CLASSIFICATION FROM CITY MU (MIXED USE) TO RU (RESIDENTIAL URBAN) AND AMENDING THE CITY'S OFFICIAL ZONING MAP, CHANGING THE ZONING DESIGNATION FROM C3 (GENERAL COMMERCIAL) TO R3 (MEDIUM DENSITY RESIDENTIAL, FOR A PORTION OF PARCELS 14-26-21-0010-03000-0100 AND 14-26-21-0010-03000-0101; PROVIDING FOR CODIFICATION, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City Council has been given authority by the State of Florida pursuant to Chapter 163, Florida Statutes, to amend the Future Land Use Map of the City's Comprehensive Plan upon written consent of the land owners, together with the approval of the City Council for said Future Land Use Map amendment duly expressed by Ordinance; and WHEREAS, the City Council has been given authority by the State of Florida pursuant to Chapters 163 and 166, Florida Statutes, to rezone property within the City Limits upon receipt of written consent of the land owner, together with the approval of the City Council for said rezoning duly expressed by Ordinance; and WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold public hearing on the 19th day of July, 2022 to consider the Future Land Use Map Amendment and Rezoning; and WHEREAS, due public notice of hearing on the proposed Future Land Use Map Amendment and Rezoning was given by the City Council on August 11, 2022, as required by the Zephyrhills Land Development Code, as amended, and Chapters 163 and 166, Florida Statutes; and WHEREAS, the Future Land Use Map Amendment meets the criteria of a small scale map amendment pursuant to Chapter 163, Florida Statutes, and is consistent with the goals, objectives and policies of the Comprehensive Plan; and WHEREAS, the City has determined that the RU (Residential Urban) Future Land Use classification would be appropriate and consistent with the City's Comprehensive Plan; and WHEREAS, the City Council has determined that the R3 (Medium Density Residential) Zoning designation would be appropriate, would be consistent with the RU Future Land Use classification, and would promote the general welfare and encourage proper development within the City. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows: Section 1. The Whereas clauses above are true and accurate and are incorporated by reference and made a part of this Ordinance. Section 2. The following lands, lying and being situated in Pasco County, Florida to -wit: PareeFTax ID No.: 14-26-21-0010-03000-0100;14-26-21-0010-03000-0101 Physical Address: 38624 B Avenue; No Address Assigned Legal Description(s): See Exhibits "A" and "B" Acreage: 1.52 Acres (MOL) the Future Land Use classification is hereby amended to RU (Residential Urban) and the Zoning designation is hereby changed to R3 (Medium Density Residential) and included within the boundaries of the City of Zephyrhills, Florida. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. -1- OR BK 10681 PG 1007 Page 2 of 4 Section 4. That if any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no way effect the validity of the remaining portions of this ordinance. Section 5. This Ordinance shall become effective thirty-one (3 1) days after the adoption if no challenge is filed, as provided in the City Charter and Chapter 163, Florida Statutes.
