Any arbitration proceeding brought under this Section, and any award, finding, or verdict of or from such proceeding shall
remain confidential between the parties and shall not be made public. HPA and Customer shall allow and participate in
discovery in ® with the Federal Rules of Civil Procedure for a limited period of ninety (90) days after the filing of the
answer or other responsive pleading, Unresolved discovery disputes may be brought to the attention of, and may be
disposed by, the arbitrator. A judgment upon any award rendered by the arbitrator may be entered in any court having
jurisdiction. If any term or clause of this Section agreement is found to be unenforceable or in violation of applicable state law,
HPA and Customer shall treat this Section as if that term or clause did not exist, and the remainder of this Section shall
remain in full force and effect, other than as discussed previously in regard to the waiver of class or representative actions
being appealable.

THAN LITIGATION. BY ENTERING INTO THIS AGREEMENT AND THE ARBITRATION PROVISIONS OF TH18 SECTION,

A, If there is a small claims court (or an equivalent type of court) located within the county and state in which Customer
resided during Customer's work with HPA, the Customer may, in accordance with the rules of that small claims court� choo-st
to b,ing (and must then keep) Customer's own claim in that small claims court,
B. HPA can file a lawsuit in court to collect on the monetary obligation represented by this Agreement. Any Claim raised by
Customer in response to such a lawsuit shall still be subject to this Section including the arbitration and mediation provisions
herein.
C. Customer may notify HPA in writing within ten days of Customer's execution of this Agreement stating clearly that
Customer rejects the arbitration option of this Section, and thereafter neither HPA nor Customer may invoke the arbitration
provision of this Section without the agreement of the other party, although such rejection will not invalidate any other
provision of this Section.
6. Delay / Unknown Conditions- HPA will not be responsible for delays that are due to events beyond its control, such as
Acts of God, labor strikes, bad weather, permitting delays or material shortages. If HPA determines within 30 days of entering
into this Agreement that the Agreement can not be performed as intended due, for example, to incorrect pricing or unforeseen
structural defects to the Customer's property, then HPA may cancel this Agreement and return all monies paid by the
Customer. HPA and the Cust6mer(s) have determined that a definite completion date is not of the essence to this Agreement.
7. Materials: All materials and work shall be furnished in accordance with normal industry tolerances, HPA is not responsible
for the actual verification of technical specifications of product manufacturers, but rather the materials used are represented
as such by the manufacturer,
