HomeMy WebLinkAboutRerecord Ordinance 1459-23 Blue Triton FLUMA and RezoningINSTR# 2023175448 OR BK 10895 PG 1811 Page 1 of 3 10/04/2023 09:12 AM Rcpt: 2630160 Rec: 27.00 DS: 0.00 IT: 0.00 Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller RERECORD TO CORRECT SCRIVENER'S ERROR IN LEGAL DESCRIPTION AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA PROVIDING AN AMENDMENT TO THE CITY'S COMPREHENSIVE PLAN, PROVIDING FOR A SMALL-SCALE COMPREHENSIVE PLAN AMENDMENT TO THE FUTURE LAND USE MAP CHANGING FROM COUNTY RES -3 (RESIDENTIAL 3 D/U PER ACRE) TO CITY I (INDUSTRIAL) AND THE ZONING DESIGNATION FROM COUNTY R-1 TO CITY LI (LIGHT INDUSTRIAL) FOR APPROXIMATELY 7.64 ACRES OF REAL PROPERTY HAVING PARCEL NUMBER 13-26-21-0110-00000- 0010 LOCATED AT 4211 AND 4210 BREEZEWOOD DRIVE; 4210 AND 4211 CAMPHORWOOD LANE; 39101 AND 39119 WOODLAND DRIVE, ZEPHYRHILLS FLORIDA 33542 IN ACCORDANCE WITH SECTION 171.044, FLORIDA STATUTES, AS AMENDED; PROVIDING FOR CODIFICATION, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, Chapters 125 and 163 Florida Statutes, authorize the City Council of the City of Zephyrhills to prepare and enforce a Comprehensive Plan for the development of the City: and the City Council desires to amend the City of Zephyrhills' Comprehensive Plan, and: WHEREAS, the City Council has determined that the proposed amendment meets the criteria for a Small -Scale Comprehensive Plan Amendment pursuant to Section 163.3184, Florida Statutes, and the Zephyrhills Comprehensive Plan; and WHEREAS, the Zephyrhills Planning Commission, sitting as the Local Planning Agency, on October 18, 2022, held a public meeting on the proposed amendment to the Comprehensive Plan with due public notice, pursuant to Section 125.55(2), Florida Statutes, and recommended approval to the City Council; and WHEREAS, based upon the recommendations of the Zephyrhills Planning Commission to the City Council, said. Council has prepared the amendment to the City's Comprehensive Plan, and; WHEREAS, the proposed Future Land Use Map amendment: meets the criteria of a small- scale Future Land Use Map amendment and is consistent with the goals, objectives and policies of the Comprehensive Plan; and WHEREAS, the City Council has determined that the I (Industrial) future land use classification would be appropriate, would promote the general welfare, and would encourage proper development within the City; and WHEREAS, the City Council has determined that the LI (Light Industrial) Zoning Designation would be appropriate, would promote the general welfare, and encourage proper development within the City; and WHEREAS, the City Council desires to hereby formally adopt the amendment to the City's Comprehensive Plan. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, Florida, as follows: Section 1. Recitals. The Whereas Clauses above are true and accurate and are incorporated by reference and made a part of this Ordinance. Section 2. Authority. This Ordinance is enacted pursuant to Chapter 163, Florida Statutes, and under the home rule powers of the City. Section 3. Amendment. The following described lands, lying and being situated in the City of Zephyrhills, to wit: -I- OR BK 10895 PG 1812 Page 2 of 3 Physical Location: East of 201h Street and north of Woodland Drive, ZEPHYHILLS FLORIDA 3 3542 Parcel /Tax ID Number: 13-26-21-0110-00000-0010 Legal description: A parcel of land lying and being in the West 1/2 of Section 13, Township 26 South, Range 21 East, Pasco County, Florida; said parcel being a portion of ZEPHYRHILLS COLONY COMPANY LANDS, according to the plat thereof recorded in Plat Book 1, Page 55, of the Public Records of Pasco County, Florida, and being more particularly described as follows: COMMENCE at a point marking the Northwest corner of the Southwest 1/4 of Section 13, Township 26 South, Range 21 East, Pasco County, Florida; thence coincident with the North boundary of the Southwest 1/4 of said Section 13, S 89°58'35" E a distance of 25.00 feet to a point coincident with the East right-of-way boundary of 20th Street; thence departing said North boundary, coincident with said East right-of-way boundary, S 00°04'24" E a distance of 1664.57 feet to a point coincident with the South boundary of Tract 104, ZEPHYRHILLS COLONY COMPANY LANDS, according to the plat thereof recorded in Plat Book 1, Page 55, of the Public Records of Pasco County, Florida, said point being the POINT OF BEGINNING; thence departing said East right-of-way boundary, coincident with said South boundary, N 89°49'26" E a distance of 633.81 feet to a point coincident with the East boundary of said Tract 104, thence departing said South boundary, coincident with said East boundary, N 00°05'15" W a distance of 332.95 feet to a point marking the Northwest corner of Tract 103 of said Plat of ZEPHYRHILLS COLONY COMPANY LANDS; thence departing said East boundary, coincident with the North boundary of said Tract 3 and the Easterly extension thereof, N 89°51'34" E a distance of 67457 feet to a point marking the Northwest corner of Tract 102; of said Plat of ZEPHYRHILLS COLONY COMPANY LANDS; thence coincident with the West boundary of said Tract 102, S 00°03'16" E a distance of 250.03 feet to a point coincident with a line being the Easterly extension of the South boundary of the lands described in Official Records Book 7746, Page 1412 of the Public Records of Pasco County, Florida; thence departing said West boundary, coincident with said South boundary and its Easterly extension thereof, S 89°57'39" W a distance of 211.55 feet to a point coincident with the East boundary of the lands described in Official Records Book 7774, Page 1667 of the Public Records of Pasco County, Florida; thence departing said South boundary, coincident with said East boundary, S 00°03'32" E a distance of 10.51 feet to a point marking the Southeast corner of said lands; thence departing said East boundary, coincident with the South boundary of said lands and the Westerly extension thereof, S 89°49'28" W a distance of 308.00 feet to a point marking the Northeast corner of the lands described in Official Records Book 7631, Page 1180 of the Public Records of Pasco County, Florida; thence coincident with the East boundary of said lands, S 00°03'32" E a distance of 260.46 feet to a point marking the Southeast corner of said lands; thence departing said East boundary, coincident with the South boundary of said lands and the Westerly extension thereof, S 89°49'45" W a distance of 788.60 feet to a point coincident with the East right-of-way boundary of 20th Street; thence coincident with said East right-of=way boundary, N 00°04'24" W a distance of 187.89 feet to the POINT OF BEGINNING. Containing an area of 332,793.85 Square Feet, 7.640 acres, more or less. Section 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 5: That if any section, sentence, clause, or phrase of this ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. Section 6. Effective Date. This Ordinance shall become effective upon passage on the second reading and signing by the Mavor.
