If the fill material is to be used in Flood Zone "A" in connection with a permitted building using stem wall

If fill material is to be used in any area, I certify that use of such fill will not adversely affect adjacent
properties. If use of fill is found to adversely affect adjacent properties, the owner may be cited for violating
the conditions of the building permit issued under the attached permit application, for lots less than one (1)
acre which are elevated by fill, an engineered drainage plan is required.
If I am the AGENT FOR THE OWNER, I promise in good faith to inform the owner of the permitting conditions set forth in this affidavit prior to
commencing construction- I understand that a separate permit may be required for electrical work, plumbing, signs, wells, pools, air conditioning, gas, or
other installations not specifically included in the application. A permit issued shall be construed to be a license to proceed With the work and not as
authority to violate, cancel, after, or set aside any provisions of the technical codes, nor shall issuance of a permit prevent the Building Official from
thereafter requiring a correction of errors in plans, construction or violations of any codes. Every permit issued shall become invalid unless the work
authorized by such permit is commenced Within six months of permit issuance, or K work authorized by the permit is suspended or abandoned for a
period of six (6) months after the time the work is commenced. An extension may be requested, in writing, from the Building Official for a period not to
exceed ninety (90) days and Will demonstrate justifiable cause for the extension. If work ceases for ninety (90) consecutive days, the job is considered

This Home Improvement Contract CAgreement'l is entered into on 3/26/2022 CAgreement Date'l by
Marc Jones Construction LLC, dba Sunpro Solar C'Sunpro", "us" or "we'l and the customer(s) listed above CCustomer" or
"you'l (Sunpro and the Customer may be referred to together as the "Parties'l for the sale and installation of the
photovoltaic solar system described below ("System'l at the installation location listed above C'Property") upon the
terms and conditions set forth in this Agreement, including all Attachments attached hereto, all of which are
incorporated into this AgreementtYou are d to a completed copy of this
Agreement signed by both you and Sunpro before any work begins. The Agreement Date above is the date on
which the last Party . • Agreement.
1. CONTRACT PRICE
The Contract Price for the System is $37,091, consisting of $37,091 for your System, $0 for your Battery,
and $0 for your re -roofing, if any, including sales tax, if applicable. The Contract Price is subject to any
change orders agreed to in writing by both you and Sunpro. No federal or state incentives, rebates, or tax
credits were used to determine the Contract Price. If you are paying a portion of the Contract Price in cash and
financing the remainder, $_ of the Contract Price will be paid in cash as a down payment, and $_
will be financed through a third -party lender. If you are paying the entire Contract Price in cash, the amount of
your deposit, progress payments, and final payment are stated in Section 3.3 below.

3. PAYMENT TERMS
3.1, This Agreement 0 IS 0 IS NOT contingent on you obtaining approval for financing by a third -party
lender.
3.2. FINANCEQ EURCHA5ES:The Contract Price only includes the amount we charge for the System and t
Work, If you obtain financing from a third -party, your agreement with your lender will determine t
total amount you owe to them and your payment schedule, and may include interest, fees, finan
charges, ACH fees, UCC removal and refiling fees, or other charges. This Agreement does not contain t
terms of your financing agreement with your lender. You are not required to use any particular lender
finance any or all of the Contract Price. Sunpro is not affiliated with any lender and does not arrange
broker loans. If you choose to finance the Contract Price, carefully read any agreements and disclosu
forms provided by your lender. if you have any questions about your financing agreement, contact yo
finance provider before signing a contract. I
Sunpro will require payment as shown on the schedule in Section 3.3 below unless we reach an
alternative arrangement with your third -party finance provider. You will be responsible for payment of
the Contract
Price even if you do not secure financing. Additional payment terms and other terms and conditions of
this Agreement are included in Attachment 1.

