RESOLUTION NO. 871-26
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ZEPHYRHILLS, FLORIDA, REGARDING THE ESTABLISHMENT OF
STORMWATER UTILITY ASSESSMENT RATES. .
WHEREAS, the City Council (the "Council") of the City of Zephyrhills, Florida (the
"City") has enacted Ordinance No. 1522-26, which creates Chapter 57 of the City's Code of
Ordinances (the "Stormwater Code") to establish a stormwater utility and stormwater assessments;
and
WHEREAS, Section 57-09 of the Stormwater Code authorizes the City Council to impose
stormwater assessments against each developed parcel located within the stormwater service area,
measured by the number of Equivalent Residential Units (ERUs) attributable to each parcel, based
upon the special benefit accruing to such property from the stormwater management service
provided by the City; and
WHEREAS, the City Council finds that the assessment of stormwater service and
improvement costs based on impervious area, as represented by ERUs, fairly and reasonably
apportions those costs in proportion to the special benefit received by each developed parcel; and
WHEREAS, the City has caused to be prepared a rate and apportionment study
demonstrating that the stormwater assessment rates set forth herein are fair and reasonable and do
not exceed the proportional special benefit conferred upon each assessed parcel; and
WHEREAS, notice of this public hearing has been provided in accordance with applicable
law and Chapter 57 of the City Code; and
WHEREAS, the City Council finds it necessary and in the best interest of public health,
safety, and welfare to establish stormwater assessment rates per ERU for Fiscal Years 2027
through 2031.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ZEPHYRHILLS, FLORIDA:
Section 1. Recitals. The foregoing recitals are true and correct and are hereby incorporated
herein by reference.
Section 2. Establishment of Rates. The City hereby establishes the annual stormwater
assessment rates per ERU for Fiscal Years 2027 through 2032 to be between $85.00 and $110.00.
The annual stormwater assessment rates per ERU for each fiscal year shall be as follows:
Fiscal Year 2026-2027:
Fiscal Year 2027-2028:
Fiscal Year 2028-2029:
Fiscal Year 2029-2030:
Fiscal Year 2030-2031:
Fiscal Year 2031-2032:
$85.00 per ERU
$110.00 per ERU

The rates for Fiscal Years 2027-2028 through 2030-2032 are projected maximum rates.
The actual rate for each such fiscal year shall be established by the annual stormwater assessment
resolution adopted pursuant to Section 57-14 of the City Code for the applicable fiscal year and
shall not exceed the projected maximum rate without further action of the City Council following
notice and hearing as required by law.
Section 3. Effective Date. This Resolution shall take effect upon adoption by the City
Council; provided, however, that the stormwater assessments imposed hereby shall not be levied
or collected unless and until Ordinance No. 1522-26 has become effective in accordance with its
terms.
