MATERIAL LAYDOWN AREAS AND INDOOR STORAGE FACILITIES; PROVIDING O' CONFLICTS, SEVERABILITY,EXPIRATION 1 . DATE.EFFECTIVE WHEREAS, as provided in section 2(b), Article VIII of the Constitution of the State of Florida, and section 166.021(1), Florida Statutes, the City of Zephyrhills, Florida (the "City"), a municipal corporation, enjoys all governmental, corporate, and proprietary powers necessary to conduct municipal government, perform municipal functions, and render municipal services, and may exercise any power for municipal purposes, except as expressly prohibited by law; and WHEREAS, as provided in section 166.021(3), Florida Statutes, the governing body of each municipality in the state has the power to enact legislation concerning any subject matter upon which the state legislature may act, except when expressly prohibited by law; and WHEREAS, the City of Zephyrhills passed Ordinance 1455-23 on February 27, 2023 to establish a temporary moratorium on receiving and processing plans and permit applications for: Recreational Vehicle Storage, Material Laydown Areas, and Indoor Storage Facilities with an expiration date of February 27, 2024; and WHEREAS, the City of Zephyrhills staff is still reviewing and preparing standards to be implemented for storage facilities as described herein and is requested additional time, not to exceed six (6) months from the effective date of this Ordinance. SECTION 1. FINDINGS OF FACT. The above "Whereas" clauses are deemed findings of fact and are adopted herein. SECTION 2. EXPIRATION. The expiration date of Ordinance 1455-23 shall be the earlier of six (6) months after the adoption of this Ordinance, or the final adoption of an ordinance regulating Recreational Vehicle Storage, Material Laydown Areas, and Indoor Storage Facilities. SECTION 3. CONFLICTS. All ordinances or parts of ordinances in conflict with any of the provisions of this Ordinance are hereby repealed to the extent of such conflict. SECTION 4. SEVERABILITY. If any section, subsection, sentence, clause, phrase, word or provision of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this Ordinance. SECTION 5. EFFECTIVE DATE. This Ordinance shall become effective pursuant to the Zephyrhills Charter.