3.4. Late Payment: If Sunpro does not timely receive any of the above payments within ten (10) days of their
due date, Sunpro may charge you an administrative late fee equal to the lesser of (i) one and a halt'
(1.5%) percent per month on the amount past due, or (ii) the maximum amount permitted under and
subject to applicable law. This late fee is not an interest charge, finance charge, time price differential, or
other such charge or payment of a similar nature.
3.5. Payment of Taxes: You acknowledge and agree that you are responsible for paying any applicab
personal property taxes on your System. i

4. 1 Sunpro will install the system within a reasonable amount of time after you sign this Agreement, but
no event later than six (6) months from the Agreement Date. We will schedule the installation of yo

4.4. The above installation timellne is an estimate only and may be adjusted as provided in this Agreeme
including for delays due to late payments, Customer Preparations, undisclosed or unforese
conditions, additional work required to make the Property suitable for the System, or those dela

caused by local permitting authorities, homeowners' associations, or other third -parties. Sunpro will

have any concerns, please notify Sunpro's customer service department with a detailed statement of

within 45 days after notice of the dispute, either Party may commence a formal proceeding pursuant to
the process detailed below. For any property, installation, or performance concerns, in addition to any
other requirements under applicable law, you must allow us access to inspect the System and, to the
extent helpful, the Property or any other property, data, information, or materials related to the dispute.
1,.2. ARBUMIM: If the Parties are unable to resolve a dispute as set forth in Sec. 6.1 above, you a
Sunpro agree that any dispute arising out of or relating to any aspect of the relationship between y
and Sunpro will be resolved exclusively by arbitration except as specifically provided below. T
arbitration, including the selection of the arbitrator, will be administered by the American Arbitrati
Association CAANJ under its Construction Industry Arbitration Rules and Mediation Procedures,
supplemented • the Consumer Due Process Protocol (collectively, the "AAA Rulesl, rather than in
court before a judge or jury. The location of the arbitration shall be the AAA closest to the Prope
unless otherwise agreed to by the Parties, and the arbitration shall be administered by a single neutr.

arbitration. This agreement to arbitrate all disputes includes claims arising before this Agreement, su
as claims related to statements about our products and services. You and Sunpro grant the arbitrator t

expenses, and attorneys'fees to the prevailing party. Attorneys' fees awarded to Sunpro for collection
any amounts due shall not exceed 20% of the amounts awarded to Sunpro. The arbitrator's decision w
be final and may be entered and enforced in any court having jurisdiction.

6.3. The arbitrator shall have the authority to award any legal or equitable relief that a court could order
grant under this Agreement. However, the arbitrator will not have authority to make any ruling or awa r a
applicable to any claimant other than you or any transaction other than yours. Sunpro and you fur I th
agree that all claims and disputes will be brought only on an individual basis, and the Parties waive t
right to bring or participate in a class action, PRIVATE ATTORNEY GENERAL, or representative action. T
arbitrator has no authority to consider or resolve any claim or dispute, or issue any relief on a clas
collective, or representative basis, unless the arbitrator obtains express consent from all parties. Y

7. Addresses for Notices: Any notices provided to Customer under this Agreement shall be sent to the
Installation Location and the Customer's email address indicated at the top of this Agreement. Any notices to
Sunpro under this Agreement shall be sent to: Marc Jones Construction, LLC d/b/a Sunpro, ATTN: Customer
Service, 22171 M.C.H. Rd., Mandeville, LA 70471.
8. Severabillity: In case any one or more of the provisions contained in this Agreement or any other documents
referred to herein or executed in connection with this Agreement or otherwise should be invalid, illegal, or
unenforceable in any respect, the validity, legality, and enforceability of the remaining provisions contained
herein and therein shall not in any way be affected thereby. It is the intention of the Parties that if any such
provision is held to be illegal, invalid, or unenforceable, there will be added in lieu thereof a provision as similar
to such provision as is possible to be legal, valid, and enforceable,

