ANNEXING ADDITIONAL TERRITORY TO BE INCLUDED
WITHIN THE BOUNDARIES DESCRIBED

ACCORDANCE WITH SECTION 171.044, FLORIDA STATUTES,
AS AMENDED
WHEREAS, Blue Triton Brands, owners of the lands hereinafter described in Section I
below, have authorized the annexation by the City of Zcphyrhills of the lands herein
described in Section 1, below; and
WHEREAS, the City is authorized by Chapter 171, Florida Statues, to annex contiguous
and infill area, and to extend the City limits upon receipt of written consent of the land
owner, together with the approval of the City Council after notice and public hearing; and,
WHEREAS, the City Council has reviewed and evaluated the applications submitted, and
has determined that the annexation of said lands into the City is in the public interest
and is consistent with the City's Comprehensive Plan and Land Development Regulations.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills,
Florida, as follows:
Section 1. The following described lands, lying and being situated in Pasco County, to
wit:.
Parcel/Tax I.D. NUMBERS: 13-26-21-0110-00000-0010
Legal Description:
A parcel of land lying and being in the West 1/2 of Section 13, Township 26 South, Range
21 East, Pasco County, Florida; said parcel being a portion of ZEPHYRHILLS COLONY
LANDS, according to the plat thereof recorded in Plat Book 1, Page 55, of the Public
Records of Pasco County, Florida, and being more particularly described as follows:
COMMENCE at a point marking the Northwest corner of the Southwest 1/ of Section
13, Township 26 South, Range 21 East, Pasco County, Florida; thence coincident with
the North boundary of the Southwest 1/ of said Section 13, s 89% 58'35" E a distance of
25.00 feet to apoint coincident with the East right-of-way boundary of 20th Street; thence
departing said North boundary, coincident with said East rigbt-of-way boundary. S
00%04'24" E a distance of 1664.57 feet to a point coincident with the South boundary
of Tract 104, ZEPHYRHILLS COLONY COMPANY LANDS, according to the plat
thereof recorded in Plat Book 1, page 55, of the Public Records of Pasco County, Florida,
said point being the POINT OF BEGINNING; thence departing said East right-of-way
boundary, coincident with said South boundary, N 89%49'26" E a distance of 633.81 feet
to a point coincident with the East boundary of said Tract 104, thence departing said South
boundary, coincident with said East boundary, N 00%05'15" W a distance of 332.95 feet to
a point marking the Northwest corner of Tract 103 of said Plat ZEPHYRHILLS
COLONY COMPANY LANDS; thence departing said East boundary, coincident with the
North boundary of said Tract 3 and the Easterly extension thereof, N 89%51'34" E a
distance of 674.57 feet to a point marking the Northwest corner of said Tract 102; thence
coincident with a ling being the Easterly extension of the South boundary of the lands
described in Official Records Book 7746, Page 1412 of the Public Records of Pasco
County, Florida; thence departing said West boundary, coincident with said South boundary
and its Easterly extension thereof, S 89%57'39" W a distance feet to a point coincident with
the East boundary of the lands described in Orifical Records Book 7774, Page 1667 of the

Public Records of Pasco, Florida; thence departing said South boundary, coincident with
said East boundary, S 00 03' 32" E distance 10.51 feet to apoint marking the Southeast corner
of said lands; thence departing said East boundary, coincident with the South boundary of
said lands and the Westerly extension thereof, S 89 49'28" W a distance of 308.00 feet to
a point marking the Northeast corner of the lands described in Official records Book 7631,
Page 1180 of the Public Records of Pasco County, Florida; thence coincident with the
East boundary of said lands, S 00 03'32" E a distance of 260.46 feet to a point marking the
Southeast corner of said lands and the Westerly extension thereof, S 89 49'45" W a distance
of 788.60 feet to a point coincident with the East right-of-way boundary of 20th Street;
thence coincident with said East right-of-way boundary, N 00 04'24" W a distance of
187.89 feet to the POINT OF BEGINNING.
Containing an area of 332,793.85 Square Feet, 7.640 acres, more or less.
Section 2. Said lands are contiguous to or is infill of the present City limits of the
City of Zephyrhills. That said lands are now unincorporated and lie in the same County
as said City, and when annexed would form a compact addition to the incorporated
territory of said City. That the owners of said lands contained in the said area to be
annexed have given written consent to have such annexation for said area. This annexation
is subject to the following conditions:
i. Installation of a 14 -foot sound attenuation barrier to be located at the
south and east perimeter of the proposed expansion of the parking
area. Barrier shall be a type designed for Industrial, Commercial,
Institutional, Roads, Highways & Bridges, Rail, and Residential
Developments. This system shall be manufactured with slots on the
front face of the panel and acoustic mineral wool enclosed within the
absorptive panel, and include proven and tested properties to
consistently reduce noise. This wall shall include noise reflective
panels in addition to absorptive panels.
ii. Where feasible, an increased "Type C" landscape buffer between
the subject's southern property boundary and abutting the
Woodland Acres neighborhood consisting of not less than a 50%
increase in the required canopy trees and understory trees, as
required by the LDC (shrubs shall not qualify as additional
required material), and;
iii. Payment of tree mitigation fees for removal of trees over and above
maximum allowed to be removed, as described per the LDC, and;
iv. Site lighting that reduces glare and lightpollutionon abutting Woodland
Acres neighborhood and is in conformance with any and all FAA
regulations due to proximity of runway approach(s) (if applicable). A
photometric plan shall be submitted indicating such conformance and
reduction of light pollution on abutting Woodland Acres
neighborhood.
Section 3. The City of Zephyrhills, Florida, is authorized by the legislature of the
State of Florida, pursuant to Section 171.044, F.S., and pursuant to the Charter of the
City of Zephyrhills, to annex contiguous or infill areas and to extend the City limits or
territorial boundaries upon receipt of written consent of all owners of land contained in
the area to be annexed, together with the approval of the City Council of the City of
Zephyrhills, of said annexation duly expressed by Ordinance.
Section 4. It is the intention of the City Council of the City of Zephyrhills, Florida to
annex the above-described lands to said City within its territorial limits and the boundary
lines of said City are hereby redefined and extended so as to include said area of lands
within its territorial limits upon the final passage of this Ordinance.
Section 5. This Ordinance shall become effective upon passage on the second reading
and signing by the Mayor.
The foregoing Ordinance No. 1458-23 was read and passed on the first reading, in an
open and regular meeting of the City Council of the City of Zephyrhills, Florida, on this
