HomeMy WebLinkAboutResolution No. 818-23 Tropical Storm IdaliaRESOLUTION NO. 818-23 EMERGENCY RESOLUTION BY THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS DECLARING A STATE OF EMERGENCY - TROPICAL STORM IDALIA. WHEREAS, the National Hurricane Center has forecast that Pasco County will experience significant effects from Tropical Storm Idalia, with the Governor of the State of Florida having declared governmental emergencies due to the threat to life, health, property, welfare or the public peace of the people ofthe State and Pasco County; and, WHEREAS, the incorporated area of the City ofZephyrhills is included in the areas threatened with severe storm damage; and, WHEREAS, this severe weather has the potential for causing extensive damage to public utilities, public buildings, public streets and roads, public drainage systems, commercial and residential buildings and areas; and, WHEREAS, Section 252.38(3)(a)(5), Florida Statutes, provides authority for amunicipal corporation such as the City ofZephyrhills to declare a state of local emergency for a period of time up to seven (7) days, which may be extended as necessary in seven (7) day increments, and to waive the procedures and formalities otherwise required of a municipal corporation by law pertaining to: a. b. c. d. e. f. g. Performance of public work and taking whatever prudent action is necessary to ensure the health, safety and welfare of the community Entering into contracts. Incurring obligations. Employment of permanent and temporary workers. Utilization of volunteer workers. Rental of equipment. Acquisition and distribution, with or without compensation, of supplies, materials and facilities. h. Appropriation and expenditure of public funds. NOW'THEREFORE'IT IS RESOLVED by the City Council of the City ofZephyrhills this 28"1 day of August, 2023, that the above described weather situation poses a serious threat to the life, health, property, welfare or public peace of the peopje of the CityofZephyrhills and that a state of local emergency shaTlrbe,andisherebv declared effective August 29, 2023 at 12:01 a:m. for aperiod oftime up to seven (7) days, which mavbe extended ^!.nc^es?ary^,seXen (7^ay,mcremente by ^ubsequent resolution, and all territory within the legal" incorporatedboundaries of the City ofZephyrhills, Pasco County, Florida shall be embraced by the provisions ofthiseme'rsenc^' resolution; " ' ----.-o-.-, BE IT FURTHER RESOLVED that the City Council for the City of Zephyrhills hereby exercises its stetutoiy authority, and appoints the City Manager as its representative to implement'and enforce the provisions of this declaration, and waives the procedures and formalities required by law of a municipal corporation, as authorized in Section 252.38(3)(a)(5), Florida Statites. All citizens are called upon and directed to comply with necessary emergency measures, to cooperate with public officials and civil emergency/disaster service forces in executing emergency operational plans and to obey and comply; with the lawful directions of properly identified public officers.