9.1 These production numbers reflect a system with present shading considered. These numbers could
change if shading from surrounding obstructions including, but not limited to, trees, roof obstructions,
etc. occurs. To achieve the numbers reflected in this document ( See 2.1 ), shading factors need to be
similar to present shading conditions.
9.2. Obstructions like vents, heat stacks, etc will cause shading on panels at certain points of the day
resulting in minor production loss (issue isolated to panels near obstructions only).
,�.3. The solar energy production provided here is only an estimate an does account for any pre-existi
shade issues, The final solar energy production guarantee will be issued after the job is complete a
based on the shade measurements conducted at the day of installation.
9.4. During the PPG Term, for every 12-month period beginning 36 months after the Operational Date (each
a "PPG Year"), Sunpro guarantees that the System will generate at least 95% of the annual estimated
production for that PPG Year, after accounting for degradation at the rate of 0.33% per year (the
"Guaranteed Annual Production'l.
9.5. If the System does not produce the Guaranteed Annual Production for any PPG Year, and you notify us

"Effective Utility Rate" means the average rate per kWh you paid to your electric company during the PPG
Year.

I have reviewed the existing structure referenced above to determine the adequacy of the existing structure support
the proposed installation of an array of solar panels on the roof.
Based on my review, the existing structure is adequate to support the proposed solar panel installation. This
assessment is based on recent on -site inspection by solar inspectors and photographs of the existing structure.
The photovoltaic system is designed to withstand uplift and downward forces; our assessment is regarding
the structure's support of the array. Stresses induced by the introduction of individual mount loads on the rafters or

Per IBC Section 1607.12.5.1, the areas of the roof where solar panels are located are considered
inaccessible, and therefore not subject to roof live loading. Live load in these areas is replaced by the dead
load of the solar array, 3 psf. The total gravity load on the structure is therefore reduced and the structure
may remain unaltered. Connections of the mounts to the underlying structure are to be installed in a
staggered pattern, except at the array ends, to distribute the loading evenly to the roof structure. The
stresses within the rafters or truss top chord due to the introduction of discrete mount loads are within acceptable I
imits, as shown on the attached calculations.
The solar panel array will be flush mounted (no more than 6" above the surrounding roof surface, and
parallel to the roof surface. Any additional wind loading on the structure due to the presence of the array is
negligible. The array structure is designed by the manufacturer to withstand uplift and downward forces
resulting from wind and snow loads. The attached calculations verify the capacity of the connection of the
solar array to the roof to resist uplift due to wind loads, the governing load case.

The reduced friction of the glass surface of the solar panels allows for the lower slope factor (Q per
Section 7.4 of ASCE 7-16 resulting in a reduced design snow load for the structure. This analysis
conservatively considered the snow load to be unchanged.
Seismic Load:
Analysis shows that additional seismic loads due to the array installation will be small. Even conservatively
neglecting the wall materials, the solar panel installation represents an increase in the total weight of the
roof and corresponding seismic load of less than 10%. This magnitude of additional forces meets the
requirements of the exception in Section 1113.4 of ASCE 7-16 . The existing lateral force resisting system
of the structure is therefore allowed to remain unaltered.

Conclusion:
To the best of my professional knowledge and belief, the subject construction and photovoltaic system
installation will be in compliance with all state and local building codes and guidelines in effect at the time
of our review.
Limitations:
Engineer's assessment of the existing structure is based on recent field reports and current photographs of
the elements of the structure that were readily accessible at the time of inspection. The design of the solar
panel racking (mounts, rails, connectors, etc.), connections between the racking and panels, and electrical
engineering related to the installation are the responsibility of others. The photovoltaic system installation
must be by competent personnel in accordance with manufacturer recommendations and specifications and
should meet or exceed industry standards for quality. The contractor is responsible for ensuring that the
solar array is installed according to the approved plans and must notify the engineer of any undocumented
damage or deterioration of the structure, or of discrepancies between the conditions depicted in the
approved plans and those discovered on site so that the project may be reevaluated and altered as required.
