HomeMy WebLinkAbout1446-22 Zephyr Storage FLU and RezoningINSTR# 2022232782 OR BK 10714 PG 3332 Page 1 of 2 10/28/2022 11:00 AM Rcpt: 2518373 Rec: 18.50 DS: 0.00 IT: 0.00 Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller ORDINANCEAN ' FLORIDA APPROVING „ AMENDMENT TO THE CITY'S COMPREHENSIVE PLAN, THE FUTURE LAND USE CLASSIFICATION FROM COUNTY ROR ' r USE); AND ZONINGAMENDING THE CITY'S OFFICIAL ZONING MAP, CHANGING THE DESIGNATION FROM (COMMUNITY COMMERCIAL), FOR PARCEL 03-26-21-0010-00100- 0020; PROVIDING FOR CODIFICATION, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City Council has been given authority by the State of Florida pursuant to Chapter 163, Florida Statutes, to amend the Future Land Use Map of the City's Comprehensive Plan upon written consent of the land owners, together with the approval of the City Council for said Future Land Use Map amendment duly expressed by Ordinance; and WHEREAS, the City Council has been given authority by the State of Florida pursuant to Chapters 163 and 166, Florida Statutes, to rezone property within the City Limits upon receipt of written consent of the land owner, together with the approval of the City Council for said rezoning duly expressed by Ordinance; and WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold public hearing on the 16th day of August, 2022 to consider the Future Land Use Map Amendment and Rezoning; and WHEREAS, due public notice of hearing on the proposed Future Land Use Map Amendment and Rezoning was given by the City Council on October 13, 2022, as required by the Zephyrhills Land Development Code, as amended, and Chapters 163 and 166, Florida Statutes and WHEREAS, the Future Land Use Map Amendment meets the criteria of a small scale map amendment pursuant to Chapter 163, Florida Statutes, and is consistent with the goals, objectives and policies of the Comprehensive Plan; and WHEREAS, the City has determined that the MU (Mixed Use) Future Land Use classification would be appropriate and consistent with the city's Comprehensive Plan; and WHEREAS, the City Council has determined that the C2 (Community Commercial) Zoning designation would be appropriate, would be consistent with the MU Future Land Use classification, and would promote the general welfare and encourage proper development within the city. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows: Section 1. The Whereas clauses above are true and accurate and are incorporated by reference and made a part of this Ordinance. Section 2. The following lands, lying and being situated in Pasco County, Florida to -wit: Parcel/Tax ID No.: 03-26-21-0010-00100-0020 Physical Address: 6923 and 6927 Gall Boulevard; 37840 Daughtery Road Legal Description: THE SOUTH 100 FEET OF TRACT 1 AND THE WEST 30 FEET OF THE NORTH 221.60 FEET OF TRACT 1, AND THE WEST 400 FEET OF TRACT 16 LESS THE SOUTH 130 FEET THEREOF; LESS THAT PORTION WITHIN 25 FEET OF THE NORTHERLY SECTION LINE OF SECTION 3, TOWNSHIP 26 SOUTH, RANGE 21 EAST, AND LESS THE RIGHT OF WAY OF/FOR US HIGHWAY 301/GALL BOULEVARD, IN ZEPHYRHILLS COLONY COMPANY SUBDIVISION AS PER PLAT BOOK 2, PAGE 6, SECTION 3, TOWNSHIP 26 SOUTH, RANGE 21 EAST, PASCO COUNTY, FLORIDA. -1- OR BK 10714 PG 3333 Page 2 of 2 Acreage: 3.40 Acres (MOL) the Future Land Use classification is hereby amended to City MU (Mixed Use) and the Zoning designation is hereby changed to City C2 (Community Commercial) and included within the boundaries of the City of Zephyrhills, Florida. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 4. That if any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no way effect the validity of the remaining portions of this ordinance. Section 5. This Ordinance shall become effective thirty-one (3 1) days after the adoption if no challenge is filed, as provided in the City Charter and Chapter 163, Florida Statutes.
